Item #04
Date: July 5, 2022
To: Mayor and City Council
From: Kristina Heredia, Assistant Community Development Director.

Jim Schaad, City Manager
Subject: Zoning Map Amendment
Recommendation:

Pass a Motion to 1) waive the second reading of Ordinance No. 1440 2) adopt Ordinance No. 1440, amending the City of Marysville Zoning Map from General Commercial (C-3) to Light Industrial (M-1), for the properties identified in Exhibits A and B.

Rationale for Recommendation:

Approval of this Rezone would allow the applicant, F.M. Booth, to utilize their existing property for expansion of their storage warehouses; a land use category not permitted in the General Commercial Zoning District.

Background:

On May 25, 2022, the Planning Commission held a public hearing to consider this Zoning Map Amendment (Rezone) request and to provide a recommendation to the City Council. The Planning Commission voted unanimously to recommend approval. The Planning Commission also considered, and approved, a Parking Variance for the new warehouse, to allow the applicant to continue using on-street parking in lieu of off-street parking. The Design Review of the proposed warehouse was tabled until a final design is submitted to staff.

The request before the City Council is to rezone seven parcels of land, approximately 0.65 acres in size.

Five of the seven parcels currently belong to the applicant, and the remaining two parcels are being purchased by the applicant from the City as RDA Properties. The City agreed to sell these two parcels to F.M. Booth with the proposed development of “Commercial/Manufacturing” (Refer to Attachment 2 – Resolution 2022-11).

Prior to 1983 the properties in question were zoned Light Industrial but were rezoned to General Commercial via Ordinance 993 to allow for commercial development under the Marysville Plaza Project (MPP). However, the anticipated commercial development did not occur, and the majority of the seven parcels have historically sat vacant.

Item #04
Discussion & Analysis:

The General Plan Designation of these properties is “Redevelopment Area.” The Redevelopment Area is not a traditional designation as it allows for the development of residential, commercial, and industrial land uses. This designation was added to the General Plan via the MPP as a guide to implement “preferred activities and planning goals1” for downtown redevelopment. While the planning goals for the downtown area have evolved since the adoption of the MPP in 1979 (and Ordinance No. 993 in 1983), the designation of mixed land uses has remained, and throughout all, F.M. Booth has been a stable fixture in the downtown area. Rezoning the applicant’s properties back to the historic zoning designation of Light Industrial affords the applicant the right to develop their private property in a manner consistent with how this section of downtown has progressed.

For a rezone to be approved, it must be consistent with the General Plan.2 Industrial zoning, and industrial land uses, are permitted in the Redevelopment Area, and F.M. Booth, an industrial company, has been a staple in the downtown area since 1912. Therefore, Staff has determined that this rezone is in conformance with the General Plan. For a more in-depth analysis, please refer to Attachment 3 – Planning Commission Staff Report.

Legal Review:

The City Attorney has reviewed and approved the recommended Ordinance.
