Item #11
Date: June 20, 2023
To: Mayor and City Council
From: Christian S. Sachs, Chief of Police
Jim Schaad, City Manager
Subject: Approve Ordinance No. XX Approving Amendment to Chapter 9.50 Recommendation:
Pass a Motion to 1) introduce Ordinance 9.50 for first reading and 2) set July 18, 2023, for second reading and consideration for adoption 3) waive the first and second reading of the Ordinance authorizing the changes to Chapter 9.50 of the Marysville Municipal Code and 4) transfer $10,000 from 10-160-5202, Property Maintenance & Beatification, to 10-130-5233, Code Enforcement, for Code Enforcement abatement actions in FY 23-24.
Rationale for Recommendation:
Chapter 9.50 required clarification for administrative penalties and formats for hearing officers.
Currently, there is no identified Code Enforcement fund for abatement proceedings. There is no dedicated code enforcement budget, and a budget needs to be adopted in an effort to continue with formal abatement proceedings.
Background:
The City of Marysville has established a Code Enforcement team which has increased code enforcement activity within the City. In reviewing existing codes, some sections of said codes require the suggested amendments to meet current direction with abatement proceedings.
City Staff is requesting a $10,000 budget in an effort to fund abatement proceedings in order to gain compliance. No budget for code enforcement proceedings currently exist.
Code Enforcement and City Staff have developed a streamlined enforcement process that consists of four steps. They are the following: 1). Notice to Correct, 2). Order to Correct, 3). Abatement Warrant (through the courts), and 4). Lien on property.
Discussion & Analysis:
The proposed Ordinance amendment to 9.50 will clarify administrative penalties and procedures.
The streamlined process, pursuant to the code, allows for fines of $100 per day for first violation.
Property owners will have 15 days to correct the violation, prior to the commencement of any fines / penalties.

Legal Review:
This amendment has been reviewed and approval by legal counsel.
Fiscal Analysis:
Staff is requesting to transfer $10,000 from 10-160-5202, Property Maintenance & Beatification, to 10- 130-5233, Code Enforcement, to provide funding for formal abatement proceedings. This transfer would occur in the newly adopted Fiscal Year 23-24 budget and would be no additional cost to the City.
