Item #06
Date: October 4, 2022
To: Mayor and City Council
From: Jim Schaad, City Manager
Subject: Adopt a Resolution Awarding a Contract for the Wastewater Treatment Plant (WWTP) Ponds Closure Project
Recommendation:

Pass a Motion to adopt Resolution No. 2022-XX, awarding a contract in the amount of $3,684,276 with Gateway Pacific Contractors, Inc. for the construction of the WWTP Ponds Closure Project, Contract No. 22- 01, State Water Resources Control Board (SWRCB) Clean Water State Revolving Fund (CWSRF) grant # C06-8557-110 based on the Improvement Plans and Contract Documents.

Rationale for Recommendation:

The City of Marysville circulated and publicly advertised in the Appeal Democrat newspaper on August 4, 2022, a Notice to Bidders to receive bids based on the improvement plans and construction documents prepared by Bennett Engineering Services Inc dated July 15, 2022, Addendum No. 1 dated August 30, 2022, and Addendum No. 2 dated September 13, 2022. The City received six bids for this project on September 14, 2022, from Anderson Dragline, Ford Construction, Gateway Pacific Contractors, Nordic Industries, P31 Enterprises, and Santos Excavation. The lowest responsive bid received for the total project with was from Gateway Pacific Contractors, Inc. in the amount of $3,684,276. All bids were under the budgeted construction amount in the grant.

Background:

The City of Marysville is under a Cease-and-Desist Order from the Regional Water Quality Control Board (RWQCB) for operating their long-standing Wastewater Treatment Plant (WWTP) ponds in the flood plain.

Since then, the City embarked on a massive project to pump their raw municipal wastewater to the Linda County Water District for treatment. The interagency agreement, design and construction of the pump station and force main was completed but the old treatment ponds remain. The RWQCB requires complete decommissioning of the treatment ponds to rescind their existing permit for the WWTP operation.

The City hired Bennett Engineering Services Inc (BEN|EN) to acquire funding, design the WWTP Ponds closure project and manage the construction in an effort to rescind the City’s unused NPDES permit.

BEN|EN has completed the environmental clearances, funding acquisition through the CWSRF, and the design for the project.

Funding for the project was secured this year from the SWRCB CWSRF. Funding for the project includes planning, legal fees, funding acquisition, design, construction management and inspection, and Item #06
construction costs incurred by the City of the past several years. There should be no cost to the City for this project.

The project involves removing municipal sludge remaining in the abandon ponds and regrading of the ponds site for future use by the City. Sludge from both the North and South Ponds sites will be hauled to a Class II landfill by the contractor per federal regulations.

Construction is expected to start in October and continue through Fall of 2023.

Discussion & Analysis:

The City has signed the grant agreement for the initial amount of $7,353,299 from the CWSRF (includes planning, legal fees, funding acquisition, design, construction management and inspection, construction, contingency and grant management costs).

All six construction bids came in within 11% of the engineer’s estimate and well within the budgeted grant amount.

Fiscal Impact:

This project’s cost incurred on the project will be reimbursed by the grant. Expenses incurred to date have been, or will be, submitted for reimbursement in the next couple of months. The remaining grant amount for construction and management will be submitted for reimbursement on a monthly basis going forward until the end of the project. Bennett Engineering Services is already under contract for grant management services including reimbursement requests as the project progresses.
