RESOLUTION NO. 2023-XX
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MARYSVILLE, STATE
OF CALIFORNIA, CERTIFYING INCLUSION OF DELINQUENT CHARGES AND
PENALTIES FOR SEWER SERVICES ON THE SECURED PROPERTY TAX ROLL IN
ORDER THAT THEY MAY BE COLLECTED IN THE SAME MANNER AS GENERAL TAXES
At a regular meeting of the City Council of the City of Marysville, California, held on the 18th day of July, 2023.
WHEREAS, Sections 5470 and 5473 of the Health and Safety Code of the State of California authorize collection of delinquent charges for sewer services on the tax roll in the same manner as general taxes; and
WHEREAS, Marysville Municipal Code Section 6.04.130 and Ordinance 960 (1981) provide for the collection of delinquent charges through the County property tax roll; and WHEREAS, in accordance with all applicable laws and through appropriate due process and notification, the owners of the subject properties as shown on Exhibit A attached hereto and incorporated herein as if fully set forth herein have not paid the incurred charges.
NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of Marysville does hereby:
1) Certify the listing of delinquent sewer charges and penalties attached hereto as Exhibit A, and by this reference incorporated herein as if fully set forth herein, and determine that each charge prescribed in said Exhibit A for each parcel is proper and correct;
2) Request the Yuba County Board of Supervisors to authorize the Auditor and Tax Collector to perform the functions respecting the placement of said delinquent charges and penalties on the tax roll and collecting said charges with the general taxes, for compensation at a cost not to exceed the amounts set by law; 3) Direct that liens of the same amount be placed on the properties to further secure the payment of the collection costs.
