RESOLUTION NO. 2023-XX
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MARYSVILLE,
CALIFORNIA APPROVING A LICENSE AGREEMENT WITH AMERICAN
PROMOTIONAL EVENTS, INC., A CALIFORNIA CORPORATION (“TNT”) FOR
THE TEMPORARY USE OF A PORTION OF CITY-OWNED PROPERTY LOCATED AT 1225 B STREET IN MARYSVILLE FOR FIREWORK SALES
At the regular meeting of the Council of the City of Marysville, State of California, held on the 4th day of April, 2023.
WHEREAS, the 2024 Marysville High School Grad Night Committee has requested the use of City-owned property located near 1225 B Street in Marysville to place a fireworks booth and sell fireworks; and
WHEREAS, the sale of fireworks is an annual fundraising event of the Grad Night Committee, the proceeds of which help pay for the costs of “Grad Night;” and WHEREAS, the Grad Night Committee contracts with American Promotional Events, Inc. (hereinafter “TNT”) to manage and operate the fundraising event for the benefit of the Grad Night Committee, and wishes the City to execute an appropriate license agreement to permit TNT to install a fireworks booth and undertake fireworks sales on behalf of the Grad Night Committee on City-owned property located near 1225 B Street; and WHEREAS, the City Council wishes to support the Grad Night event.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Marysville, as follows:
A. The License Agreement between the City of Marysville and TNT attached hereto and incorporated herein as if fully set forth herein is hereby approved; and B. The City Manager or designee is authorized to execute said License Agreement and any other related documents which are necessary for the 2024 Marysville High School Grad Night Committee to sell fireworks on City-owned property.
I HEREBY CERTIFY that the foregoing Resolution was duly and regularly introduced and adopted by the Council of the City of Marysville, County of Yuba, State of California, held on the 4th day of April, 2023, by the following vote:
