Item #06
Date: 21 October, 2025
To: Mayor and City Council
From: Dan Flores, Community and Economic Development Director Jim Schaad, City Manager
Subject: Consideration of Caltrans Requests for Temporary Construction Easements and Property Acquisition Related to Highway 70 Project (Binney Junction Area) Recommendation:

Staff recommends that the City Council, 1) Pass a Resolution 2025 -XX to Authorize the City Manager to execute agreements with the State of California Department of Transportation (Caltrans) for the requested temporary construction easements, right-of-way easements, and property acquisitions as described herein and 2) Approve conveyance of the identified parcels and authorize related actions necessary to complete the transactions.

Rationale for Recommendation:

The Highway 70/Binney Junction project is a critical regional transportation improvement that will enhance traffic safety, mobility, and access within Marysville and Yuba County. The requested temporary construction easements and property acquisitions represent limited and strategically located areas necessary for Caltrans to complete the project. Approval ensures timely delivery of state-funded infrastructure improvements that directly benefit the City.

Background:

The California Department of Transportation (Caltrans) is undertaking a major improvement project along State Route 70 in the Binney Junction area of Marysville. As part of this project, Caltrans requires certain property interests currently owned by the City of Marysville to facilitate construction staging, roadway realignment, and right-of-way needs.

The parcels involved include temporary construction easements, long-term easements, and permanent acquisitions.

Discussion & Analysis:

The following parcels have been identified by Caltrans:

Parcels: 37880-1 (TCE), 37880-2, 37880-3 $25,000
Type: Utility Easements and Temporary Construction Easement Size: Approximately 10.54 acres combined
Location: Between Highway 70 and Union Pacific Railroad tracks.

TCE Duration: 40 months
These property rights are necessary to support Caltrans’ construction operations, provide access, and establish permanent right-of-way for the project.

Cal Trans has agreed to accommodate the trailer and the resident residing on the property.

Staff has reviewed the requests and determined that the affected parcels are not critical to ongoing City operations or long-term strategic land use plans. Conveyance of these property rights will not impair City services.

Alignment with City Council Goal(s):

Approval of this action aligns with the City’s strategic goals by:

Supporting regional mobility and safety improvements on State Route 70.

Facilitating state investment in Marysville’s transportation infrastructure.

Enhancing opportunities for economic development associated with improved roadway access and traffic flow.

Legal Review:

The City Attorney’s office has reviewed the proposed easement and acquisition documents provided by Caltrans. The agreements are consistent with applicable law, and no legal objections have been identified.

Execution of the documents by the City Manager is legally sufficient.

Fiscal Impact:

The fiscal impact to the City is expected to be neutral or positive. Caltrans will compensate the City for property acquisitions and easementsin accordance with fair market value. Revenues received may be directed to the City’s General Fund or designated for capital projects as determined by the City Council.

There are no anticipated ongoing costs to the City associated with the conveyance of these property rights.
