Item #03
Date: February 20, 2024
To: Mayor and City Council
From: Christian S. Sachs, Chief of Police
Jim Schaad, City Manager
Subject: California Highway Patrol Adult Use Marijuana Act (AUMA) Grant Recommendation:
Pass a Motion to 1) authorize the Police Chief to submit for California Highway Patrol Adult Use Marijuana Act (AUMA) Program Grant, 2) approval to accept the grant in the event the Police Department is awarded, and 3) authorize the Finance Director to make the appropriate supplemental appropriations per the grant documents if awarded.
Rationale for Recommendation:
Submitting for and accepting this grant funding would increase driving under the influence enforcement and send officers to advanced training.
Background:
With the passage of Proposition 64, the Control, Regulate, and Tax Adult Use Marijuana Act (AUMA), in 2016 California voters mandated the state set aside funding for the California Highway Patrol (CHP) to disperse to local governments and qualified nonprofit organizations for education, prevention, and enforcement of impaired driving laws pursuant to Revenue and Taxation Code Section 34019.
It is the intent of the CHP to enhance traffic safety by administering AUMA grants to educate the public regarding the dangers of impaired driving, fund efforts to remove impaired drivers from the roadway, and advance research into impaired driving issues.
The Marysville Police Department was awarded this grant in fiscal years 2021-2022, 2022-2023, and 2023- 2024.
Discussion and Analysis:
The California Highway Patrol Adult Use Marijuana Act (AUMA) Program grant would be a one-year grant if awarded. This grant cycle will be July 1, 2024, through June 30, 2025. This funding would be used to reduce the number of collisions by impaired drivers, increase public awareness related to the dangers of impaired driving, improve highway safety, send officers to advanced training, and provided additional enforcement such as DUI Saturation patrols and DUI checkpoints.
Fiscal Analysis:
There is no fiscal impact to the City General Fund nor required matching funds. If awarded, a supplemental appropriation, not to exceed $77,953, would be added to the proper accounts per the grant award documents within Fund 28, Cannabis Tax Grant in Fiscal Year 2024-25.
