Item #10
Date: June 20, 2023
To: Mayor and City Council
From: Christian S. Sachs, Chief of Police
Jim Schaad, City Manager
Subject: Approve Ordinance No. XX approving Amendments to Chapters 8.04 and 8.13 of the Marysville Municipal Code
Recommendation:
Pass a Motion to 1) introduce an Ordinance for the first reading, 2) set July 18, 2023 for the second reading and consideration for adoption, 3) waive the first and second reading of the Ordinance authorizing the changes Amending Portions of Chapter 8.04 of the Marysville Municipal Code Entitled, “General Regulations” and Chapter 8.13 of the Marysville Municipal Code Entitled, “Penalty for Violations.”
Rationale for Recommendation:
Chapter 8.04.130 required an update for private property violations and Chapter 8.13 required an amendment to outline specific correctable violations.
Background:
Current Chapter 8.04.130 (a) is a duplicated section within the code. The new subsection (a) is in response to dogs depositing fecal matter on private property and a requirement for said person in control of such animal to remove and dispose. Current Chapter 8.13 only lists two fine amounts, and this section needs to address which ordinance sections are allowed as correctable violations.
Discussion & Analysis:
The proposed ordinance amendment to 8.04 will clarify fecal matter deposited on private property and the prosed ordinance amendment to 8.13 will outline correctable violations as it relates to Chapter 8.12.
Legal Review:
This amendment has been reviewed and approval by legal counsel.
Fiscal Analysis:
There is no fiscal impact with this item.
