Item #04
Date: July 21, 2026
To: Mayor and City Council
From: Jeramy Chapdelaine, Public Works Director
John Mallen, Consulting City Engineer
Subject: Binney Junction Sewer Main Relocation Project, Contract 26-01 – Contract Award Recommendation:

Pass a Resolution 2026-XX to award a contract in the amount of $1,064,536.00 to Newland Entities Inc. for relocation of the Sewer main around the low area of the Binney Junction project on State Route 70 / B Street under the Caltrans Utility Agreement No. 0325UA2858.10 for the relocation of City sewer infrastructure required for the State Route 70 Binney Junction Railroad Rehabilitation Project (03-0H160), based on Contract Number No. 26-01, Binney Junction Sewer Main Relocation Project, Improvement Plans / Contract Documents and Contractor’s submitted bid package.

Rationale for Recommendation:

As required by the City of Marysville’s Municipal Code, Chapter 2.76, Purchases, a formal bid was advertised, opened, tabulated, and staff is requesting Council authorization to award the project to lowest responsive bid by the lowest responsible bidder.

Background:

Utility Relocation Requirements
Caltrans determined that City sewer lines must be relocated to clear the Binney Junction Railroad Rehabilitation Project area. The relocation will follow City Sewer Relocation Plans No. 03150000821 dated January 30, 2025 (8 sheets), approved by Caltrans on March 26, 2025. Caltrans issued Notice to Owner No. 2858.10 on September 15, 2025, directing relocation work.

Joint Use Agreement (JUA) completed between the City and Caltrans The JUA defines the easement relationship and authorizes the City’s continued use of State right-of-way for sewer facilities. It includes:
• Identification of existing City easements within State ROW • Modification/confirmation of easement locations
• Obligations for both parties related to future construction or maintenance Utility Agreement No. 0325UA2858.10 completed between the City and Caltrans This agreement governs the relocation work and includes:
• Scope of Work (relocation of sewer facilities per approved plans) Item #04
• Caltrans acknowledgment that existing facilities are being relocated at State expense because they are in the right-of-way under prior rights.
• Requirements for competitive bidding or City force account • Caltrans reimbursement procedures and monthly/quarterly billing • Federal compliance requirements
On June 5, 2026, the city executed and agreement with Union Pacific Railroad for the realigned sewer crossing under the Railroad.

On July 16, 2026, bids were opened and the City Engineer subsequently tabulated and reviewed the bids.

See Attachment 1 Bids Results for a tabulation of bids.

Discussion & Analysis:

The city received 4 bid proposals, all responsive and within the expected range of the estimated cost. The lowest bid received was from Newland Entities Inc. with a listed subcontracts of Tull Consulting Group, Pacific Boring, Cell-Crete Crop, and Bravos Controls in the amount of $1,064,536.00. In addition to the cost of the contract, the city is budgeting and additional 15% to cover construction management and inspection, UPRR agreement costs and City administration cost along with a 10% contingency for the unforeseen project cost of construction totaling $266,134.00. The total budgeted construction cost would be $1,330, 670.00.

The agreement with Caltrans estimated the total project cost around $1,500,000, so this contract in line with that estimated cost.

Environmental Review:

The proposed sewer infrastructure relocation is being performed pursuant to Caltrans Utility Agreement No. 0325UA2858.10 to accommodate the State Route 70 Binney Junction Roadway Rehabilitation and Complete Streets Project (EA 03-0H160; SCH No. 2020050510). The utility relocation was evaluated as part of the Final Environmental Impact Report/Environmental Assessment (EIR/EA) prepared and approved by Caltrans for the Binney Junction Project. The City's work is within the scope of the approved Caltrans project and no additional environmental review is required for this contract award.

Alignment with City Council Goal(s):

Goal #3 Improve Infrastructure
Fiscal Impact:

Total Project Cost: $1,330,670
Caltrans Agreement Funding: $1,330,670
Local Cost Share:

The City will cover the costs initially until Caltrans remits reimbursement under the agreement.
