Item #02

Date: March 17, 2026
To: Mayor and City Council
From: Jim Schaad, City Manager
Subject: Resolution of the City Council of the City of Marysville to appoint an Interim Human Resources Director, Pursuant to Government Code Sections 21221(h).

Recommendation:

Approve Resolution 2026-XX to appoint a temporary Interim Human Resources Director, under Government Code Sections 21221(h).

Background:

California Government Code 21221(h) of the Public Employees Retirement Law permits the governing body of public agency to appoint a CalPERS retiree to a vacant position requiring specialized skills during the recruitment of a permanent appointment, in order to prevent the stoppage of critical public services. This appointment requires formal approval by the City Council, as stipulated by state law. The City Council must pass a resolution to formalize the appointment and document the necessity of the interim appointment.

Discussion & Analysis:

The City has retained consultant John Perry to analyze the needs of the Human Resources Division. It has been confirmed that the City is in need of a Human Resources Director. In March 2026, the City will begin the review and recruitment process to fill the vacancy for the newly created Human Resources Director position.

The recruitment and placement process are expected to take at least four to six months. The recruitment process also includes multiple legally required background checks and administrative procedures before the selected candidate can begin working with the City.

The position of Human Resources Director is vital to the organization, now more than ever.

To employ John Perry as a retired annuitant during this transition, it is necessary to certify the nature of the employment appointment of John Perry as a retired annuitant with CalPERS.

Because of John Perry’s familiarity with the various labor agreements and current personnel Item #02
items in progress, his assistance during the staffing transition is critical to the continued success of the Human Resources Division.

It is anticipated that John Perry will serve in this capacity for approximately six months during the recruitment process for a permanent replacement. Salary compensation paid to retirees cannot be less than the minimum nor exceed the maximum rate of pay for the position. The hourly rate paid to John Perry will fall within the established salary range for the Human Resources Director position.
