Item #02
Date: August 20, 2026
To: Mayor and City Council
From: Jim Schaad, City Manager
Subject: Adopt Resolution 2026-XX to Appoint Bruce Buttacavoli and Brad Hudson to the Office of Councilmember and Canceling the November 3, 2026, Election due to only two (2) candidates being nominated for two (2) open Councilmember offices.

Recommendation:

Staff recommends that the City Council adopt Resolution 2026-XX, appointing Bruce Buttacavoli and Brad Hudson to the Office of Councilmember for a full term of four (4) years in lieu of an election, and canceling the November 3, 2026 Election, pursuant to California Elections Code Section 10229.

Rationale for Recommendation:

Elections Code Section 10229 provides that if by the statutory nomination filing deadline, no one or only one person has been nominated for any office, and there is no citywide contested race, then the City Clerk shall certify those facts to the City Council and publish notice of the same. More than five days after publication, the City Council may take one of three courses of action for each of the offices:

1. Appoint to the office the person who has been nominated.

2. Appoint to the office an eligible voter if no one has been nominated.

3. Hold the election for the office.

Pursuant to Elections Code Section 10229, the City Clerk provided the required certification to the City Council that only two (2) people have been nominated for the two (2) open Councilmember offices and published a notice of the same.

Adoption of Resolution 2026-XX would appoint Bruce Buttacavoli and Brad Hudson to the City Council for full terms of four (4) years and would cancel the November 3, 2026 election.

If appointed, Bruce Buttacavoli and Brad Hudson would take office and serve exactly as if elected at the November 3, 2026, Election.

Background:

On June 2, 2026, the City Council adopted Resolution 2026-22, calling and giving notice of the holding of a general municipal election for the purpose of electing two (2) members of the City Council for the full term of four (4) years.

As of the close of the nomination period, Friday, August 7, 2026, only two (2) candidates, Bruce Buttacavoli and Brad Hudson, had been nominated and filed nomination papers to run for City Council.
