RESOLUTION NO. 2024-XX

RESOLUTION OF THE COUNCIL OF THE CITY OF MARYSVILLE, STATE OF

CALIFORNIA RATIFYING THE PROCLAMATION OF THE EXISTENCE OF A LOCAL

EMERGENCY IN THE CITY OF MARYSVILLE DUE TO THE FIRE AT THE

MARYSVILLE HOTEL
WHEREAS, California Government Code sections 8558 and 8630 empower the City of Marysville to proclaim the existence of a local emergency when the City is affected or likely to be affected by conditions of disaster or of extreme peril to the safety of persons and property within the City's territorial limits; and
WHEREAS, Chapter 2.68 of the Marysville Municipal Code authorizes the Director of Emergency Services to proclaim the existence or threatened existence of a local emergency when the City is affected or likely to be affected by conditions of disaster or of extreme peril to the safety of persons and property within the City, and the City Council is not in session; and WHEREAS, Chapter 2.68 of the Marysville Municipal City Code designates the City Manager to be the Director of Emergency Services; and
WHEREAS, on June 16, 2024, a significant fire broke out at the Marysville Hotel, causing extensive damage to the structure and surrounding properties, resulting in hazardous conditions including compromised structural integrity of the building, potential release of hazardous materials, and significant debris, all of which pose an ongoing threat to public safety; and WHEREAS, immediate response and coordination from various city and county agencies are required to manage the aftermath of the fire, ensure public safety, and begin the process of recovery and rebuilding, impacting significant City and community operations, including critical public infrastructure and services, which will require the provision of additional public safety and emergency services; and
WHEREAS, the closure and detouring of State Highway 70 between 3rd and 4th Streets due to the fire has caused significant impacts to daily commuters and goods movement, resulting in severe traffic congestion and economic impact to businesses in the vicinity; and WHEREAS, the compromised structural integrity of the Marysville Hotel poses an immediate risk of collapse, which could result in injury or death and property damage to commuters, truckers, and businesses adjacent to the building; and
WHEREAS, the incident has created significant economic impact to businesses directly impacted by the perimeter of the hotel's fall zone and to those affected by the re-routing of traffic; and
WHEREAS, the conditions of extreme peril to the safety of persons and property caused by the fire at the Marysville Hotel warrant the proclamation of a Local Emergency to enable the City of Marysville and other local government entities to adequately plan, prepare, and deploy resources to effectively respond to the threat posed by the impacts of the fire, and to warn City of Marysville residents and visitors of the ongoing hazardous conditions; and WHEREAS, at the time of this Proclamation, the City Council is not in session (but was able to be called into session).

NOW THEREFORE, BE IT RESOLVED:
