RE: VELB Shrub Transplant Proposal for the City of Marysville’s Wastewater Treatment Plant Ponds Closure Project in Yuba County, California
Dear Jim:
Heron Pacific, LLC (dba “Wildlands”) is pleased to offer you the following cost proposal based on the elderberry shrub provided by ECORP Consulting, Inc. via email dated November 2, 2021, and the site visit conducted by Wildlands representatives on November 10, 2021. The elderberry shrubs would be transplanted to the USFWS-approved River Ranch VELB Conservation Bank in Yolo County, California.
DESCRIPTION of SERVICES COST
Transplant 7 elderberry shrubs $13,800
Please note this pricing is valid for 60-days. The transplant cost includes the time and materials associated with the preparation (shrub pruning and clearing in the immediate vicinity of the elderberry shrubs), removal, transport and replanting of the previously mapped elderberry shrubs during the season when plants are dormant, approximately November 1st through the first two weeks in February, or outside of this season if authorized by USFWS.
TERMS
1. The elderberry shrubs will be transplanted from the project site to the River Ranch VELB Conservation Bank. The above cost includes the necessary maintenance and monitoring costs in perpetuity in accordance with the July 9, 1999 U.S. Fish and Wildlife Service VELB Guidelines.
2. Wildlands assumes site access will be unrestricted. This includes the removal of any fencing or other materials by others that would preclude equipment and 2 vehicle access to shrubs. Overhanging limbs will be trimmed and removed by others. Client will be responsible for verifying the absence of any type of underground service in the area in which equipment must be used (e.g. current USA ticket).
3. All work will be performed under the terms and conditions of the USFWS Biological Opinion issued for the project.
4. This proposal assumes certain site conditions, including, but not limited to dry ground. If these conditions change or discoveries are made prior to or during the course of work which materially affect Wildlands’ costs to complete the project (e.g., previously unknown rocky substrates, excessive groundwater, unfavorable weather, unanticipated delays or interference with the progress of work), then work will be halted until a change order or contract amendment, mutually agreed upon by both Wildlands and Client is issued.
5. If there are any deviations or alterations from the original specifications, then work will be halted until a change order or contract amendment, mutually agreed upon by both Wildlands and Client is issued.
6. A qualified Wildlands biologist will oversee all transplant work conducted.
7. Payment is due upon receipt of invoice. Wildlands will submit an invoice to Client at the completion of work. A monthly finance charge equal to 1-1/2% of the unpaid balance will be levied on the account if delinquent over 45 days.
