Item #03
Date: December 5, 2023
To: Mayor and City Council
From: Nicole Moe, City Clerk
Jim Schaad, City Manager
Subject: Amendment to the Administrative Code – Title 5 – Part Time Sick Leave Recommendation:
Pass a Motion to adopt Resolution 2023-XX amending portions of the Administrative Code, Title 5, allowing for front loading of 40 hours of sick leave every January 1 for all eligible non-permanent, temporary, or extra-help employees per year effective January 1, 2024, per new Senate Bill (SB) 616.
Rationale for Recommendation:
Due to changes signed into law on October 4, 2023, Governor Newsom approved the increase in paid sick leave hours for part time employees to change from 24 to 40 each year, starting January 1, 2024, via SB 616. Currently the Finance Department Staff is front loading the 24 paid sick leave hours (current hours for 2023) afforded to employees by AB1522, the “Healthy Workplaces, Healthy Families Act of 2014” it will also allow part time staff to have a clear understanding of available hours as well as eliminating the administrative processes.
Background:
Historically, the Finance Department staff had the task to not only monitor all part time employees’ hours worked but must calculate how many hours the employee has earned based on the hours worked as well as manual entry of these hours earned into the payroll system each payroll period. Time was saved starting in January 2022 with Council’s approval to front-load hours, it is estimated that approximately 30- 45 minutes of Staff’s time has been saved each pay period. As part of the Healthy Workplaces, Healthy Families Act of 2014, Council has previously adopted Ordinance No. 1355 for the Marysville Administrative Code, and an amendment to the Administrative Code on January 21, 2014, to adopt the necessary changes to gain compliance with the Act. This change would be effective January 1, 2024.
