RESOLUTION 2022-XX
RESOLUTION OF THE COUNCIL OF THE CITY OF MARYSVILLE, STATE OF CALIFORNIA, AUTHORIZING THE CITY MANAGER TO ENTER INTO A RIGHT-OFWAY ACCESS AND USE AGREEMENT FOR DEPLOYMENT OF A CITYWIDE FIBER
OPTIC NETWORK WITH SIFI NETWORKS YUBA CITY LLC
At a regular meeting of the Council of the City of Marysville, State of California held on the 19th day of October 2021.
WHEREAS, the City Council for the City of Marysville has identified goals and priorities to maintain the Quality of Life in the City of Marysville; and WHEREAS, a citywide fiber network aligns with the City Council’s goals for Infrastructure and Business Friendly and is a significant opportunity to strengthen the City’s ability to retain and attract businesses, jobs, and private investment; and
WHEREAS, SiFi Networks Yuba City LLC (SiFi) proposes to build a privately funded citywide fiber optic system (System) to provide access to all residents, businesses and City facilities; and,
WHEREAS, to facilitate the timely construction and maintenance of the System, SiFi has requested that the City enter into a long-term Right-of-Way Access and Use Agreement (Agreement); and,
WHEREAS, among many other terms, the City will provide a single point of contact, for which it will be compensated up to a fixed amount on an annual basis, and be required to process permitting per the terms of the Agreement; and
WHEREAS, SiFi will install the fiber optic network by ________ ; and WHEREAS, the City will also agree not to enter into a similar agreement with other vendors for a period of one year after execution of the Agreement.
NOW, THEREFORE, be it resolved by the City Council of the City of Marysville that the City Manager is authorized to execute the Agreement with SiFi Networks Yuba City LLC in a form substantially in conformance with Attachment A, attached hereto, and as approved by the City Attorney.
