Subject: Affirmatively Further Fair Housing
Recommendation:
Pass a motion to adopt Resolution 2024-XX supporting efforts by the City of Marysville to affirmatively further fair housing.
Summary:
The State of California over the past several years has adopted requirements to ensure that jurisdictions combat housing discrimination. This effort is referred to as a program to affirmatively further fair housing.
During April’s Fair Housing Month, the City of Marysville is prioritizing this goal. By adopting this resolution, the City of Marysville will confirm fair housing as a priority, and continue to support access to job opportunities, housing and quality education, to eliminate barriers to housing.
Background
In 1968 Congress established the Fair housing Act to prohibit discrimination in the sale, rental and financing of housing based on race, religion and national origin. It has been expanded to include discrimination based on sex, disability and familial status. In 2019 the state adopted AB 686 which expands fair housing requirements outlined in the Fair Employment and Housing Act (FEHA). This law:
• Requires all state and local public agencies to facilitate deliberate action to explicitly address, combat, and relive disparities resulting from past patterns of segregation to foster more inclusive communities.
• Creates new requirements that apply to all Housing Element due for revision on or after January 1, 2021.
This requires all public agencies to examine existing and future policies, plans, programs, rules, practices, and related activities and make proactive changes to promote inclusive communities. As a result, the City’s current Housing Element (2021-2029), includes an implementation requirement to adopt an Item #XX
Affirmative Fair Housing Program. This has not been accomplished yet, due to staff resources and funding limitations, and continues to be on the staff’s radar to complete in the future.
This Resolution is important in affirming the city’s commitment to complying with the state mandate, and to be eligible for grant funding.
Fiscal Analysis
There is no fiscal impact in adopting this Resolution.
