Item #03
Date: June 20, 2023
To: Mayor and City Council
From: Christian S. Sachs, Chief of Police
Jim Schaad, City Manager
Subject: Initiate Code Enforcement Legal Proceedings
Recommendation:
Pass a Motion to authorize City Attorney to initiate code enforcement legal proceedings as it relates to real property located at 220 18th Street, Marysville, CA.
Rationale for Recommendation:
Code Enforcement personnel have attempted to gain compliance through the administrative abatement process for the past 11 months without success. Legal action for formal abatement is the next step in the process to mitigate this hazard.
Background:
Code enforcement personnel initiated a Code Enforcement action on 220 18th Street, Marysville CA, on May 25, 2022. The action was in reference to several violations of the Marysville Municipal Code.
Specifically, miscellaneous lumber and garbage strewn about the property causing blight, offensive odor coming from the front and back yards of the property, garbage and debris piled in the backyard that is visible from the street/public roadway, piles of trash in the front yard attracting bugs/vermin, residence windows broken out and covered with cardboard, building appears to be falling apart in disrepair causing a potential fire hazard, and vehicles parked on the grass.
Code Enforcement has issued 11 notices of violation from May 25, 2022, through April 20, 2023. Total fines are currently in the amount of $1,210. This does not include the personnel time committed to all inspections and noticing of said property.
Additionally, Marysville Municipal Code 8.12.430 only allows for 3 dogs per residence. At this current time there are 9 dogs at this location, only 6 of which are registered. Animal Care Services has issued citations for unlicensed dogs and there are other pending court cases in reference to animal registration violations.
Item #03
Discussion & Analysis:
The Code Enforcement team has followed the administrative abatement process by noticing this property owner 11 times in the last 11 months. Code Enforcement personnel had specifically spoken with the resident who is also the property owner, and she is non- compliant.
The administrative abatement process has been exhausted and the next step in the abatement process is to file formal abatement sanctions through the courts in an effort to gain compliance.
Legal Review:
This abatement case has been reviewed by and discussed with the City Attorney.
Fiscal Impact:
No fiscal impact at this time to begin the process.
