AGENDA ITEM
TITLE: Review/Discuss/Provide Direction Re Current City Policy Governing Bereavement Leave for Employees of the City of Maricopa
PROPOSED BY: Eric G. Ziegler
MEETING DATE: November 18, 2025

RECOMMENDATION
Review/Discuss/Provide Direction Re Current City Policy Governing Bereavement Leave for Employees of the City of Maricopa

BACKGROUND
Chapter 2.40 of the Maricopa municipal Code as it now exists adopts a statutory Personnel system for the City of Maricopa. A portion of that system authorizes Council to adopt personnel policies and procedures by resolution.

Council adopted a fairly comprehensive set of rules and regulations by resolution in 1989. These rules and regulations have been updated since that time, most recently in June, 2019 (copy attached as Exhibit A). Prior to June, 2019 most recent amendments seem to have been adopted in 1992 and 1996 respectively. As a practical matter, this means that prior to the 2019 amendments/additions, the city's personnel policies were somewhat outdated and that many did not conform to then current law.

In 2019, upon recommendation of the City Attorney, staff re-worked the city's personnel system to conform to current law and practice in effect at the time the policies were revised and to vastly simplify rules and regulations to make them much more practical for a four employee operation.

Prior to the 2019 revisions, the city's policy with respect to employee Bereavement Leave was articulated in two sections of the previous (prior to 2019) policies and procedures.

The first reference occurs in Section 19 on page 4 of a prior policy (copy attached as Exhibit B) which states:
"All employees may, with approval of the Personnel Officer, take up to three (3) days of bereavement leave not chargeable against his sick leave or vacation to attend the funeral or memorial services for a member of his immediate family." Later references, some of which appear to conflict with the above reference, occur in Chapter 5 Statement of Policy Sick Leave on page 17 of a prior policy (copy attached as Exhibit B) which states in part:
"Sick Leave must be used for the following purposes only:

3. Death in family. (See Bereavement (Compassionate) Leave" Bereavement (Compassionate) Leave is also addressed on page 18 of Exhibit B as follows:
"1. Sick leave will be used for bereavement leave up to three days or 24 hours.

Bereavement Leave may be granted to a regular employee by the respective Department Head in the event of a death in the employees immediate family. For the purposes of this section only, the employee's immediate family shall mean the spouse, son, daughter, adopted child, step child, parent, grandparent, brother, sister, father-in-law, mother-in-law, brother-in-law, sister-in-law or a close relative if residing in the household of the employee." "2. Requests for bereavement leave in excess of three days for this purpose shall be subject to approval of the City Administrator and will be charged to accumulated sick Given that these and other policies superseded by the 2019 resolution are no longer controlling, the issue of Bereavement Leave is governed by the 2019 policy revisions which appear to be silent on the issue.

This means that at present, the city has no Bereavement Leave policy.

Staff recommends that Council Review/Discuss/Provide Direction Re Current City Policy Governing Bereavement Leave for Employees of the City of Maricopa. As an suggestion, Council may wish to consider a policy which grants employees paid leave of 3 or 5 days in the event of death in the immediate family. Council also needs to define the immediate family to which such a policy would apply. Staff would also suggest that part time employees be granted such leave on a pro-rated basis.
