Subject: Transfer Yuba County Assessor Parcel Nos. 010-156-005 & 010-156-006 (426 J St. & 1000 5th St., Marysville, California) from the City of Yuba City to the City of Marysville Recommendation:
Pass a Motion to adopt Resolution 2024-XX authorizing the City Manager to execute all documents and pay nominal fees necessary to transfer certain real property identified as Yuba County Assessor Parcel Nos. 010-156-005 & 010-156-006 (426 J St. & 1000 5th St., Marysville, CA) from the City of Yuba City to the City of Marysville.
Background:
On June 21, 2016, the Cities of Marysville and Yuba City entered a Cooperative Agreement authorizing Yuba City to be the Lead Agency for the 5th Street Bridge Replacement Project within Marysville City Limits. Terms of the agreement authorized Yuba City to exercise its powers of eminent domain to acquire property located within the City of Marysville until such time that both Cities agree that it is appropriate for Yuba City to quitclaim such property to Marysville. The 5th Street Bridge Replacement Project is complete and in the process of being closed out by Caltrans. On February 6th, 2024, the City Council for Yuba City adopted a resolution authorizing the transfer of subject properties back to the City of Marysville.
Discussion & Analysis:
The properties being transferred are identified as lots 5 and 6 in the attached aerial exhibit. The remainder portion of lot 5 is now right-of-way and part of a right turn lane from 5th Street onto J Street.
Should the City dispose of these properties in the future it will be subject to the Surplus Land Act process.
Alignment with City Council Goal(s):
Goal #1: Increase Fiscal Sustainability: This project addresses the City Council’s Strategic Goal of fiscal responsibility. The property has no utility or development value until transfer to the City of Marysville is complete.
Environmental Review:
On September 6, 2016, Yuba City conducted a Public Hearing and adopted Resolution No. 16-057 determining that the public interest and necessity required the acquisition and condemnation of certain Item #08
real property located at 426 J Street and 1000 5th Street, Marysville, California including certification of the appropriate environmental document. The transfer of this property from one agency to another is an exemption from CEQA under section 15312 as a Class 12 Categorical Exemption.
Legal Review:
The transfer of this property between agencies is exempt from current requirements of the Surplus Land Act in accordance with Government Code Section 54234.a(1). Marysville will be responsible for following the current requirements of the Surplus Land Act in the event it seeks to dispose of the property in the future.
Fiscal Analysis:
There will be minimal staff time involved in executing the necessary documents. The property was acquired with Regional Surface Transportation Funds awarded to Yuba City by SACOG with no local match funds required. Marysville will be responsible for all costs related to the transfer and recordation of the subject property which is minimal.
