AGENDA ITEM
TITLE: REVIEW CITY PARK EXPANSION AND REHABILITATION PROJECT STATUS UPDATE FOR CLEAN CALIFORNIA GRANT #CCL-5201-001 & 2018
PARKS BOND ACT GRANT # SW-15-004
PROPOSED BY: Lauri Robison
MEETING DATE: October 13, 2026
RECOMMENDATION: None. This item is presented for informational purposes only BACKGROUND:
At the request of the City Council, Upland Construction, the City's Construction Manager for the City Park Expansion and Rehabilitation Project, was asked to provide an update regarding the current progress and anticipated completion of the City's park project.
Upland submitted a Project Status Report dated October 5, 2026. The report provides an update on the current status of the project, including work that has been substantially completed, work currently in progress, remaining work, grading and rock installation, anticipated scheduling, and outstanding quality-control items.
Uplands reports that the contractor's (S&B Sons, Inc.) current contract working days are scheduled to expire on October 22, 2026. The report also addresses the potential for liquidated damages to begin accruing after that date, as well as the contractor's current staffing and progress toward completion.
The written Project Status Report from Upland Construction is included with this staff report for the City Council's review and information.
UPLAND CONSTRUCTION
CONSTRUCTION & CIVIL ENGINEERING
Rock installation is dependent upon grading being finished. The rock work includes:
• 2"-4" rip-rap at the drainage swale
• 3/4" standard gray gravel
• 3/4" red lava rock
• Decomposed granite in the landscape and pump track areas Before rock can be placed, each area must be finish graded. Irrigation, soil preparation, and planting must also be completed first so the rock does not have to be removed later to install them. Because finish grading is not complete, they are currently only able to work on the decomposed granite & rock applications within the pump track area.
Anticipated Schedule
The Contractor has submitted 3 construction schedules over the course of the project. Unfortunately, none of the schedules have been properly adhered to so utilizing their most recently submitted schedule would not be useful.
The most useful source of data we have is that the contracted working days with the Contractor ends on October 22, 2026. After this date, Liquidated Damages will begin to come into effect. Per Contract documents, the City is entitled to $750/Day in addition to the City's engineering, inspection and overhead costs during the extension, taken from the final payment.
We will continue to monitor the contractor's progress closely. For full transparency, completing the work by October 22 will require consistent crews and multiple trades working concurrently for the remainder of the project. The contractor had no crew at all on site on September 30, 2026 and has consistently been inconsistent with the size of their work force.
Additionally, we continue to work through quality-control issues on the Contractors end. In many instances, they have been required to re-do their work as it did not meet standards such as compaction requirements, ada compliance, finish quality etc. We anticipate a large "punch list" to be presented to the Contractor at the point of full substantial completion which will require that the Contractor remediate some items. We try and point these items out as they go, but until the site is fully cleaned up and made presentable it is hard to see everything.
We will continue to stay in contact with the City to provide as accurate information as possible.
Sincerely,
