Date: June 20, 2023
To: Mayor and City Council
From: Dan Flores, Community Development Director
Jim Schaad, City Manager
Subject: Lease Agreement for Bryant Field
Recommendation:

Pass a Motion to approve a Lease Agreement for Bryant Field, between the City of Marysville and Highlands Community Charter School.

Background:

Highlands Community Charter School is a Public Adult Community Charter School with a strong presence in the Sacramento and San Diego Region as well as a branch located in the City of Marysville. An important component of the mission of Highlands is building legacies leading to self-sufficiency and generational change through strong community partnerships. Highlands has expressed a desire to lease Bryant Field as a training and event facility, further enhancing its partnership commitment with the City of Marysville.

Discussion and Analysis:

Highlands Community Charter School is an Adult Charter School with over 13,000 students and 30 locations throughout the State of California. Highlands has demonstrated a strong commitment and substantially invested in improving and maintaining Bryant Field. Highlands’ commitment and investment have made it possible for the Marysville Drakes Baseball Team to safely play baseball on the field. The Drakes are part of a larger independent professional baseball league called the “Pecos League” with 16 teams throughout the United States including 8 teams in California. The improvements have also created a more attractive environment for other potential events at the ballpark.

Highlands recognized the benefit of training students at Bryant Field and utilizing the stadium for large events related to their school. The City created a mutually beneficial lease agreement. The lease agreement is to be effective May 1, 2023, as Highlands did some maintenance and improvements beginning on that date.

Some key terms of the lease agreement include 1) The lease is for 3 years with the option for renewal. 2) The lease rate is $2,000 per month with a 3% increase each year. 3) The Lessee (Highlands) will be solely responsible for all maintenance and City-approved improvements to the ballpark or field. 4) The Lessee is responsible for all utility expenses (water, sewer, electricity, gas) during the term of the lease. 5) The City will maintain the right to continue holding community and other reserved events at the ballpark under the terms indicated in the lease agreement. 6) All billboards, banners, and other forms of advertising including electronic billboards must be pre-approved by the City. 7) Lessee will have naming rights Item #08
subject to City approval provided “Bryant Field” remains part of the name selected by the Lessee.

Additional terms are outlined in the attached agreement.

Alignment with City Council Goal(s):

Goal #1: Increase Fiscal Sustainability
Goal #2: Expand Economic Development Opportunities
Goal #5: Support Parks & Recreation
Legal Review:

This contract has been reviewed and approved by legal counsel.

Fiscal Analysis:

The term of the Lease is three (3) years with the annual rent starting at $2,000 per month for the first year and increasing by 3% on the 1st of May each year to coincide with the Agreement date. The revenue to the City over the three years will total $73,181.60. In addition, Highlands has contributed over $300,000 in the form of improvements and maintenance to the ballpark this year to date with further improvements and maintenance planned for the duration of the lease with the approval of the City.
