PROCLAMATION OF THE EXISTENCE OF A LOCAL EMERGENCY IN THE CITY
OF MARYSVILLE DUE TO THE FIRE AT THE MARYSVILLE HOTEL
WHEREAS, California Government Code sections 8558 and 8630 empower the City of Marysville to proclaim the existence of a local emergency when the City is affected or likely to be affected by conditions of disaster or of extreme peril to the safety of persons and property within the City's territorial limits; and
WHEREAS, Chapter 2.68 of the Marysville Municipal Code authorizes the Director of Emergency Services to proclaim the existence or threatened existence of a local emergency when the City is affected or likely to be affected by conditions of disaster or of extreme peril to the safety of persons and property within the City, and the City Council is not in session; and WHEREAS, Chapter 2.68 of the Marysville Municipal City Code designates the City Manager to be the Director of Emergency Services; and
WHEREAS, the Director of Emergency Services of the City of Marysville hereby declares:
1. On June 16, 2024, a significant fire broke out at the Marysville Hotel, causing extensive damage to the structure and surrounding properties. The fire, although the hotel was vacant, has resulted in the severe impact on nearby businesses due to the necessary road closures and detours; and
2. The fire has created hazardous conditions including compromised structural integrity of the building, potential release of hazardous materials, and significant debris, all of which pose an ongoing threat to public safety; and
3. Immediate response and coordination from various city and county agencies are required to manage the aftermath of the fire, ensure public safety, and begin the process of recovery and rebuilding; and
4. Conditions of extreme peril to the safety of persons and property have arisen within the City caused by the fire at the Marysville Hotel, impacting significant City and community operations, including critical public infrastructure and services, and which will require the provision of additional public safety and emergency services; and
5. The closure and detouring of State Highway 70 between 3rd and 4th Streets due to the fire has caused significant impacts to daily commuters and goods movement. As a major corridor for goods transportation, this closure has resulted in severe traffic congestion, with delays of up to 40 minutes during peak hours. A vast majority of the City's police resources are actively engaged in traffic control to manage this situation, and businesses in the vicinity have been severely impacted by the detours; and
6. The California Department of Transportation (Caltrans) and the California Highway Patrol (CHP) have also expended significant resources to manage the resulting traffic backups and ensure the safety of commuters and efficient movement of goods through the detour routes; and
7. The compromised structural integrity of the Marysville Hotel poses an immediate risk of collapse, which could result in injury or death and property damage to commuters, truckers, and businesses adjacent to the building; and
8. The aforesaid conditions of extreme peril warrant and necessitate the proclamation of a Local Emergency to enable the City of Marysville and other local government entities to adequately plan, prepare, and deploy resources to effectively respond to the threat posed by the impacts of the fire, and to warn City of Marysville residents and visitors of the threat posed by the ongoing hazardous conditions; and
9. At the time of this Proclamation, the City Council is not in session (but was able to be called into session).
NOW THEREFORE, IT IS HEREBY PROCLAIMED that a local emergency exists throughout the City of Marysville, commencing on or about the time and date of the signature of the Director of Emergency Services below.
IT IS FURTHER PROCLAIMED AND ORDERED that during the existence of said local emergency, the powers, functions, and duties of the Director of Emergency Services shall be those prescribed by state law and the ordinances and resolutions of this City, and by the City of Marysville’s Emergency Operations Plan.
IT IS FURTHER PROCLAIMED AND ORDERED that this Proclamation shall remain in effect until further notice, and hereafter by ratification of the City Council.
IT IS REQUESTED that the Governor of the State of California proclaim a State of Emergency due to the threat posed by the fire at the Marysville Hotel in the State of California; include the City of Marysville in any emergency declaration by the State; ensure the City of Marysville is included in any emergency declaration that may be issued by the President of the United States of America; waive regulations that may hinder response and recovery efforts; and make available California Disaster Act and State Private Nonprofit Organizations Assistance Program funding. _______________________________________
