Item #05
Date: April 4, 2023
To: Mayor and City Council
From: Nicole Moe, City Clerk
Jim Schaad, City Manager
Subject: California Office of Emergency Services (CalOES) Designation of Applicant’s Agent for NonState Agencies (Form CalOES 130) Recommendation:

Pass a Motion to 1) adopt Resolution 2023-XX approving the CalOES’ Designation of Applicant’s Agent Resolution for non-state Agencies, under the Robert T. Stafford Disaster Relief and Emergency Assistance Act of 1988 and 2) approve the City Manager, or designee, to complete and submit the necessary forms to CalOES to comply with reimbursement procedures.

Rationale for Recommendation:

Adopting this resolution, allows the City to submit to the State for possible future reimbursements for the City’s costs and expenses of responding to any future disasters over the next three (3) years.

Background:

When State and/or Federal governments declare States of Emergency, State and/or Federal reimbursements for the municipal expense of responding to local disasters, such as COVID-19, become available. Under the Robert T. Stafford Disaster Relief and Emergency Assistance Act, non-state agencies, such as the City of Marysville, are authorized to submit applications for obtaining State and Federal financial assistance through CalOES, by adopting a Designation of Applicant’s Agent Resolution designating CalOES as agent of the City for that purpose. A new Resolution is required if the previously submitted document is older than three (3) years from the last date of approval or has never been filed with the State. The City’s previous resolution will expire on April 7, 2023.

Discussion & Analysis:

The Applicant’s Agent Resolution is required to be filed with CalOES to be eligible for emergency and or disaster recovery reimbursement from State and Federal Agencies, Resolution No. 2023-XX serves that purpose. The Resolution allows the City to apply for both any reimbursements and new funding for any declared emergency and for additional funding necessary for the next three (3) years. Resolution No. 2023-XX designates the City Manager, Finance Director and the City Clerk as the City’s authorized agents to execute and deliver any, and all, additional certificates, assurances, agreements, and other documents Item #05
as may be required of the City in connection with obtaining State and Federal financial assistance for which the City is eligible.

Alignment with City Council Goal(s):

Goal #1: Increase Fiscal Sustainability:

The resolution and Council authorization will allow the City to recapture and receive reimbursement for General Fund monies that are currently being spent to respond to the COVID-19 pandemic.

Fiscal Impact:

There would be a positive financial impact. However, the exact dollar amount is unknown at this time.
