RECO
MEETING DATE: October 28, 2025
MMENDATION
Motion to Award of Bid for Construction of City of Maricopa City Park Expansion (California Department of Parks and Recreation Grant Contract C9801018, Project No SW-15-004) and City of Maricopa Park Beautification and Rehab Project (Clean California Local Grant Funds No. CCL-5201-001) to the lowest responsive and responsible bidder S&B Sons Construction, Inc. in the amount of $1,967,586.64 Base Bid plus Alternative 1 in the amount of $254,945.44 and Alternative 2 in the amount of $38,400.12; total award $2,260,932.20; and to authorize Mayor and City Clerk to execute necessary documents on behalf of the city.
BACKGROUND
At the regularly scheduled meeting of Tuesday, August 26, 2025, Council approved plans and specs and authorized call for bids for the project referenced herein. Bid opening was scheduled for 2 p.m. Tuesday, September 30. During the bidding period, the city issued two addenda to the original plans and specs (copies attached) and revised the bidding deadline from September 30 to Tuesday October 7, 2025. This change was verbally reported to Council by the City Administrator at the regularly scheduled meeting of Tuesday, September 23, 2025 At the close of bidding at 2 p.m. Tuesday, October 7, 2025 bids were publicly opened and read by the City Clerk in the Administrative Conference Room at Maricopa City Hall. A total of 5 bids were received as noted on the attached Bid Opening Checklist. One bid was subsequently withdrawn because of computational errors in the bidder's submission. Lowest responsive and responsible bidder from the remaining four bidders was S&B Sons Construction, Inc. of Bakersfield with a base bid of $1,967,586.64.
The bid package for this project specified that the contract would be awarded to the lowest bidder for the base project. The specs for the project also include two optional features which would be awarded to the lowest responsive and responsible bidder on the base project given sufficient grant funds to cover the cost. Given the bids received and the amount of the lowest responsive and responsible bid the city has ample funding to award both alternatives, these being Alternative 1 in the amount of $254,945.44 and Alternative 2 in the amount of $38,400.12 for a total bid award of $2,260,932.20
It should also be noted that Clean California Local Grant Funding for this project includes a $190,000 construction engineering allowance for the CalTrans portion of the project. Construction engineering for the balance of the project is included in the Parks and Recreation Prop. 68 grant funding for the original project.

Analysis of the Three Lowest Bids
Bid Opening Date: 10/07/2025
During bid review, staff found major arithmetic errors in Black Hall Construction Inc's submission. The original base bid was $2,099,679.00, but after correction based on unit prices, it should be $1,560,971.69, a difference of $538,707.31 or about 34.51% higher than the corrected amount.
Pursuant to Public Contract Code § 20103.8, the City is authorized to correct minor arithmetic errors by recalculating totals based on the unit prices shown; however, the magnitude of this discrepancy exceeds what can be considered a minor extension correction and indicates a potential clerical mistake in bid preparation.
In accordance with Public Contract Code § 5103, a bidder may withdraw its bid without forfeiture of bid security if a material clerical error is demonstrated and the bidder provides written notice of withdrawal within five working days of bid opening. City staff must inform the bidder of the discrepancy and allow them to request withdrawal. Should the bidder elect to withdraw, the City may proceed with award to the next lowest responsive and responsible bidder.
If no withdrawal request is received within the statutory period, the City may determine the bid to be nonresponsive due to material inconsistencies that prevent a fair comparison with other bids. Staff will continue to Consult City Attorney before declaring the bid nonresponsive or allowing withdrawal to ensure compliance with Public Contract Code requirements prior to recommending contract award.

California Public Contract Code (PCC) § 20103.8
"In the case of discrepancy between the unit price and the total set forth for the same item, the unit price shall prevail. If the unit price is not set forth, the total price shall prevail." Per project specifications Page 58, the unit price controls.
The contractor's arithmetic or clerical mistake affects about 25% of the total bid, that's a major error, and it goes beyond a simple arithmetic correction under PCC § 20103.8.
Mistaken Base Bid amount is $2,099,679.00
Corrected Total Base Bid is $1,560,971.69
Difference is $538,707.31 which is 34.51% higher than the corrected base bid amount
1. PCC $ 20103.8 - Unit Price Prevails (Minor Arithmetic Corrections) This section only allows the City to fix mathematical extensions (e.g., quantity × unit price).
It does not allow changing or disregarding a major portion of the bid.
If the contractor's error causes a large deviation (like 25%), it may indicate a clerical or judgment mistake - not just arithmetic.
That's where Public Contract Code SS 5101-5103 apply.
2. PCC § 5103 - Withdrawal for Mistake
Under 5 5103, a bidder may withdraw a bid (without forfeiting the bid bond) if:
• The bidder notifies the public agency within 5 working days after bid opening, and • The bidder demonstrates by clear and convincing evidence that a material mistake was made, and
• The mistake was clerical, not judgmental (for example, transposition, omission, or decimal error).
If the City agrees the mistake is bona fide, the bid may be withdrawn but not corrected.
3. If the City Detects the Error
If the City notices the 25% discrepancy:
• The City cannot correct a major error to make the bid lower or higher — only minor math extensions.
• The City should notify the bidder and allow them to submit a withdrawal request under PCC § 5103.
• If the bidder does not request withdrawal, the City must evaluate responsiveness — a bid with a major inconsistency or unrealistic total may be found nonresponsive.
During bid review, staff found major arithmetic errors in Black Hall Construction Inc's submission. The original base bid was $2,099,679.00, but after correction based on unit prices, it should be $1,560,971.69, a difference of $538,707.31 or about 34.51% higher than the corrected amount.
Additionally, Black Hall Construction did not utilize the provided subcontractor forms and instead omitted the subcontractors' amounts by using their own forms.
In accordance with Title 49, Section 26.11 of the Code of Federal Regulations, and Section 4104 of the Public Contract Code of the State of California, as amended, the following information is required for each sub-contractor who will perform work amounting to more than one half of one percent (0.5%) of the Total Base Bid or $10,000 (whichever is greater).
Conclusion: Staff will continue to consult administrator and City Attorney before declaring the bid nonresponsive or allowing withdrawal to ensure compliance with Public Contract Code requirements prior to recommending contract award.

hereby certifies the above information regarding participation in a previous contract or subcontract subject to the equal opportunity clauses, as required by Executive Orders 10925, 11114, or 11246, and that, where required, he has filed with the Joint Reporting Committee, the Director of the Office of Federal Contract Compliance, a Federal Government contracting or administering agency, or the former President's Committee on Equal Employment Opportunity, all reports due under the applicable filling requirements.
Note: The above certification is required by the Equal Employment Opportunity Regulations of the Secretary of Labor (41 CFR 60-1.7(b) (1)) and must be submitted by bidders and proposed subcontractors only in connection with contracts and subcontracts which are subject to the equal opportunily clause. Contracts and subcontracts which are exempt from the equal opportunity clause are set forth in 41 CFR 60-1.5. (Generally only contracts or subcontracts of $10,000 or under are exempt.) Currently, Standard Form 100 (BEO-I) is the only report required by the Executive Orders or their implementation regulations.
Proposed prime contractors and subcontractors who have participated in a previous contract or subcontract subject to the Executive Orders and have not filed the required reports should note hat 41 CFR 60-1.7(b) (1) prevents the award of contracts and subcontracts unless such contractor submits a report covering the delinquent period or such other period specified by the Federal Highway Administration or by the Director, Office of Federal Contract Compliance, U.S. Department of Labor.
