6) Motion to adopt resolution entitled A Resolution of the City Council of the City of Maricopa Approving the Manner of Collection of Delinquent, Current and Future Garbage and Refuse Collection and Disposal Service Fees
BACKGROUND
NOTE: The City Attorney has determined that a two thirds vote is necessary to adopt a resolution authorizing collection of refuse collection and disposal service fees by the County Tax collector. Thus, the proposed resolution must be adopted with at least four votes if the city is to collect refuse collection and disposal service fees by assessment through the County Tax Collector.
Section 5473 of the California Health and Safety Code allows cities providing garbage and refuse collection manner.
Many small cities avail themselves of this option by executing an agreement with the county tax collector authorizing such action and by adopting an annual resolution assessing the appropriate fees and authorizing the county tax collector to bill for and collect those fees as noted above. This spares the cities the expense of establishing what is essentially a retail billing and collection operation and it assures that all fees are ultimately collected since failure to pay will eventually result in sale of delinquent properties.
Attached hereto is a report containing the description of each parcel of property receiving garbage and refuse collection and disposal service from the city of Maricopa and the amount of the garbage and refuse collection and disposal fee for each parcel for the fiscal year beginning July 1, 2026 and ending June 30, 2027 computed in conformity with the city's garbage and refuse collection and disposal fee resolution adopted by the City Council, the said report being attached to and made a part of a proposed resolution entitled A Resolution of the City Council of the City of Maricopa Approving the Manner of Collection of Delinquent, Current and Future Garbage and Refuse Collection and Disposal Fees authorizing the collection of such fees by the Kern County Tax Collector.
The deadline for submitting this resolution to the county is next week. After the county receives the city's resolution, a similar resolution directing the tax collector to proceed is adopted by the county Board of Supervisors.
Attached hereto is the proposed resolution including authorizing the County Tax Collector to collect the subject fees including Exhibit A which designates the parcel numbers to which the rates apply and the fee for each parcel.
Staff recommends that Council conduct the Public Hearing advertised for this time and date and, after receiving comments, protests and objections to assessments specified in in Exhibit A, to close the Public Hearing and consider a motion to adopt resolution entitled A Resolution of the City Council of the City of Maricopa Approving the Manner of Collection of Delinquent, Current and Future Garbage and Refuse Collection and Disposal Fees.

Section 5473 et seg of the California Health and Safety Code allows cities providing sanitary sewer service to place fees for such service on the county tax rolls and to have such fees collected by the county tax collector at the same time and in the same manner as other taxes are collected. The city of Maricopa has traditionally collected both sewer service fees and refuse collection and disposal fees in this manner.
Attached hereto is a report containing the description of each parcel of property receiving sanitary sewer service from the city of Maricopa and the amount of the sewer service fee for each parcel for the fiscal year beginning July 1, 2026 and ending June 30, 2027 computed in conformity with the city's sewer service fee ordinance adopted by City Council, the said report being attached to a proposed resolution entitled A Resolution of the City Council of the City of Maricopa Approving the Manner of Collection of Delinquent, Current and Future Sewer Service Fees as Exhibit A authorizing the collection of delinquent, current and future sewer service fees by the Kern County Tax Collector.
The deadline for submitting this resolution to the county is August 10, 2026. After the county receives the city's resolution, a similar resolution directing the tax collector to proceed is adopted by the county Board of Supervisors.
Attached hereto is the proposed resolution authorizing the County Tax Collector to collect the subject fees. Attached to the resolution is Exhibit A which designates the parcel numbers to which the rates apply and the fee for each Staff recommends that Council conduct the Public Hearing advertised for this time and date and, after receiving comments, protests and objections to assessments specified in in Exhibit A, to close the Public Hearing and consider a motion to adopt resolution entitled A Resolution of the City Council of the City of Maricopa Approving the Manner of Collection of Delinquent, Current and Future Sewer Service Fees

BACKGROUND
This Public Hearing is being held as required by AB 2561/Government Code 3502.3 for the purpose of presenting the status of city staff vacancies and recruitment retention efforts. The city is required to do this once per fiscal year and before the City's final budget for the impending fiscal year is adopted.
In September, 2024, the Governor signed Assembly Bill 2561, subsequently codified as Government Code 3502.3.
This law amended the Meyers-Milias-Brown Act (the law governing employer/employee labor relations in California, schools excepted) to require public agencies to address job vacancies that are apparently perceived as a "problem" by the legislature.
As previously noted, the primary purpose of the public hearing will be to present details regarding the number of open positions, steps taken to fill them, and potential areas for improvement, as well as to allow citizens to make their comments known.
Under Government Code 3502.3, public agencies are required to present at least once each fiscal year, during an advertised public hearing before the governing board and prior to adoption of its final budget for the coming fiscal year, the following information: 1) Status of Job Vacancies; 2) Status of Recruitment Efforts; 3) Retention Efforts.
During the presentation, the public agency is also required to identify any necessary changes to policies, procedures and/or recruitment activities that may lead to obstacles in the recruitment process.
In addition, if the number of vacancies within a single bargaining unit meets or exceeds 20% of the total number of authorized full-lime positions, the public agency shall, upon request of the recognized employee organization, include the following information during the public hearing: 1) Total number of job vacancies; 2) Total number of applicants for vacant positions; 3) Average number of days to complete the hiring process from the time a position is posted; 4) Opportunities to improve compensation and other working conditions.
VACANCIES
Maricopa is one of the smallest cities in California and one of the most financially challenged. The city employs a total of six people, four of whom are full-time, meaning that those employees work a total of 32 regularly scheduled hours each week. The other two employees work part-time, meaning that those employees work a total of less than 32 hours each week.
During Fiscal Year 2025-2026, the City experienced one employee vacancy. The position was advertised for three consecutive weeks in the Taft Midway Driller, The Bakersfield Californian, and the Fresno Bee, each of which serves as an adjudicated newspaper of General Circulation in the Taft-Maricopa, Kern, and Fresno County areas. Despite these recruitment efforts, the position remains vacant as of the date of this report.
The obvious conclusion regarding vacancies is that the City of Maricopa has no significant number of position vacancies during the fiscal year in question, i.e., FY 2025-2026, nor does the city have any significant delay in filling the few vacancies that do occur.
BARGAINING UNIT
The City of Maricopa's employees are not represented by a recognized employee organization, nor are the city's employees covered by a negotiated Memorandum of Understanding (MOU). In the absence of representation, the city offers no comments related to bargaining unit issues.
RECRUITMENT / RETENTION
Given that the City of Maricopa contracts with Kern County for Public Safety (Police and Fire) Services as well as for certain planning, building, inspection, and similar services, it seldom has a need for extended recruiting services.
Thus, all of the city's job vacancy recruiting efforts for at least the past several years have been satisfied by advertising such vacancies in the Taft Midway Driller, Bakersfield Californian, and Fresno Bee, which are adjudicated newspapers of General Circulation in the Taft-Maricopa, Kern, and Fresno County areas. The City sees no reason to modify the current recruiting process, given its success in timely filling of job vacancies for an extended numberof years.
Similarly, given the small size of the City's workforce and the relative infrequency of job vacancies, the City sees no reason to amend its policies regarding retention of existing employees.
HNCORPORATED

The city is required to do this once per fiscal year and before the City's final budget is adopted.

Assembly Bill No. 2561
CHAPTER 409
An act to add Section 3502.3 to the Government Code, relating to public employment. [Approved by Governor September 22, 2024. Filed with Secretary of State September 22, 2024. ]
LEGISLATIVE COUNSEL'S DIGEST
AB 2561, McKinnor. Local public employees: vacant positions.
Existing law, the Meyers-Milias-Brown Act (act), authorizes local public employees, as defined, to form, join, and participate in the activities of employee organizations of their own choosing for the purpose of representation on matters of labor relations. The act requires the governing body of a public agency to meet and confer in good faith regarding wages, hours, and other terms and conditions of employment with representatives of recognized employee organizations and to consider fully presentations that are made by the employee organization on behalf of its members before arriving at a determination of policy or course of action.
This bill would, as specified, require a public agency to present the status of vacancies and recruitment and retention efforts at a public hearing at least once per fiscal year, and would entitle the recognized employee organization to present at the hearing. If the number of job vacancies within a single bargaining unit meets or exceeds 20% of the total number of authorized full-time positions, the bill would require the public agency, upon request of the recognized employee organization, to include specified information during the public hearing. By imposing new duties on local public agencies, the bill would impose a state-mandated local program. The bill would also include related legislative findings.
The California Constitution requires local agencies, for the purpose of ensuring public access to the meetings of public bodies and the writings of public officials and agencies, to comply with a statutory enactment that amends or enacts laws relating to public records or open meetings and contains findings demonstrating that the enactment furthers the constitutional requirements relating to this purpose.
This bill would make legislative findings to that effect. state to reimburse local agencies and school districts for certain costs The California Constitution requires the
mandated by the state. Statutory provisions establish procedures for making that reimbursement.
This bill would provide that no reimbursement shall be made pursuant to these statutory provisions for costs but would recognize that a local agency or school district may mandated by the state pursuant to this act,
pursue any available remedies to seek reimbursement for these costs.
Vote: majorily Appropriation: no Fiscal Committee: yes Local Program: yes THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS:
SECTION 1. The Legislature finds and declares as follows:
(a) Job vacancles in local government are a widespread and significant problem for the public sector affecting occupations across wage levels and educational requirements. (b) High job vacancies impact public service delivery and the workers who are forced to handle heavier workloads, with understaffing leading to burnout and increased turnover that further exacerbate staffing challenges.
(c) There is a statewide interest in ensuring that public agency operations are appropriately staffed and that high vacancy rates do not undermine public employee labor relations.
SEC. 2. Section 3502.3 is added to the Government Code, to read:
3502,3. (a) (1) A public agency shall present the status of vacancies and recruitment and retention efforts during a public hearing before the governing board at least once per fiscal year. (2) If the governing board will be adopting an annual or multiyear budget during the fiscal year, the presentation shall be made prior to the adoption of the final budget. (3) During the hearing, the public agency shall identify any necessary changes to policies, procedures, and recruitment activities that may lead to obstacles in the hiring process. (b) The recognized employee organization for a bargaining unit shall be entitled to make a presentation at the public hearing at which the public agency presents the status of vacancies and recruitment and retention efforts for positions within that bargaining unit.
(c) If the number of job vacancies within a single bargaining unit meets or exceeds 20 percent of the total number of authorized full-time positions, the public agency shall, upon request of the recognized employee organization, include all of the following information during the public hearing:
(1) The total number of job vacancies within the bargaining unit. (2) The total number of applicants for vacant positions within the bargaining unit. (3) The average number of days to complete the hiring process from when a position is posted. (4) Opportunities to improve compensation and other working conditions. (d) This section shall not prevent the governing board from holding additional public hearings about vacancies. (e) The provisions of this section are severable. If any provision of this section or its application is held invalid, the invalidity shall not affect other provisions or applications that can be given effect without the invalid provision or application.
(f) For purposes of this section, "recognized employee organization" has the same meaning as defined in subdivision (a) of Section 3501.
SEC. 3. The Legislature finds and declares that Section 2 of this act, which adds Section 3502.3 to the Government Code, furthers, within the meaning of paragraph (7) of subdivision (b) of Section 3 of Article I of the California Constitution, the purposes of that constitutional section as it relates to the right of public access to the meetings of local public bodies or the writings of local public officials and local agencies. Pursuant to paragraph (7) of subdivision (b) of Section 3 of Article I of the California Constitution, the Legislature makes the following findings:
It is in the public interest, and it furthers the purposes of paragraph (7) of subdivision (b) of Section (3) of Article 1 of the California Constitution, to ensure that information concerning public agency employment is available to the public.
SEC. 4. No reimbursement shall be made pursuant to Part 7 (commencing with Section 17500) of Division 4 of Tille 2 of the Government Code for costs mandated by the state pursuant to this act. It is recognized, however, that a local agency or school district may pursue any remedies to obtain reimbursement available to it under Part 7 (commencing with Section 17500) and any other law.
AB 2561 Puts a Spotlight on Public
Sector Vacancy Rates

Assembly Bill ("AB") 2561 adds Government Code Section 3502.3 to the Meyers- Milias-Brown Act ("MMBA"), imposing new obligations on public agencies related to tracking and presenting information on job vacancies. The new law and the legal obligations thereunder take effect January 1, 2025.
Note: On December 9, Liebert Cassidy Whitmore will be conducting a training for public agency clients on this new law. Registration will include a number of resources intended to facilitate public agency compliance with the new law.
Register for the training here.
AB 2561 declares that job vacancies in local government are a widespread and significant problem for the public sector, and that job vacancies may undermine labor relations between public agencies and their employees. AB 2561 requires that, on an annual basis, public agencies assess and address vacancy rates in order to help avoid the negative effects of understaffing on the delivery of public services as well as on public employees.
New Public Hearing Obligations Require Public Agencies to Report on Vacancies Under Government Code Section 3502.3, public agencies must now do the following:
1. Track job vacancies at the agency;
2. Present information on the status of the vacancies (such as information on the number of posted job openings, candidates interviewed, eligibility lists created, conditional offers made, etc.) and the agency's recruitment and retention efforts.
An agency must present this information at a
governing busy priest oice perisco ear palich i adopt an agal or multiyear budget in a given year, the public hearing must occur prior to the governing body adopting the agency's budget; anc
3. Identity, during the public hearing, any policies, procedures, and recruitment activities that may present obstacles in the agency's hiring process and potentia changes that may alleviate such obstacles.
These affirmative obligations apply to all public agencies subject to the MMBA, even if the agency does not have any represented employees. However, if the agency has a represented workforce, the new law entitles recognized employee organizations to make a presentation at the public hearing when the agency makes its presentation.
Notably, the law does not regulate the presentation that the employee organization is entitled to make.
Additional Obligations May Apply if the Vacancy Rate in a Bargaining Unit:
Exceeds 20%
In addition to the requirements described above, if the vacancy rate in a bargaining unit is at least 20% of the total number of authorized full-time positions, the employee organization that represents the bargaining unit may request that the agency present additional information at the public hearing.
Upon such a request, a public agency must present the following additional information:
1. The total number of job vacancies within the bargaining unit;
2. The total number of applicants for vacant positions within the bargaining unit;
3. The average number of days to complete the hiring process from when a position is posted; and
4. Opportunities to improve compensation and other working conditions.
Implications for Public Agency Communications with Employee Organizations The intent of the new law is to require public reporting on information regarding vacancy rates and to leverage the disclosure of such information to increase staffing at public agencies and increase compensation for public employees to assist with recruitment and retention efforts.
In terms of meet and confer obligations, AB 2561 does not change the obligations to which public agencies are subject. For example, public agencies continue to possess the management right to decide which services to offer and the level of funding for such services. Public agencies must also continue to discharge their obligation to meet and confer over certain decisions that affect the matters within the scope of representation implicated by high vacancy rates, such as the decisions to contract out bargaining unit work, remove work from a bargaining unit, and to make material changes to an employee's workload. Public agencies regularly rely on these strategies to maintain important public services where there are high vacancy rates.
In terms of requests for information, the new law will likely precipitate an increase in the number of requests from employee organizations seeking information regarding vacancies that the employee organizations may use in their presentation at the public hearing. Agencies should be proactive and prepare for such requests, even before employee organizations make a request. Agencies should also be mindful that employee organizations are entitled to information that is relevant and necessary to their representational responsibilities and that the obligation to provide such information extends to information beyond that which relates to vacancies.
The new law will also affect agency budget planning processes. Agencies should be prepared to add the following steps to their budget planning process in order to account for and address the labor relations issues implicated by the new law:
• Review and analyze agency vacancy rates prior to or early on in the budget planning process, focusing on vacancy rates by bargaining unit. • Consider conducting a statting study in order to analyże the number of positions actually required to provide the public services that the governing body prioritizes
• Present vacancy information by bargaining unit to the relevant employee organizations, along with information regarding recruitment and retention efforts for that bargaining unit. Agencies may consider presenting such information proactively on a regular basis (e.g., January 1 each year) and standardizing the information presented to each employee organization in order to potentially avoid more expansive requests for information. recognized employee organizations.
• Provide advance notice of the hearing to all recognized employee organizations, along with notice that they have the right to make presentations at such hearings.
• Since AB 2561 does not regulate employee organization presentations, agencies should consider proposing presentation parameters to employee organizations and attempt to reach written agreements on the terms of the presentations with each employee organization. Such terms may specify the number of presenters, length of presentations, subjects to be discussed, and data to be presented.
• In the event that an agency receives direction from its governing body to inge an out un and a and cite it he diant mployes,
• Prepare for employee organizations to make a number of proposals related to sta dress such as lyrand staffin sansend about understanding ander to workload for existing staff
One potential unintended consequence of the new law is that agencies with persistently high vacancy rates in difficult to recruit positions may consider reducing funding for such positions (i.e., defunding vacant positions) in order to lower the vacancy rate and avoid the additional reporting obligations that attach when there is a high vacancy rate

AGENDA ITEM
TITLE: Consideration of Participation in Kern County's HUD Urban County Entitlement Program for the 2027-2029 Qualification Period
PROPOSED BY: Eric G. Ziegler
MEETING DATE: June 23, 2026
RECOMMENDATION
Consider and take action regarding Participation in Kern County's HUD Urban County Entitlement Program for the Qualification Period of July 1, 2027, through June 30, 2029.
BACKGROUND
The City of Maricopa has received an invitation from Kern County Planning and Natural Resources Department to rejoin the County's HUD Urban County Entitlement Program for the qualification period beginning July 1, 2027, through June 30, 2029.
The City of Maricopa previously participated in the County Entitlement Program, and rejoining the program would provide the City with an estimated annual allocation of CDBG funding of approximately $80,000 - $230,000; however, the City would be limited to those funds and would not be eligible to apply independently for other CDBG funding opportunities during the three-year qualification period.
Participation in the program requires Council adoption of the attached Resolution and approval of the attached Cooperation Agreement.
Council consideration is considered at this time to determine whether participation in the Urban County Entitlement Program is in the best interest of the City.
