Item #08
Date: August 15, 2023
To: Mayor and City Council
From: Christian S. Sachs, Chief of Police
Jim Schaad, City Manager
Subject: Code Enforcement Hearing Officer Contract
Recommendation:

Pass a Motion to approve Resolution No. 2023-XX to enter into an Agreement with David J. Collins dba Collins Law Firm to provide code enforcement hearing examiner services.

Rationale for Recommendation:

The City is required to have a code enforcement hearing examiner and there are no current appointments to this position.

Background:

Pursuant to Marysville Municipal Code 9.50.070, in order to hear cases brought by the enforcement officer under the provisions of Chapter 9.50, the City Council shall appoint by Resolution or Ordinance a hearing examiner. Such examiner shall serve at the pleasure of the City Council. At this time, there are no appointments to this position.

The Code Enforcement Department has increased enforcement and there is a need to have a hearing examiner in order to complete the appeals hearing process.

Discussion & Analysis:

David J Collins is currently the hearing examiner for the County of Sutter and the City of Yuba City. David J.

Collins has experience with the services needed and would serve at the pleasure of the City Council.

Staff has completed an agreement which has been reviewed and approved by David J. Collins if the City Council so chooses to approve this resolution and Agreement.

Legal Review:

The Agreement has been reviewed and approved by City Legal Staff.

Fiscal Analysis:

There is a fiscal impact of $85 per hearing as outlined in the contract, however the appellant has to pay a $500 hearing fee which would offset the cost of the hearing, thus no negative fiscal impact to the City.
