Item #10
Date: February 7, 2023
To: Mayor and City Council
From: Dan Flores, Community Development Director
Jim Schaad, City Manager
Subject: Facilities Use Agreement for the Yuba-Sutter Youth Soccer League, Inc.
Recommendation:
Pass a Motion to approve a 10-year agreement with the Yuba-Sutter Youth Soccer League, Inc. to utilize a portion of Beckwourth Riverfront Park for Youth Soccer Training and Competition.
Discussion & Analysis:
The Yuba-Sutter Youth Soccer League (YSYSL) has been a long-standing licensee of the City of Marysville.
They have held an agreement with the City for youth soccer training and competition since November 2, 1988. Their current use agreement expired on June 1, 2022. YSYSL is interested in extending the term of its agreement for the 2023 soccer season and the subsequent 10 years expiring December 31, 2032.
The City and YSYSL wish to continue their relationship for the use of the soccer facility, on terms and conditions that are beneficial to the taxpayers of Marysville who own the grounds, and the many thousands of youngsters who participate and enjoy the organized activities sponsored by YSYSL at this location.
Once this recommendation is approved the City would grant to YSYSL on the terms and conditions set forth in the attached agreement a license for use of the license area on “Licensee Use Days”. YSYSL shall have exclusive use of the license area on the “Licensee Use Days”. YSYSL shall have no right to use the license area on days that are not designated as “Licensee Use Days” except to the extent that the public would have the right to use the fields. The licensee shall have the right to promote, schedule, and play youth soccer to the extent that the participants are members of the YSYSL Youth Soccer League and are covered by the licensee’s insurance. YSYSL may continue to reserve dates for non-youth soccer events provided that the person, firm, or entity who uses the license area must contact the City on the earlier of 10 days after the licensee reserves a date for non-youth soccer events. The City must have, and the entity must supply the City with acceptable insurance, sign a use agreement acceptable to the City, and pay fees to the City for use of the license area. YSYSL shall provide notification of reserved dates to both the City Manager as well as persons as the City Manager may designate.
The Community Development Director, City Manager, and the City Attorney met with the Directors of YSYSL and agreed upon the terms proposed in the attached agreement.
Item #10
Alignment with City Council Goal(s):
Goal #1: Increase Fiscal Sustainability, Goal #2: Expand Economic Development Opportunities and Goal #5: Support Parks & Recreation.
Fiscal Analysis:
This agreement is for 10 years with a yearly fee of $3,000 the first year, $3,250 the second year, and increased by $250 each subsequent year. The 10-year contract has a value of $41,250 for the user fee.
Along with the use fee, the agreement also contains language for reimbursement for the cost of utility service and any other service supplied for the licensed area.
There is an additional benefit in sales tax revenue, however, this is difficult to quantify. Sports events can bring a lot of people to the community that will stay overnight, eat at the local restaurants, and purchase gas and supplies from the local stores. In addition, the City will be negotiating a parking feesharing agreement with YSYSL prior to June 1, 2024.
