Honorable Mayor and Members City Council Meeting
of the Marina City Council of May 10, 2022
CITY COUNCIL HOLD STUDY SESSION REGARDING THE DUNES
DEVELOPMENT PROJECT AND HAVE A DISCUSSION REGARDI NG
COMPENSATION AND MITIGATION FOR TREES ILLEGALLY REMOVED AND
CHANGING POLICIES AND PROCEDURES TO ENSURE COMPLIANCE WITH
TREE REMOVAL REGULATIONS
RECOMMENDATION: City Council consider
1. Review the submitted staff report and the standard operating procedures
2. Adopt the recommended penalties for the unpermitted removal of trees
SUMMARY:
On March 21, 2022 Mar ina residents informed City staff that a r ow of trees within the Dunes Development Project area were removed without the benefit of permits. After this incident , the Community Development Director received approximately thirty (30) emails about the removal of a grove of trees within Phase 3 of the project. The applicant, Marina Community Par tners (MCP), was directed by city staff to cease removal of all trees moving forward until a deeper investigation occurred and the City Council could provide direction on how to resolve this issue moving forward. On A pril 5, 2022 the City Council directed staff to organize a community meeting with concerned citizens and to have a special City Council meeting prior to May 31, 2022 to discuss this matter in more detail.
Figure 1-Dunes Phased Development Map
PROJECT TREE BACKGROUND:
On January 14, 2021 the Planning Commission reviewed the design review and tree removal permits for BMR Sites #1 and #2 within the Dunes Development.1 As shown in Figure 2 several trees within BMR site 2 were recommended for removal (1397, 1398, 1410, 1411, 1412). On March 21, 2022, the applicant’s sub-contractor removed an asbestos laden pipe that was below the surface of trees 1384-1396 without prior approval from the City of Marina.
Figure 2-Tree Removal
PENALTY
Tree Mitigation-The Development Agreement between the City of Marina and Marina Community Partners (MCP) was executed on July 8, 2005. This agreement froze certain City regulations to those in effect at the time of execution of the agreement. The provisions of the 2005 Marina Municipal Code regulate tree removal within the Specific Plan area. The removal of all trees identified as protected in the Specific Plan and determined to be in fair or good condition a re required to be replaced at 2:1 ratio, unless removed without a permit. In such cases, the recommended ratio be multiplied by a factor of 3 (6:1). 2 The University Village
Specific Plan requires the condition of Monterey cypress and pines be recorded. The condition of Eucalyptus are not required to be recorded and are therefore not required to be replaced.3
Code Enforcement-In addition to the requirement to replace 6 trees for every 1 removed without permits (6:1), the City Council does have the authority under the Municipal Code to declare this violation a public nuisance
1 January 14, 2021 Planning Commission packet: https://www.cityofmarina.org/AgendaCenter/ViewFile/Agenda/_01142021- 209. Tr ee Removal Permit for the Removal of 9 Monterey Pi ne Trees, 5 Monterey Cypress Trees, 2 Mexican Fan Palms, 1 Coast Live Oak, and 1 Eucalyptus Tree for the development of 140 affordable housing units on Lot 24 – Area Q (APN 031- 251-014) and a portion of Lot 20 – Area F (APN 031-282-043)
2 12.04.060(c)-Compensation Plans. However, until such time as said public tree planting plan is adopted, such replacement trees and/or payment shall be based upon the replacement of the healthy trees to be removed on a m inimum two-for-one basis unless the compensation plan is appealed, in which case the city council may approve tree replacement at a lesser rate.
12.04.100(c)-The planting of replacement trees on site or the payment to the city to fund the purchase, planting and maintenance of off-site tree plantings should be in accordance with the tree replacement formula found in Section 12.04.060C multiplied by three for each tree removed in violation of this chapter.
3 Trees 6’’ diameter breast plate height (DBH) and greater are recorded and only cypress, oaks, pines will be recorded. The condition of eucalyptus will not be recorded. Acacia trees will not be recorded in [a] table but locations will be noted on [a] map (Chapter 5, Development Regulations, University Village Specific Plan, pg 118) and to make the appli cant appear be fore a City administrative hearing officer via a code enforcement proceeding as identified within Chapter 1.12 of the Marina Municipal Code.4
Default-Finally, pursuant to Section 11.4 of the 2005 D isposition and Development Agreement (DDA), the City Council can find the applicant in default of this agreement. Questions related to finding MCP in default with the DDA should be directed to the City Attorney on May 10, 2022.
TREE STANDARD OPERATING PROCEDURES (SOP)
In light of the unpermitted removal of trees, the Community Development Director, Guido F. Persicone, did a comprehensive review of the City’s tree removal permitting processes and has prepared a standard operating procedure for the removal and retention of trees moving forward. Please see Attachment 1 to this report for more details, but the main recommendation being pushed forward is that upon review of the City’s policies and procedures, there were many interested parties involved in this permit process, the applicant, the arborist and the assigned city planner, but a break down in the system was after approval of the tree removal permit by the Planning Commission, but prior to movement of dirt on the site the assigned project planner was not signing off on a specific tree protection sheet within the grading or building permit plans.
Moving forward, before any dirt is moved or a demolition permit issued by the Building Division, a project planner will be required to approve a Tree Protection and Removal Sheet on a set of plans. The policy has been broadly written to basically mean any permit issued by the City will require the planners to stamp a set of plans to ensure the adequate protection and removal of specific trees.
No s
ite modification permits, including but not limited to grading, building or demo permits will be issued in which protected trees are on a property unl ess an applicant submits a separate Tree Protection and Removal Sheet in their submittal package. This sheet in the building, grading, or demo permit set of plans w ill clearly label the trees on site that will be retained, and which will be removed.
No permits will be issued until the project planner has reviewed this sheet of the plans and stamped said plans either in Blue Beam or with a hard copy stamp5.
Additionally, the applicant has agreed to on site monitoring by City staff prior to work near or abutting trees in the near term to provide an additional check on implementation of this new SOP.
COUNCIL QUESTIONS
At the April 5th Council meeting several questions were submitted to city staff for additional follow up. The answers to those questions can be found in Attachment 2 to this report.
COMMUNITY
MEETING:
On May 2, 2022 a community meeting within the development occurred with concerned citizens. At this meeting the following issues/comments were discussed
• The applicant (MCP) apologized to the community for inadvertently removing t rees and pledged to work closely with the City of Marina to ensure this mistake does not happen again. • MCP reviewed their current submittal for Phase 2 West and Phase 3 and agreed to retain an additional twenty-four (24) trees within the project site. Please see Attachment 3 for the specific additional trees that will retained. The applicant agreed to share a map of retained trees with the residents in the near term.
• The applicant agreed to conduct a site visit with concerned citizens for Phase 3 and Phase 4 of the development to further identify trees that could be retained for the later parts of project.
4 Section 1.08.040-Any condition existing in violation of this code or a city ordinance is deemed to be a public nuisance. See also, Chapter 1.12 (Administrative Fines) for additional code enforcement details. 5 Excerpt from the Tree Protection and Retention Policy. See Attachment 1 for further details.
FISCAL IMPACT:
On site monitoring of all trees will by paid for by the applicant so there will be no fiscal impact to the City of Marina.
ENVIRONMENTAL REVIEW:
Adoption of the Tree Retention and Removal Policy is not considered a project under CEQA.
CONCLUSION:
This request is submitted for City Council consideration and comment.
Respectfully submitted,
Guido F. Persicone, AICP

MEMORANDUM
DATE: February 21, 2017
FROM: Guido F. Persicone, Community Development Director Brian McMinn, Public Works Director
TO: Community Development and Public Works Staff
SUBJECT: Tree Preservation and Protection Standard Operating Procedures (SOPs)
1. No site modification permits, including but not limited to grading, building or demo permits will be issued in which protected trees are on a property unless an applicant submits a separate Tree Protection and Removal Sheet in their submittal package. This sheet in the building, grading, or demo permit set of plans will clearly label the trees on site that will be retained, and which will be removed. No permits will be issued until the project planner has reviewed this sheet of the plans and stamped said plans either in Blue Beam or with a hard copy stamp, and
2. No site modification permits, including but not limited to grading, building or demo permits will be issued in which trees are on a property until the applicant has installed protection fencing around all trees that are to be retained. Protective fencing shall be installed no closer to the trunk than the dripline, and far enough from the trunk to protect the integrity of the tree. a. The fence shall be chain link and a minimum of five feet in height. Fence shall be supported by vertical posts driven 2 feet (min) into the ground. b. The existing grade level around a tree shall normally be maintained out to the dripline of the tree. No signs, wires, or any other object shall be attached to the tree. c. Trees that have been damaged by construction shall be repaired in accordance with accepted arboriculture methods
d. The applicant shall submit a picture of the fencing and submit said photos to the project planner.
3. Tree recommended for removal shall be spray painted with a red X. The applicant will take a picture of the tree with the red x and submit this to the project planner.
4. A city inspector will be on site to ensure only trees recommended for removal by the Planning Department will be removed. This will be based on the Tree Protection and Retention Sheet that will be on all plans moving forward
“Tree” means any living woody perennial plant having a single stem of six inches or more DBH or a multi-stemmed plant having an aggregate diameter of ten inches or more measured at DBH
Existing trees in good or fair condition to be removed shall be replaced on site at a ratio of two replacement trees for each tree removed (2:1).
The minimum size of tree selection is 15-gallon. Minimum 24” box trees shall be located in areas of special interest such as focal points and neighborhood entries.
Nesting Birds
For any trees proposed to be removed or relocated between January and July, surveys for active nests of birds-of-prey birds shall be undertaken by a qualified biologist. If active nests are found and the biologist determines that construction activities would remove the nest or have the potential to cause abandonment, then those activities shall be avoided until the young have fledged and are no longer dependent upon the nests for survival.
Special Status Bat Species
BR-5.1 Conduct surveys for special-status bats in the project site and implement avoidance/relocation plan if present.
a. Prior to the removal of large trees or abandoned buildings, a qualified biologist shall survey the
trees and abandoned buildings for presence of roosting bats. If special-status bat species are present, the following measures should be implemented.
b. Tree removal should not occur if maternity bat roosts are present (between April 15 and August 1) in the trees to be removed.
c. No tree removal should occur within 300 feet of the maternity roost until all young bats have fledged – as determined by a qualified biologist.
d. If special-status bats are present, but there is not an active maternity roost, a Memorandum of Understanding (MOU) with the CDFG should be obtained in order to remove the animals prior to tree removal. Alternate habitat may need to be provided if bats are to be excluded from maternity roosts. A roost with comparable spatial and thermal characteristics should be constructed as directed by a qualified biologist. In the event that adult bats need to be handled and relocated, a qualified biologist shall prepare and implement a relocation plan subject to approval by CDFG that includes relocating all bats found on-site to an alternate suitable habitat.
A Mitigation and Monitoring Plan that mitigates for loss of bat roosting habitat should be prepared by a qualified biologist and approved by CDFG prior to tree or building removal
Pre Construction Surveys
Pre-construction (i.e. no more than 30 days prior to construction) surveys for active nests shall be conducted within 250 feet of proposed construction activities. If active nests are found and the biologist determines that construction activities would adversely affect the nest or cause nest abandonment, then those activities should be avoided in these areas until the young have fledged, as determined by nest monitoring by a qualified biologist through the breeding season. Once the young have fledged, construction activities may resume in the vicinity and no further mitigation measures would be required.

2) Phase 3 Arborist report on tree locations, sizes, species, and health be made available asap.
The Phase 3 Arborist report has been made available to the public as of April 13, 2022 from this project link: https://www.cityofmarina.org/204/The-Dunes-on-Monterey-Bay
3) Postpone April 14 PC meeting on Phase 3(?) tree removal permit until unauthorized tree removal is addressed, and compensation planned.
No tree removal permits are scheduled for this meeting.
4) Based upon the Phase 3 arborist report, the number of trees and their locations to be kept and those to be removed need to be photographed and discussed in public.
The Phase 3 Arborist report has a photo of each tree and city staff are available to answer project related questions, but in general the tree removal permit includes: 458 trees are proposed for removal in the project site (Figure 2; Appendix A-B). These include:
178 Monterey cypresses ( Hesperocyparis macrocarpa), 6" to 101" DBH, • 184 Monterey pines ( Pinus radiata), 6" to 46" DBH,
• 11 Torrey pines ( Pinus torreyana), 6" to 33" DBH,
• Fou r (4) coast live oaks (Quercus agrifolia), 10" to 13" DBH, • 69 eucalyptus trees ( Eucalyptus spp.), 7" to 88" DBH, • F ive (5) Australian cheesewoods (Pittosporum undulatum), 6" to 20" DBH, • Four (4) Chinese junipers ( Juniperus chinensis), 8" to 12" DBH, • Two (2) Mexican fan palms ( Washingtonia robusta), 17" and 20"DBH, and • One (1) Peruvian peppertree (Schinus molle), 33" DBH.
5) Following questions need to be publicly discussed:
a. Why are certain trees removed and others kept?
Recommendation for removal is based on the City’s Tree Ordinance and for the Dunes Development the criteria identified within the University Village Specific Plan. For the specific criteria, please review page 5 of the Phase 3 Tree Removal Report from Denise Duffy and Associates.
https://www.cityofmarina.org/204/The-
Dunes-on-Monterey-Bay
b. Who determines what distance of proximity to roads, planned underground infrastructure, and planned residential or other buildings would require removal of existing trees?
The determination of infrastructure is based on the primary goals of the City which are to allow the project to move forward but to do so in a manner that preserves as many trees as possible and also plants replacement trees to mitigate for the loss of mature trees.
c. How many residential units and 1000’s of sq feet of office are to be constructed in Phase 3?
255 Single Family Housing Units
Arts District – this is something the city is taking the lead on not MCP, as MCP transferred this back to the City with the Operating Agreement.
Business Park - entitlements allow nearly 400,000 square ft or more of office park Neighborhood retail-around 10,000 square feet of retail for this phase.
d. What documents have been approved giving developer the rights to build structures or roads in certain Phase 3 locations?
The Phase 3 Tentative Map is scheduled to appear before the Planning Commission on May 26
th. Per Section 16.08.070 of the Marina Municipal Code the City Council will then review the tentative map.
e. What documents have been approved giving developer the rights to remove Phase 3 trees considered by developers as necessary to remove due to planned infrastructure (utilities, roads, buildings) or massive grading?
No approvals have been granted for the Phase 3 tentative map as of April 13, 2022.
f. What rights does City have to require certain trees thought to be iconic or beneficial to community to be retained?
The City retains its authority under the Marina Municipal Code and the University Village Specific Plan to retain as many trees as possible.
g. What are the options developer and City have to compensate for the loss of large, healthy, trees by retaining existing large, healthy trees? Per State law the Dunes development is bound by the original regulations in place when the 2005 Development Agreement was signed. Per the original agreement the applicant is bound by the replacement penalty of 6 trees for every 1 tree that is removed without a permit.
6) Attempt to retain all matriarch trees in Phase 3 such as:
Table 1 is a summary of the trees the Mayor requested staff be prepared to discuss at the May 10, 2022 Special Dunes Tree meeting. However, it should be pointed out that the Planning Commission has not provided its input on this tree removal permit as of yet so it would be premature of the City Council to provide policy direction on this matter. If the Council wishes to review the matter, an appeal can be filed with the City Clerk within 10 working days of the decision (17.70.040).

7) We should strive for a win-win by building a quality community in part by retraining clusters of large trees and isolated matriarchs scattered throughout Phase 3.
Agreed.
8) ASAP after arborist Phase 3 report has been released for at least 1 week, plan a meeting on-site with approx. 10 engaged community members, mayor, developer representatives, and City staff to discuss process of deciding which large healthy trees will be retained.
Agreed. The Community Development Director has scheduled a meeting with interested parties on May 2, 2022. Additionall, the Phase 3 tree report is available on the City website as of April 14, 2022 at:
https://www.cityofmarina.org/204/The-Dunes-on-
