Item #XX
Date: January 18, 2022
To: Mayor and City Council
From: Jim Schaad, City Manager
Subject: Authorize the Regional Waste Management Authority to submit a regional application under the Senate Bill 1383 Local Assistance Grant Program and act as Lead Agency on behalf of the City of Marysville.

Recommendation:

Pass a Motion to Authorize the Regional Waste Management Authority to 1) submit a regional application under the Senate Bill (SB) 1383 Local Assistance Grant Program and 2) act as Lead Agency on behalf of the City of Marysville for such program.

Rationale for Recommendation:

CalRecycle has developed a one-time grant program in an expedited manner to provide aid in the implementation of the SB 1383 regulations regarding organic waste diversion, edible food recovery, and organic waste recycled product procurement. The City and other regional member jurisdictions are eligible for a minimum of $20,000 in funding with some member jurisdictions eligible for higher amounts based on population to implement the program. As a result, at least $267,000 is expected to be available to the six jurisdiction RWMA region. The RWMA was formed to provide regional waste management planning and has a significant responsibility for managing compliance with SB 1383 requirements. Staff recommends that this funding for implementation be directed to the RWMA for SB 1383 implementation purposes.

Background:

CalRecycle issued a Draft Request for Approval on November 10th for the proposed criteria for the SB 1383 Local Assistance Grant Program for FY 2021-22. This one-time grant program is being developed in an expedited manner to provide aid in the implementation of the SB 1383 regulations regarding organic waste diversion, edible food recovery, and organic waste recycled product procurement.

The application was released on January 4th, the application is due February 1st, Letters of Authorizations are due by March 1st, and grants are tentatively scheduled to be awarded in April 2022 for this two-year grant program.

Grant fund payments are proposed to be in advance. Eligible applicants are proposed to include cities, counties and regional or Joint Powers Authorities that will have adopted enforceable ordinances(s) or similarly enforceable mechanisms by April 1, 2022, to mandate compliance by organic waste generators, haulers, and other entities subject to the requirements of Chapter 12: Short-lived Climate Pollutants of the SB 1383 regulations.

Item #XX
CalRecycle proposed setting a base award amount of $20,000 for eligible entities and distributing the remaining funds based on per capita calculations. As a result, at least $267,000 is expected to be available to the six jurisdiction RWMA region with the City of Marysville at the base amount.

Discussion & Analysis:

Within the list of eligible activities and costs the following are most appropriate to the RWMA:
• Personnel and consultants for education and outreach, capacity planning, procurement requirement planning and documentation, record keeping, enforcement and inspections, and program evaluation/gap analysis
• Containers (small household food waste bins and labeling) • Education and outreach materials
• Support for edible food recovery including trucks, equipment and refrigeration • Indirect cost cap of 10 percent
RWMA staff is suggesting that the application focus on personnel (i.e., new RWMA staff) and consultant (i.e., Yuba-Sutter Transit and Aurora Environmental, Inc. contract staff) activities and costs as these are clearly known, significant and documentable expenditures. Other activities and costs noted in the above list could still be funded from the RWMA budget and other sources as the details of such activities and costs are developed later in 2022.

Letters of authorization are also required from each of the member agencies. The RWMA would like to have all letters of authorization by January 31, 2022.

Fiscal Analysis:

There is no cost impact to the City for this program. Activities funded through this source would otherwise need to be absorbed by RWMA member agencies.
