Subject: Department of Alcohol Beverage Control (ABC) Designee Recommendation:
Pass a Motion to designate and authorize the City Manager to be City Council’s designee to make determinations of Public Convenience or Necessity (PCN) for persons/premises applying for an ABC License.
Background:
ABC sent a letter to the City of Marysville on or around January 31, 2023, asking for assistance in designating a person or Council as designee to assist with ABC license determinations within the City of Marysville. Pursuant to section 23958.4 BPC, certain license types such as off-sale (types 20,21), public premises (types 42,48), and certain club type licenses (types 50,51,57), the Department (ABC) may issue said licenses if the local governing body of its designated subordinate officer or body, determines that issuance of the license would serve a public convenience or necessity (PCN).
