ORDINANCE NO. ______

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF MARYSVILLE ADDING SECTION 3.12.065 TO THE MARYSVILLE MUNICIPAL CODE TO IMPLEMENT THE SHORT-TERM RENTAL FACILITATOR ACT OF 2025 AND REQUIRE SHORT-TERM

RENTAL FACILITATOR REPORTING
WHEREAS, the City of Marysville imposes a transient occupancy tax pursuant to Chapter 3.12 of the Marysville Municipal Code on transient occupancy in hotels and other lodging facilities, including homes, houses, apartments, and portions of structures offered for transient lodging; and WHEREAS, online short-term rental marketplaces may advertise or facilitate transient occupancies without publicly displaying the precise location of the lodging, making it difficult for the City to identify operators who are required to register, collect, report, and remit transient occupancy tax; and
WHEREAS, Senate Bill 346 (Stats. 2025, ch. 751) enacted the Short-Term Rental Facilitator Act of 2025, codified at Government Code section 50990 et seq., effective January 1, 2026; and WHEREAS, Government Code section 50990 authorizes a city to adopt an ordinance making the Act applicable within its jurisdiction, after which the city may require short-term rental facilitators to provide specified information needed to identify short-term rentals and administer and enforce transient occupancy tax requirements; and
WHEREAS, the City Council desires to implement the Act within Marysville to promote consistent registration, reporting, and payment of transient occupancy tax and equitable treatment of all transient lodging operators.

NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MARYSVILLE DOES ORDAIN AS FOLLOWS:

SECTION 1. Findings and Purpose.

The foregoing recitals are true and correct and are incorporated into this Ordinance. The purpose of this Ordinance is to implement the Short-Term Rental Facilitator Act of 2025 within the City and provide the Tax Administrator with information necessary to identify short-term rentals, administer Chapter 3.12, and promote collection of transient occupancy tax legally due to the City.

SECTION 2. Municipal Code Amendment.

Section 3.12.065 is added to the Marysville Municipal Code to read as follows:

3.12.065 Short-Term Rental Facilitator Reporting.
(a) Applicability of State Law. Chapter 4.6 (commencing with section 50990) of Part 1 of Division 1 of Title 5 of the California Government Code, known as the Short-Term Rental Facilitator Act of 2025 (the "Act"), is hereby made applicable within the jurisdictional boundaries of the City of Marysville. Unless the context requires otherwise, terms used in this section have the meanings assigned to them by the Act.
(b) Quarterly Reporting. Upon written request of the Tax Administrator, each short-term rental facilitator shall submit a report to the City for each calendar quarter in the form and manner prescribed by the Tax Administrator. Each report shall identify the physical address, including the nine-digit ZIP Code, of each short-term rental within the City that was facilitated during the reporting period. The report shall be submitted no later than the last day of the month following the close of the applicable calendar quarter, unless the Tax Administrator specifies a later date.
(c) Additional Identifying Information. If the information provided under subsection (b) is insufficient to identify a specific short-term rental, the Tax Administrator may request, and the short-term rental facilitator shall provide, the additional information authorized by Government Code section 50993(b), including:
(1) The assessor parcel number of the short-term rental; (2) The URL associated with the specific short-term rental listing; and (3) Information exclusively related to identifying an accessory dwelling unit, guest house, or single unit of a timeshare or multifamily housing project located at the reported address or assessor parcel number.
(d) Listing Requirements. A short-term rental facilitator shall include in each short-term rental listing any applicable City license or permit number associated with the short-term rental and the transient occupancy registration certificate number issued by the City under section

3.12.060.
(e) Administration. The Tax Administrator may prescribe reasonable forms, electronic formats, transmission methods, and instructions necessary to administer this section, consistent with the Act and other applicable law.
(f) Enforcement. A violation of this section is subject to the remedies and penalties provided by this chapter and any other remedy available to the City. Failure of a short-term rental facilitator to provide a report required by this section may also be subject to an administrative fine or penalty pursuant to Government Code sections 50993(e) and 53069.4, in amounts and under procedures established by resolution of the City Council or other applicable City law. Each failure to submit a required report and each listing maintained in violation of subsection (d) constitutes a separate violation.
(g) No Limitation on Other Authority. Nothing in this section limits the City's authority to administer or enforce Chapter 3.12, regulate short-term rentals or short-term rental facilitators, enter into a transient occupancy tax collection agreement, audit records as authorized by law, or exercise any other power available to the City.

SECTION 3. California Environmental Quality Act.

The City Council finds that adoption of this Ordinance is not a project subject to the California Environmental Quality Act ("CEQA") under State CEQA Guidelines section 15378 because it establishes an administrative reporting and tax-enforcement mechanism that does not have the potential to result in a direct or reasonably foreseeable indirect physical change in the environment.

Alternatively, adoption is exempt under State CEQA Guidelines section 15061(b)(3) because it can be seen with certainty that the Ordinance will not have a significant effect on the environment.

SECTION 4. Severability.

If any section, subsection, sentence, clause, phrase, or portion of this Ordinance is for any reason held invalid or unconstitutional by a court of competent jurisdiction, that decision shall not affect the validity of the remaining portions. The City Council declares that it would have adopted this Ordinance and each section, subsection, sentence, clause, phrase, or portion thereof irrespective of the fact that any one or more portions may be declared invalid or unconstitutional.

SECTION 5. Effective Date.

This Ordinance shall take effect thirty (30) days after its adoption.

SECTION 6. Publication.

The City Clerk shall cause this Ordinance, or a summary thereof, to be published or posted in the manner required by the City Charter and applicable law.

The foregoing Ordinance was introduced at a regular meeting of the City Council of the City of Marysville held on September 15, 2026, and was adopted at a regular meeting held on October 6, 2026, by the following vote:
