Item #06
Date: September 3, 2024
To: Mayor and City Council
From: Vincenzo S. Corazza, Public Works Director
Jim Schaad, City Manager
Subject: Marysville’s Historic City Cemetery Security Services Agreement Recommendation:

Pass a motion to approve the agreement for Security Services at the Marysville’s Historic Cemetery and authorize City Manager to sign the agreement.

Background:

The City’s Historic Cemetery has had an onsite watchman for years that resided in a trailer provided by the City that would open and close the gates allowing visitors ground access and provided security and maintenance work on cemetery grounds. The City covered the cost of providing power, water, and a portable restroom on site. In 2021, the City started paying a stipend to the onsite watchman in the amount of $400 per month to perform extra duties that were assigned by the City.

Discussion & Analysis:

Since 2021, the City’s Historic Cemetery had entered into an Independent Contractor Agreement with Kevin Wright who provided security along with performing general maintenance services for the Historic Cemetery. In October of 2023, he resigned and vacated the position. The Cemetery Commission as well as City Staff have been looking for a replacement since. There were several applicants, but they did not pass a background check.

Daniel B. Ferguson (Contractor) is the current caretaker for the Catholic Cemetery that is across State Route 70 from the Historic Cemetery. He approached staff about the position and after checking his credentials and background, was qualified and willing to take the position. Per the agreement, the Contractor will be providing his own trailer and the City will be providing water, sewer, and electricity for the Contractor’s use.

The services to be performed under the agreement with the Contractor are as follows:
• Unlock the gates to the Historic Marysville City Cemetery as directed by the City. • Lock the gates to the Historic Marysville City Cemetery as directed by the City. • Promptly notify Marysville Police Department of any suspicious behavior he becomes aware of at the Historic Marysville City Cemetery. The Contractor shall notify the Police Department by calling (530) 749-3900.

Item #06
Legal Review:

This agreement has been reviewed by the City Attorney.

Fiscal Analysis:

The current monthly stipend of $400 has been budgeted using account 10-160-5165 for FY 2024-25. No additional funding is being requested with this agreement.
