Item #03
Date: October 1, 2024
To: Mayor and City Council
From: Christian S. Sachs, Chief of Police
Jim Schaad, City Manager
Subject: Approve Resolution 2024-XX Adopting a Policy Protecting Individuals Engaged in Nonviolent Civil Rights Demonstrations
Recommendation:

Pass a Motion to approve Resolution 2024-XX adopting a policy protecting individuals engaged in nonviolent civil rights demonstrations.

Rationale for Recommendation:

In preparation for the upcoming Community Development Block Grant Program (CDBG) for the 2024 funding year, the California Department of Housing and Community Development (HCD) has updated Chapter 4: Additional Grantee Requirements of the Grants Management Manual, effective August 27, 2024. This update mandates the adoption of an excessive force resolution that prohibits the use of excessive force against non-violent civil rights demonstrations.

Discussion and Analysis:

When Grantees sign the Standard Agreement to accept CDBG funds, they certify that they will pass and enforce a resolution prohibiting the use of excessive force by law enforcement agencies within its jurisdiction as this is the minimum requirement to comply with the federal excessive force requirements. The Marysville Police Department already has comprehensive policies in place regarding the use of force. These policies are designed to protect the rights and safety of all community members while fostering trust between law enforcement and the public. By adhering to these standards, the City not only complies with federal guidelines but also demonstrates its commitment to promoting accountability and community-oriented policing.

Fiscal Analysis:

There is no fiscal impact to the City associated with adopting this Resolution.
