Item #04
To: Mayor and City Council
From: Jeramy Chapdelaine, Public Works Director
Subject: Administrative update to the Americans with Disabilities Act (ADA) Transition Plan Recommendation:

Pass a Motion to approve administrative updates to the ADA Transition Plan changing the current ADA Coordinator and email from Craig C Platt to Jeramy Chapdelaine, Public Works Director and repeal resolution 2020-34 and replace with Resolution 2026-XX accepting the administrative update.

Rationale for Recommendation:

The Transition Plan is required in order to comply with The Americans with Disabilities Act (ADA) and to ensure that City programs, services and activities are accessible to persons with disabilities and that public facilities, such as buildings, parks and streets, meet physical access requirements. To assist the City to maintain compliance with current Federal ADA requirements it is necessary to approve and adopt the City's amended ADA Transition Plan to reflect the current Public Works Director as the contact and ADA administrator.

Background:

The Americans with Disabilities Act (ADA) was originally enacted on July 26, 1990 as Public Law 101- 336 (42 U.S.C. Sec. 12101 et seq.), and became effective on January 26, 1992. The fundamental goal of the ADA is to ensure equal access to civic life for people with disabilities. Title II of the ADA requires state and local governments to make their programs, services and activities accessible to persons with disabilities. It also establishes physical access requirements for public facilities (buildings and sidewalks, etc.). The ADA requires that all cities with greater than 50 employees establish an ADA Transition Plan by 1995, as ADA codes continue to change, the City must update its Transition Plan to ensure compliance with the ADA Act.

The ADA Transition Plan will assist the City by authorizing staff to conduct surveys and identify physical obstacles limiting accessibility to the City's public buildings and sites where programs, services and activities are provided to the public, describing the methods to make the programs, services and activities accessible and developing a proposed schedule to implement these methods. The ADA Transition Plan update will include several components. Staff will perform reviews of City ADA policies and procedures, conduct surveys of City buildings, public right of way and parks to determine barriers to access, lead public outreach efforts and create the City's ADA facilities database.
