RESOLUTION NO. 2023-XX
RESOLUTION OF THE COUNCIL OF THE CITY OF MARYSVILLE, STATE OF
CALIFORNIA, ASSESSING COSTS OF DELINQUENT REFUSE SERVICE CHARGES
AGAINST PROPERTY TO BE COLLECTED ON THE SECURED TAX ROLL IN THE
SAME MANNER AS THE GENERAL TAXES OF THE CITY
At a regular meeting of the Council of the City of Marysville, California, held on the 18th day of July, 2023.
WHEREAS, Sections 5470 and 5473 of the California Health and Safety Code permit the collection of delinquent charges for refuse collection and disposal service on the tax roll in the same manner as general taxes; and
WHEREAS, Section 6.08.095, entitled "Billing Charges to be a Lien," of Chapter 6.08 of the Marysville Municipal Code entitled "Refuse Disposal" further authorizes the City of Marysville to place a lien on private property for collection of unpaid refuse collection and disposal bills; and
WHEREAS, the Finance Director has caused a notice to be given to the property owners of all properties described in Exhibit "A" having delinquent refuse collection and disposal bills; and
WHEREAS, notice was given by mailing a notice to the owner thereof as shown on the most recent Assessor's Roll; and
WHEREAS, neither the record owner nor any other person complied with the order of the Finance Director; and
WHEREAS, said notice has become final; and
WHEREAS, the Finance Director has submitted to the City Council an itemized written report showing all required information, said report being Exhibit "A" attached hereto; and WHEREAS, a copy of said report was posted as required by law; and WHEREAS, at a regular meeting held on July 18, 2023, the City Council conducted a hearing to consider the objections of any property owners liable to be assessed for the cost of delinquent refuse disposal billings; and
WHEREAS, the City Council wishes by this Resolution to assess against the properties described in Exhibit "A" the cost incurred for refuse disposal described in the report filed by the Finance Director.
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Marysville that the report filed by the Finance Director, which is attached hereto as Exhibit "A," is hereby confirmed as submitted to this Council.
BE IT FURTHER RESOLVED that this Council hereby orders that the cost described in Exhibit "A" be assessed against the properties also described therein and hereby confirms that assessment.
BE IT FURTHER RESOLVED that said assessment shall constitute a special assessment against any lien upon each of said properties.
BE IT FURTHER RESOLVED that the City Clerk of the City of Marysville shall transmit a certified copy of this Resolution to the County Auditor of the County of Yuba and request that the County Auditor cause the amounts set forth in Exhibit "A" attached hereto to be reflected on the next regular tax bill levied against each parcel and the amount of each such assessment to be collected at the same time and in the same manner as ordinary City taxes are collected and that said assessment shall be subject to the same penalties and interest and to the same procedure for foreclosure and sale in the case of delinquency as are provided for ordinary City taxes.
I HEREBY CERTIFY that the foregoing Resolution was duly and regularly introduced and adopted by the City Council of the City of Marysville, County of Yuba, State of California, by the following vote:
