Item# 09

Date: November 7, 2023
To: Mayor and City Council
From: Dan Flores, Community Development Director
Jim Schaad, City Manager
Subject: Annex Building Lease Agreement with the Yuba County Office of Education Recommendation:

Pass a Motion to approve a Use Agreement by and between the City of Marysville (the City) and the Yuba County Office of Education (YCOE) for the premises located at 429 10th Street, Marysville, California.

Rationale for Recommendation:

The term of the Use Agreement is through April 30, 2028. In exchange for the Use Agreement, YCOE will provide a staff member to assist with Parks and Rec scheduling as well as access to their Parks and Rec Software. In addition, YCOE will be providing ongoing activities for Marysville Youth. YCOE will maintain the facility as well as the surrounding park area. In economic development, parks and recreation services are often cited as one of the most important factors in surveys of how livable communities are. Parks provide gathering places for families and social groups, as well as for individuals of all ages and economic statuses, regardless of their ability to pay for access.

Discussion & Analysis:

Yuba County Office of Education shall use the premises as a Community Education Center and Parks and Recreation Scheduling Center for the City of Marysville.

The term of this Use Agreement shall begin effective October 1, 2023, and shall continue until the end of the grant life of April 30, 2028. Notwithstanding the foregoing, the City may, upon no less than six months prior written notice to YCOE, cause early termination of the Use Agreement at any time during the term of the agreement.

The consideration for this agreement is set forth in the attached Use Agreement and will include YCOE providing Rec Desk software. The City will complete repairs to the building utilizing grant funds, as outlined in Exhibit B of the Use Agreement. Accordingly, there will be no rental payments included in this lease.

YCOE shall dedicate one staff member at the site to implement, monitor, and operate the Rec Desk software program for scheduling Parks and Recreation for the City. City of Marysville staff will also have access and be able to utilize the software remotely for the term of the lease.

Item# 09
Prior to YCOE occupying the space, the City of Marysville will do the following utilizing grant funds: (See Exhibit B) repair the roof; repair all broken windows and glass doors; repair the heating and air conditioning system; repair the electrical, and plumbing issues. The City of Marysville Public Works Director inspected the property and estimates that the above-listed repairs will cost approximately $300,000.

The City will continue to maintain the yard area around the building and YCOE will be responsible for maintaining the building itself. YCOE will also be responsible for all utilities.

Washington Square Park is zoned Primary Open Space (OS-1). Within this zoning designation buildings utilized as “service structures” are permitted with a Use Permit. The City’s annex building has served multiple uses in its history, including the Chamber of Commerce, and the Gold Sox headquarters.

Allowing the YCOE to operate out of this building, and to provide recreation services to the City, qualifies it as a service structure.

Alignment with City Council Goals:

Goal #1: Increase Fiscal Sustainability
Goal #2: Expand Economic Development Opportunities
Goal #5: Support Parks & Recreation
Fiscal Analysis:

The total award for the grant is up to $3,000,000 with a five-year grant project cycle commencing on May 1, 2023, and ending on April 30, 2028, with no local match agreement. There is no cost to the General Fund as all reimbursement for expenses will come from the Proposition 64 Grant with no rental payments included in this lease.
