Item #07
Date: July 2, 2024
To: Mayor and City Council
From: Jennifer Styczynski, Finance Director
Jim Schaad, City Manager
Subject: State Community Development Block Grant (CDBG) Resolution Update Required by HCD Recommendation:
Pass a Motion to approve Resolution No. 2024-XX authorizing the Mayorto accept and enter into a CDBG grant agreement and all documents relating to the administration of the grant.
Rationale for Recommendation:
The State is asking for an updated resolution to replace the already approved and signed resolution adopted by the City Council on June 4, 2024, for the 2023A CDBG Notice of Funding Availability (NOFA) and the already approved and signed resolution adopted by the City Council on November 21, 2023, for the 2023 CDBG NOFA. In sections 4, 5 and 6 of the original resolutions, the City Council authorized the City Manager, or designee, the authority to execute and deliver all applications, enter into the grant agreement, and submit all funds requests and all required reporting forms in connection to the grant.
The proposed resolution will replace both previously adopted resolutions and will be submitted to the state upon approval. The resolution has been reviewed and approved by the CDBG representatives to avoid any further changes.
Discussion & Analysis:
One June 13, 2024, staff was notified by the California Department of Housing and Community Development (HCD) that pursuant to California Government Code sections 40601 and 40602, the Mayor or Mayor pro tempore must sign any written contracts and conveyances made or entered into by the City, unless the City has an ordinance or municipal code in effect that specifically allows or designates contracts to be signed by an officer other than the mayor or mayor pro tempore. In researching, per Chapter 2.04.110(c) of the Marysville Municipal Code (MMC), it states “The presiding officer shall sign all ordinances, resolutions, contracts, and other documents necessitating his signature which were adopted in his presence, unless he is unavailable, in which case the signature of an alternate presiding officer may be used.” In Chapter 2.04.090, the presiding officer is identified as the Mayor.
With this information, HCD is requesting a new resolution to authorize the Mayor to sign any written contract and conveyances made or entered into by the City. Staff will be working on updating the MMC Item #07
to allow the Council to designate the City Manager as signature authority for all ordinances, resolutions, contacts, and other documents to mitigate potential future requests.
Fiscal Analysis:
There will be no fiscal impact on the General Fund as this is an administrative clean-up only.
