RE: Amendment of Agreement for Legal Services
The City desires to continue to retain Shute, Mihaly & Weinberger LLP for legal services to assist the City with litigation against the California Department of Transportation (CalTrans) related to its Final EIR/EA for the State Route 70 Binney Junction Roadway Rehabilitation and Complete Streets Project.
This letter serves to amend the contract amount from the current not-to-exceed amount of $60,000 to $120,000, allowing continued representation of the City in the matter, either by through settlement negotiations or preparatory steps to proceed with litigation. No other changes to the original agreement are intended as part of this extension. Considering the foregoing, please sign and return a copy of this letter to acknowledge your agreement for professional legal services will be continued with a revised not-to-exceed amount of $120,000.
