Item #08
Date: December 16, 2025
To: Mayor and City Council
From: Jeramy Chapdelaine, Public Works Director
Jim Schaad, City Manager
Subject: Approval of Caltrans Joint Use Agreement and Utility Agreement for State Route 70 – Binney Junction Sewer Relocation Project
Recommendation:

Pass Resolution 2025 -XX to Authorize the City Manager to execute the following agreements with the State of California Department of Transportation (Caltrans):
1) Approve the Caltrans Joint Use Agreement (DOT RW 13-01) related to City utility facilities located within State Highway 70 right-of-way.
2) Approve the Caltrans Utility Agreement No. 0325UA2858.10 for the relocation of City sewer infrastructure required for the State Route 70 Binney Junction Railroad Rehabilitation Project (03-0H160). 3) Authorize the City Manager to execute all required documents and take all actions necessary to complete the agreements, including issuance of progress billings consistent with Caltrans reimbursement requirements.

Rationale for Recommendation:

Caltrans is undertaking the Binney Junction roadway rehabilitation and operational improvements on State Route 70 in Marysville, from south of 14th Street to north of Cemetery Road. The project includes turn pockets and auxiliary lane improvements.

City sewer facilities are located within the project limits and must be relocated to accommodate construction. The City’s sewer facilities exist within Caltrans right-of-way and require updated easement documentation, triggering the need for:
• A Caltrans Joint Use Agreement (DOT RW 13-01) related to easements and use of State right-of-way by City utilities.
• A Utility Agreement (DOT RW 13-05) that defines the scope, cost responsibilities, billing procedures, and compliance requirements for relocation of City sewer facilities.

The FY21-22 Budget Act Memo provided by Caltrans staff (limited content available) indicates State processes applicable to budget authority and allocation of right-of-way funding.

Item #08
Discussion & Analysis:

Utility Relocation Requirements
Caltrans determined that City sewer lines must be relocated to clear the Binney Junction Railroad Rehabilitation Project area. The relocation will follow City Sewer Relocation Plans No. 03150000821 dated January 30, 2025 (8 sheets), approved by Caltrans on March 26, 2025. Caltrans issued Notice to Owner No. 2858.10 on September 15, 2025, directing relocation work.

Joint Use Agreement (JUA)
The JUA defines the easement relationship and authorizes the City’s continued use of State right-of-way for sewer facilities. It includes:
• Identification of existing City easements within State ROW • Modification/confirmation of easement locations
• Obligations for both parties related to future construction or maintenance Utility Agreement No. 0325UA2858.10
This agreement governs the relocation work and includes:
• Scope of Work (relocation of sewer facilities per approved plans) • Caltrans acknowledgment that existing facilities are being relocated at State expense because they are in the right-of-way under prior rights.
• Requirements for competitive bidding or City force account • Caltrans reimbursement procedures and monthly/quarterly billing • Federal compliance requirements
Legal Review:

The City Attorney’s office has reviewed the proposed easement and acquisition documents provided by Caltrans.

The agreements are consistent with applicable law, and no legal objections have been identified. Execution of the documents by the City Manager is legally sufficient.

Alignment with City Council Goal(s):

Approval of this action aligns with the City’s strategic goals by:

Goal #2 - Enhancing opportunities for economic development associated with improved roadway access and traffic flow.

Goal #3 - Facilitating state investment in Marysville’s transportation infrastructure.

Goal #4 - Supporting regional mobility and safety improvements on State Route 70.

Fiscal Analysis:

There is no direct cost to the City. Caltrans will pay 100% of the actual and necessary costs to relocate the City sewer facilities.

State payment is made within 45 days of receiving itemized progress bills from the City. The City must submit a final bill within 360 days of completion.
