Bids are submitted for the entire work. The amount of the bid, for comparison purposes, will be the total of all items. The total of unit basis items will be determined by extension of the item price on the basis of the estimated quantity set forth for the item.
The bidder shall set for each item of work, in clearly legible figures, an item price and a total for the item in the respective spaces provided for this purpose. In the case of unit basis items, the amount set forth under the "Total" column shall be the extension of the item price bid on the basis of the estimated quantity for the item.
In case of discrepancy between the item price and the total set forth for the item, the item price shall prevail; provided, however, if the amount set forth as an item price is ambiguous, unintelligible or uncertain for any cause or is omitted, or in the case of unit basis items is the same amount as the entry in the "Total" column, then the amount set forth in the "Total" column for the item shall prevail in accordance with the following:

1. As to lump sum items, the amount set forth in the "Total" column shall be the item price.
2. As to unit basis items, the amount set forth in the "Total" column shall be divided by the estimated quantity for the item and the price thus obtained shall be the item price.
If this proposal shall be accepted and the undersigned shall fail to enter into the contract and to furnish the two bonds in the sums to be determined as aforesaid with surety satisfaction to the City of Marysville, within fifteen (15) days, not including Sundays and legal holidays, after the bidder has received notice from the Director of Public Works that the contract has been awarded, the City of Marysville may, at its option, determine that the bidder has abandoned the contract, and thereupon this proposal and the acceptance thereof shall be null and void and the forfeiture of such security accompanying this proposal shall operate and the same shall be the property of the City of Marysville.

The purpose of this Addendum No. 1 is to notify Bidders of clarifications to the Project Plans for the above project. This Addendum shall be attached to and become a part of said Contract Documents. THIS
ADDENDUM SHALL BE SIGNED BY THE BIDDER, DATED AND SUBMITTED WITH THE PROPOSALFORTHEPROJEC~
Bidder Questions I Clarifications:
1. Question: Proposal form: Section 2.2 in the Contract Specifications states "All proposal forms shall be directly purchased from the City of Marysville ... Copies of proposal forms obtained from a source other than the City will not be allowed." Please confirm that the proposal form within the project specifications (which can be downloaded from the City's website free of charge) is okay to use.
Response: All proposals must be submitted on the forms provided in the project specifications. These forms can be purchased or downloaded from the City website.
2. Question: Working days: The Notice to Contractors states "Completed the work within 100 working days" and then section 6.3 says "All work under this contract shall be completed within a maximum of ninety (90) working days". Please clarify this project is 90 or 100 working days.
Response: The Notice to Contractors mentioned the contract would be completed within 100 working days because the requirements for the appetence program change with projects longer than 100 working days. The time of complete for the project shall be 90 working days. As stated at the Pre-Bid meeting, the City may award the project and not issue the Notice to Proceed until the weather is conducive to begin the working days.
3. Question: Working hours: The specifications do not include allowable hours of work. Plan sheet 2 includes " .. . all working involving traffic control and staged construction of the project to occur during the hours of 9AM and 3PM." Sheets 16 and 17 (Traffic Handling) has " ... all working involving traffic control and staged construction of the project to occur during the night from 7PM to 7 AM." Please clarify the daily working hours for the project.
Response: As discussed at the Pre-Bid meeting, the hours of work are not directed to be at night and are 7am to 7pm. Due to the large amount of commuter traffic on 5th Street, traffic control involving temporary restriction of lanes and / or flagging to be restricted to 9 am to 3pm. This restriction would not apply to lanes that are closed for an extended duration during construction.
4. Question: Concrete testing: The specifications do not address concrete quality control testing.
Plan sheet 2 includes "The Contractor shall be solely responsible for all quality control

associated with the project. The quality control shall include but is not limited to the following:
.. . all geotechnical testing and reporting, concrete testing, asphalt testing ... " Please include requirements for concrete testing - type of testing and frequency Response: A slump test, air entrainment, and strength cylinders shall be performed for each pour on the street light and signal foundations. For the nonstructural concrete on the sidewalks, curbs, gutters, ramps, and driveways these tests shall be performed per each mix design used.
5. Question: Exhibit 15-H DBE Information - Good Faith Efforts includes (at the top of the page) ''This list must be submitted with bid proposal". However, section 2. 13 of the specification states "If good faith efforts documentation is not submitted with the bid, it must be received by the Agency no later than 3:00 p.m. on the 5th calendar day after bid opening. Please confirm the GFE does not need to be submitted with the bid.
Response: All proposals shall be submitted with the form 15-H Good Faith Effort Information. Federal bidding procedure does not allow a bid to be considered incomplete if the form 15-H information is submitted no later than 3:00 p.m. on the 5th calendar day after bid opening.
6. Question: The Notice to Contractors DBE goal was stated to be 23%; however, in the DBE Information- Good Faith Efforts form 15-H in the bid package it says the goal is 17%. I just wanted to clarify which one it is.
Response: The 23% goal is correct. Attached is the corrected for 15-H.
7. Question: Is the good faith effort due 3 working days after the bid per section 2. 14 or 5 calendar days after the bid per the Notice and form 15-H? Response: 5 calendar days, the section 2.14 3 calendar days only applies to CDBG funding which this project does not have.
8. Question: There is no subcontractor listing form included in the bid proposal other than Exhibit 12-8 part 1 and part 2. Please include subcontractor listing form and also verify when 12-8 part 1 and part 2 are due (typically part 2 is to be included with the remaining DBE information - no later than 5 calendar days after bid opening).
Response: The form 12-B part 1 shall be used for listing all subcontractors used in the project bid submitted for the project. It is preferred that 12-B part 2 is submitted with the bid proposal. Federal bidding procedure does not allow a bid to be considered incomplete if the form 12-B information is submitted no later than 3:00 p.m. on the 5th calendar day after bid opening.
9. Question: Aggregate base under concrete: typical cross sections on the plan sheets show 4" AB, the bid item is Class 2 Aggregate Base (0.50- feet) (under sidewalk), and the City Standard Detail shows 6" minimum AB bedding for sidewalk, curb and gutter. Please confirm 4" or 6" AB under the sidewalk, curb and gutter.
Response: The aggregate base shall be 6" AB under the sidewalk, curb and gutter.

11 . Question: Can the curb and gutter be poured at the same time as the sidewalk monolithically? Response: The City details and standards require the curb and sidewalk to be poured separately. An exception to this could be made for the accessible ramps and the alley driveways.
12. Question: The driveways on the plans are different sizes, but the bid item is Each. Please clarify?
Response: The square footage for the driveway concrete is accounted for in bid item 9 and each price in Bid Item 12 is for the extra cost for forming up the heavy-duty driveways and including the rebar in the aprons.
13. Question: The accessible ramps on the plans are different sizes, but the bid item is Each.
Please clarify?
Response: The square footage for the ramp concrete is accounted for in bid item 9 and each price in Bid Item 10 is for the extra cost for forming up the ramps and including the truncated domes at the bottom of the ramps.
14. Question: Storm Drain: The plan and profile sheets have the storm drain sizes listed in feet rather than inches, and there are two locations listed for 6' (assuming 6'J but no bid item for 6" storm drain. Please clarify storm drain sizes, quantities and pipe.
Response: The pipe sizes are all inches and should have been designated as (") see attached corrected sheets. The 6" pipe was the size of the existing pipe and has been revised to 8" on the attached revised plan sheets P-1, P-2, P-3, & P-4. The quantity of 8" and 1 O" pipe has been corrected in the attached bid schedule.
15. Question: Bid item #33 - 1 O" Class 4 reinforced concrete pipe and bid item #34 - 8" reinforced concrete pipe: RCP is no longer made in those sizes, please provide an alternate pipe type.
Response: SDR-26 PVC may also be used for these bid items and the bid schedule has been revised to reflect this.

16. Question: Existing storm drain: In the locations where we are to relocate the drain inlets, what are we to do with the existing pipe leads? Please confirm - remove or abandon in place, and related specification.
Response: The existing leads would be abandoned in place in accordance with Caltrans Standard Specification Section 71-6. This work would be covered in Bid item
36. 17. Question: Bid item #36 Connect to Existing Storm Drain: the plans don't specify the depths of the existing manholes at the tie-in point. Please provide more detail on tie-in locations.
Response: The intent was to tie into the existing manholes at the same location/ invert as the existing pipes and then abandon the existing leads not used in place.
18. Question: Bid Item 6, Pavement Repair Sections: Please confirm the Aggregate Base and HMA to restore the Pavement Repair Sections are included in bid item 6.

19. Question: Tree removal: On plan sheet 4 (OP-1) calls out three trees to be removed. There are quite a few other trees (within the sidewalk) that are not marked on the demo plan to be removed. On the demo plan sheet "Contractor is to coordinate removal of any trees, shrubs, vegetation, and clearing and grubbing as necessary to facilitate construction." Specification section 9. 1 states "Trees and shrubbery that are not to be removed, shall be protected from injury or damage." Please confirm there are only three trees to be removed, the remaining trees within the concrete sidewalk will remain. Specification section 11.1 includes" ... when no bid item is provided for tree removal, the cost therefor shall be included in the price bid for clearing and grubbing." Please add bid item for tree removal or clear and grub.
Response: All of the existing trees in the sidewalk will be removed. The plans had only called out the tress larger than 12" diameter in the existing planter. This item should be included in Bid Item 5 "Remove Concrete Sidewalk, Curb, & Gutter" which is the equivalent to clear and grub for this project.
20. Question: Is Bid Item 26 6" C900 PVC irrigation sleeves in roadway only for the 11/2" mainline crossing the roads and not the lateral lines? Nor any sleeves under the sidewalks? Will all other sleeving for the rest of the mainline and lateral lines be paid under item 27? Please advise.
Response: The bid item 26 sleeves are only for the road crossings and intended to be used for running the main line and lateral within. Any other required sleeving under sidewalks, ramps, and driveways would be in bid item 27.

21. Question: There are two trenching details on L-3.3 irrigation details plan sheet. Detail 7 shows the direct burial wire without any sleeve nor conduit, but detail 8 shows the wire inside a conduit that is inside a sleeve? Please advise what detail we are to reference.
Response: Both details are applicable based on location of sleeve. Delete inner sleeve, detail 8, L-3.3.
22. Question: Plan sheet L-3.2 states city to provide manufacturer and model of the irrigation controller? The specs don't provide a model and manufacturer for the controller? Will the city supply the controller? Or please provide a model number and manufacturer of the type of controller for this project. Please advise.
Response: The City uses Rainbird ESP-LXME Controllers.
23. Question: Irrigation specs on plan sheet L-4.1 say to use two wire cable and the remote-control valves to have 2 wire decoders. Detail 6 electric box on sheet L-3.3 show to use 14-1 conventional wire? And detail 4 remote control drip valve doesn't show any decoders? Please advise if the irrigation system is two wire or conventional not clear.
Response: The system will be 2-wire pre the specs on sheet L-4.1
24. Question: Please advise what details are to be used to install the new 11/2" water meter? Specs section 21 irrigation system section 21. 11 states to use City of Yuba City detail 401 and 405 for water service connection, but those details are for the county of yuba not the city? Detail 401 is Inlet Transitions and detail 405 is for Large Manhole Assembly? Details 401 and 405 are the wrong details to reference, please provide correct details to bid water meter installation.
Response: The City will have California Water Service install the new 1 ½" water meter.
The contractor point for connection would be the new 1 ½" back flow preventor at the back of the meter.
25. Question: Are there any fees the contractor should be aware of in regards to water service and water meter installation? Who will perform the hot tap? Response: The City will pay the connection fees and have California Water Service install the new 1 ½" water meter. The contractor point for connection would be the new 1 ½" back flow preventor at the back of the meter.
26. Question: Plan sheet L-4.1 specification E. Main Line Joint Restraints, are we to use joint restraints and fittings for the mainline? Does the mainline get thrust blocks not clear? Please advise if we are to use thrust blocks or joint restraints.
Response: City Joint restraints not required on irrigation mainline 3" size or smaller.

27. Question: For the decorative fluted signal poles, you have shown on sheet SP-3, the Union Metal Corporation is no longer manufacturing fluted signal standards, please let me know how we need to quote this?
Response: The Visco poles to match those installed at 5th & J Street with the smooth tapered poles and decorative base or equal are acceptable. Attached is the submittal with the luminaire information from that project.
28. Question: For the seven each single and seven each twin arm decorative street lights there is no specification for the pole or luminaire, can you please provide this information? Response: The Visco poles to match those installed at 5th & J Street. Attached is the submittal with the luminaire information from that project.
29. Question: For the street light system there is not a circuited set of plans, can you please provide this plan including a service point if required? Response: The point of service from the existing street lights at the nearby PG&E secondary box will be used to service the new lights including the locations that are moving to the median from the sides of the street.
30. Question: For bid item #13 temporary signal modifications and signal detection on "H" Street, there are no electrical plans to bid this work, can you provide plans or outline what you are requiring for this work?

4. Project Description - Enter the project description as it appears on the project advertisement (Bridge Rehab, Seismic Rehab, Overlay, Widening, etc).
5. Bidder's Name - Enter the contractor's firm name. 6. Prime Certified DBE - Check box if prime contractor is a certified DBE. 7. Bid Amount - Enter the total contract bid dollar amount for the prime contractor.
8. Total Dollar Amount for ALL Subcontractors - Enter the total dollar amount for all subcontracted contractors.
SUM = (DBEs + all Non-DBEs). Do not include the prime contractor information in this count.
9. Total number of ALL subcontractors - Enter the total number of all subcontracted contractors. SUM = (DBEs + all Non-DBEs). Do not include the prime contractor information in this count.

Haul only pricing is based on the customers direct purchase and scheduling with the material supplier or dump site.
General Hauling Terms: All trucks charge back to their original starting location empty. We reserve the right to refuse to haul material that we deem either unsuitable for the truck requested or material such as open grade/rubberized asphalt. If a special agreement is made to haul open grade or rubberized asphalt, there will be a 1-hour clean-out charge billed for each truck at the applicable hourly rate. SHK Hauling, Inc is not responsible for delays or loss of production caused by weather, road or traffic conditions, mechanical failure or any other condition beyond our control. Trucks are subject to availability and based on scheduling.
For day work there is a seven (7) hour minimum charge per truck. Far night work there is an eight (8) hour minimum charge per truck. There is a four (4) hour show-up time charge per truck if the job is cancelled and the truck(s) have already shown up to the dispatched location. All prices quoted are subject to fuel increases. A copy of our Fuel Surcharge Assessment is attached.
Payments for invoices are due within thirty (30) days of the invoice date. Delinquent invoices are subject to a 2% service charge per month. All prices are for work performed through December 31st, 2022. Prices quoted are good for a period of sixty (60) days from the bid date, signing and returning this quote or the submission of a work/purchase order within the specified time will secure the pricing and terms stated in this quote. A signed work/purchase order also constitutes acceptance of these terms as stated.
Changed Conditions: Any conditions that were not disclosed by the contractor at the time of the bid, which effect the work to be performed by SHK Hauling, Inc., must be promplly provided in writing for-review to determine if a change in pricing is required.
A FUEL SURCHARGE may apply in the case of rapidly escalating fuel costs. IF a FUEL SURCHARGE is implemented, it will adjust once per week on Monday. The FUEL SURCHARGE will be based on the Sacramento Average unbranded Price as published by the Oil Price Information Service (OPIS), PLUS ALL APPLICABLE California State & Federal Taxes.

Portland cement concrete grinding is excluded from this quotation unless specifically quoted.
Removal of Asphalt Concrete over gutter damages can't be guaranteed by ABSL.
ABSL Construction will cold plane as close as possible to existing manholes, water valves, and other obstructions in cutting plane. Handwork and placing temporary asphalt tapers around these objects or at pavement edge for safety requirements are excluded.
Contractor to post streets with "No Parking" signs prior to subcontractor's phase of work, provide water or water meter and provide traffic control during cold planing operation.
All areas to be ground shall be clearly marked by the general or the job inspector.
If pilot car to be provided by others if required.
Anything not specifically included in this price should be considered excluded.
ABSL Construction does not accept backcharges due to machine breakdown during operation above the machine's daily rental fee.
Back charges will only be based on the time the machine is broken and will reflect the cost of the equipment for that time. All others costs due to the equipment breakdown will not be charged to ABSL Construction.
All teeth over one complete set will be charged to the contractor.
ABSL does not accept force account rates or retention.
This quotation will be part of our contract or purchase order agreement and is valid till a new change of the rates .

GRINDING JOB AGREEMENT

The prices set forth above are based on the following assumptions and are subject to change under conditions set forth below.
1) A minimum daily rate is any part of an 8 hour day and overtime will be charged for work done other than a regular weekday shift.
2) Modification to the work may require a change in the quote. 3) Unless otherwise indicated the unit prices are based on ABSL performing all the work included on the proposal. If ABSL does not receive a contract for all the work, the unit prices are subject to adjustment. 4) The unit prices are based on the estimated quantities in the bid proposal. If the quantity of the item changes by 25% or more the unit price is subject to equitable adjustment. 5) All teeth over one complete set will be charge to the contractor. 6) Prices are good for 30 days from the date of this proposal, after that date the prices are subject to adjustment.
7) In the event there is an increase in the cost of fuel of more than $0.50 per gallon during the performance of this contract, ABSL will be entitled to a $75.00 per day fuel surcharge. The base cost of fuel shall be established on the bid date of the contract by reference to the Weekly Retail On-Highway Diesel Prices for California, as published by the U.S. Department of Energy on its web site at www.tonto.eia.doe.gov/oog/info/wohdp/diesel.asp.
8) If ABSL cannot proceed with its work as scheduled due to others, standby time will be charged at the following rate: $500.00 per hour.
9) Downtime for equipment becoming stuck in wet or muddy sub-grade conditions will be charged at a stand-by time rate until removed. Additional equipment required for removal will be charged at a time and materials basis.
10) This proposal to be attached and made part of any and all resulting contracts. 11) The above price does not include permits, fees, bonding, state or local taxes. 12) This is a proposal only for the purpose of establishing a price for work as outlined. In the event ABSL is the low bidder a formal contract or PO suitable to both parties shall be prepared and fully executed. 13) Repairs of damage to ABSL equipment due to unmarked or buried obstructions; i.e. valve boxes, manholes covers, concrete, steel fence posts, steel pipe or excessive depth asphalt will be billed at time and material for repairs.
14) Backcharges to ABSL must be communicated by contractor in a written notice within 72 hours from the time of occurrence.
15) Unless otherwise agreed to in writing prior to start of work, payment is due and payable within 30 days of billing, and no retention to be withheld on payments. 16) All utilities within mill grade are to be located and marked by customer. It is the sole responsibility of the lessee or renter (customer) to follow the requirements of the regional notification center law pursuant to Article 2 (Commencing with Section 4216) of Chapter 3.1 of Division 5 of Title 1 of the California Government Code. Customer assumes sole responsibility for, and all subsequent liabilities coincident with following the requirements of the regional notification center law. Furthermore, customer agrees to be responsible for all damage to both utilities themselves and to our company's equipment by reason of ABSL equipment encountering unmarked utilities.

Property corners and survey benchmarks to be furnished by others.
Excavation or over excavation, re-compaction, removal, replacement or processing of soils due to hazardous material, unsuitable material, sub surface obstructions, ground water and loose or over saturated soils will be an added cost based on an extra work charge.
Plan or staking errors by engineer or architect resulting in labor and equipment loss of time or in additional work will be an added cost based on an extra work charge.
Contract is based on award of all items of work in the quotation.
Progress payments shall be received by MJD Engineering no later than (30) days after date of invoicing. Failure to make payment as agreed shall allow MJD Engineering to suspend all work until the account is made correct or terminate the contract.
Payment in full, including retention, within (30) days of completing contract scope of work.
Should either party bring suit in court to enforce any of the terms hereof, it is agreed that the prevailing party shall be entitled to reasonable attorney's fees, expert fees and court costs.
The prevention, delay, non-performance or stoppage of work due to any of the following reasons may cause an increase in prices and or backcharge allocation and a possible delay in production time as follows; Acts of Nature, scheduling conflicts and/or workrelated conflicts caused by other subs on the project, and/or any situation beyond MJD ENGINEERING's control.

Thank you for the opportunity to provide a bid for this work. \ve provide civil and stormwater engineering services. This proposal assumes the project is a Risk Level 2.

Traffic Control and Sign Quote Provisions
CONTRACT: 21-01 BID DATE: 12/2/2021
No items on this quote will be deleted unless approved by T and S DVBE, Inc. prior to bid opening.
Meal periods and proper rest periods must be given to all traffic control personnel on job site. If they are not provided, the additional hourly costs as indicated in the union agreements and/or California Labor Code (whichever prevails) will be added to the daily billing. Meal periods must be given as follows: 1 before 8 hours, 1 after 10 hours and 1 after 12. Missed meal periods cost 1/2 hour of overtime each, however employees must take at least 1 meal period off the clock after 10 hours.
Working Time:
All pricing is based on consistent working weeks/days. Prices are subject to change if prime contractor contracts T ANDS DVBE Inc. less than full 40 hr.
Week and/or 8 hr. days. Additional Mob and or increased hourly rates will be applied.
Mobilization: T and Swill mobilize on an as available basis. With respect to other contracts and customers, T and Sis available on a first come first serve basis.
Non traffic control items exclude any and all traffic control, electrical and water pollution control work. Cutting and coring of concrete is excluded. Sign post anchors can be provided prior to pouring sidewalk, so they can be wet set. Coring of concrete can be provided for $200 per hole. Layout of signs or delineation by others.
Traffic control trucks come equipped with signage for closures and speed reduction . Radar trailers and PCMS are not included.
Cones left onsite for edgeline delineation or anything other than temporary traffic control will be charged $0.50 each per day for rental. Construction area signs will be removed and T and S DVBE, Inc. will retain possession of said signs. All stationary mounted detour signs shall be installed at the beginning of the project covered. Uncovering and re-covering as needed by others unless T and Sis on site providing traffic control. All portable detour signs will be delivered to the job site. Cost to repair damage to the reflective sheeting from tape used to cover detour panels will be charged to the prime contractor. Placing and USA marks provided by others, so T And Scan call in to Underground Service Alert. If T and S has to paint USA marks, additional mobilization charges will be applied.
All traffic control rates will increase every July 1 by the exact amou nt the wages and fringes increase starting in 2021. No additional markup will be applied, only the amount of the laborers increase (if any) for that fiscal year.
Radios: Our pilot car(s) and flaggers will be equipped with VHF and UHF 2-way radios. Our pilot cars and flaggers will be equipped with CB radios for communication with your truckers and other CB-equipped equipment.
Rental Equipment: The Prime Contractor shall be responsible for any damage or loss to/of the equipment due to traffic conflicts, vandalism, theft, acts of nature or mishandling by Prime Contractor's staff, this includes batteries. The Prime Contractor will NOT be responsible for maintenance of the operational capabilities, except for operational difficulties and repairs brought about by such traffic conflicts, vandalism, acts of nature or mishandling by Prime Contractor's staff. Prime contractor is responsible for all lost stolen or damaged equipment on job site. (Includes all non-powered equipment) A daily record of. items used will be provided by T and S DVBE Inc. for the prime contractor to sign off on. Al l water for crash cushions supplied by others. All components for crash cushions shall be returned to T and S DVBE including anchor bolts:· Cones for tapers delineating rental equipment are not included.

Insurance: T ANDS DVBE. lNC. maintains insurance coverage's as required by USDOT-FHWA, Caltrans (Commercial General Liability, Commercial Auto, and Workers Comp); any additional coverage's required by the Prime Contractor can be acquired by us at the Prime Contractor's sole expense (e.g., Workers' Comp Waiver of Subrogation, Excess Liability umbrella).
Inclusion of these entire quotations in Subcontract or Work Order is required either within the body of the Subcontracts/Work Orders or appendixes to and referenced within the Subcontract/Work Order. Such inclusion and /or referencing in no way obligates the Prime Contractor t o use any of the optional quotations above.
Acknowledgement & Agreement: By appointing or listing T ANDS DVBE, INC. as a subcontractor on this project, the Prime Contractor acknowledges and agrees to all applicable terms and conditions as stated above and in the descriptions below.
All Payments {There will be no payment retention on traffic control) T ANDS DVBE INC. will bill every two weeks. Invoice due and payable 30 days from date of invoice. Customer agrees to pay a finance charge of 1.5% per month on all past due balances. Customer further agrees to pay reasonab le attorney's fees and cost if collection is required. Venue for the purpose of this obligation shall be Shasta County, CA. T ANDS DVBE Inc. will be paid with in 30 days of invoicing or work shall stop until payment is made.
Acceptance of this quote is acceptance of these provisions, which shall prevail if in conflict with any other contract documents. This quote must become a binding part of any contract written in reference to it.
No retention is to be held on Traffic Control and Equipment Rental.
