Marysville Police Department - DRAFT FOR LEGAL, RISK MANAGEMENT, AND LEXIPOL REVIEW Regional SWAT Team Participation - 1
Regional SWAT Team Participation
TBD.1 PURPOSE AND SCOPE
This policy establishes Marysville Police Department requirements for selection, training, equipment, authorization, supervision, and documentation of Department personnel participating in the Yuba-Sutter Regional SWAT Team (YSRST). It is intended to ensure that Marysville personnel participate only when appropriately trained, qualified, equipped, and authorized, consistent with the regional memorandum of understanding (MOU), Department policy, applicable law, and recognized safety standards.

Nothing in the MOU requires the Department to provide personnel for a deployment or training activity. The Chief of Police, the Lieutenant if designated by the Chief, or the on-duty sergeant may decline, limit, suspend, or terminate Marysville participation when staffing, resources, training, equipment, safety, legal, or operational concerns warrant.

TBD.2 POLICY
It is the policy of the Marysville Police Department to permit personnel to participate in YSRST activities only after the Department has independently verified and documented that all applicable selection, training, qualification, medical or fitness, equipment, and authorization requirements have been met. Regional assignment or approval does not substitute for Department approval.

No Department employee shall participate in YSRST training, planning, staging, deployment, or operations unless the City Council has approved the City's participation and the applicable MOU has been fully executed by all required parties, has taken effect, and has not expired, terminated, or been superseded. Department participation shall cease upon expiration, termination, or suspension of the MOU unless and until Councilauthorized participation under a valid MOU is restored.

TBD.3 DEFINITIONS
Deployment - Any activation, response, staging, planning, tactical assignment, or operational support performed as a member of or on behalf of the YSRST. Attendance at an approved basic course or Department-authorized selection assessment is not a deployment.

Ordinary patrol assignment - Duties performed under the Department patrol chain of command that are within the member's normal training and equipment, even when the member is supporting an incident at which the YSRST is present. An officer performing only an ordinary patrol assignment shall not be represented, tasked, or deployed as a YSRST member.

Personal protective equipment (PPE) - Department-issued or Department-approved protective equipment required for the member's assigned tactical function and reasonably anticipated hazards, including applicable ballistic, head, eye, hearing, respiratory, hand, medical, identification, and communications equipment.

Qualified - Current compliance with all Department and YSRST training, proficiency, firearms, fitness, medical, equipment, and assignment-specific requirements applicable to the member's role.

Lieutenant - If designated by the Chief of Police, the Department Lieutenant may perform the administrative, compliance, and review functions expressly assigned to the Lieutenant under this policy. Such designation does not transfer authority reserved to the City Council or Chief and does not authorize the Lieutenant to serve as a YSRST commander, leader, risk assessor, or tactical decision-maker.

Sergeant coordinating SWAT activity - The MPD sergeant designated in writing by the Chief of Police to coordinate the Department's SWAT activity and serve as MPD's administrative liaison for rosters, training, equipment, records, readiness, and policy compliance. This sergeant has no authority to command the YSRST, approve regional tactics, conduct the regional risk assessment, or direct personnel from another agency.

On-duty sergeant - The MPD sergeant responsible during the applicable shift for Department staffing, accountability, and release of MPD personnel for a particular activation. The on-duty sergeant does not Policy Marysville Police Department

become the YSRST Tactical Commander and shall not direct regional tactics, but retains authority over ordinary MPD patrol activity and the safety, accountability, conduct, and withdrawal of MPD personnel.

Entry team - Personnel assigned to make or directly support a tactical entry into a structure, vehicle, or other area for the purpose of locating, controlling, rescuing, or arresting a person, including breaching and immediate entry-team support functions.

Sniper/observer function - A designated precision-rifle or sniper/observer assignment. An armed sniper/observer is a member who carries, controls, deploys, or may be expected to employ a precision rifle as part of that assignment.

TBD.4 SELECTION AND APPOINTMENT
The Chief of Police retains final authority to approve, deny, condition, or revoke the appointment of any Department member to the YSRST. Before appointment, the Chief or the Lieutenant, if designated by the Chief, shall confirm that the member:
• Meets Department performance, conduct, fitness, firearms, and assignment prerequisites. • Has successfully completed all City- or Department-required Injury and Illness Prevention Program (IIPP) training and workplace violence prevention training, and the completion is current and documented. • Has completed the training required for the specific role to be performed, subject to the limitedparticipation provisions of this policy. • Has received and demonstrated proficiency with the PPE, weapons, communications equipment, and other equipment required for the proposed function.
• Has reviewed applicable Department policy, the current MOU, and the portions of the YSRST operating procedures necessary for the assignment.
• Has a completed readiness record maintained by the Department.

A member who has not completed a California POST-certified Basic SWAT Course, or an equivalent course specifically approved in writing by the Chief, may participate only in a documented training or support status approved by the Chief. The member shall be appropriately supervised, equipped, and restricted to duties within the member's existing training and qualifications. The member shall not be assigned to, enter with, or directly support an entry team and shall not serve in an armed sniper/observer function. The member may not carry, control, deploy, or be responsible for a precision rifle as part of a sniper/observer assignment until all required sniper and Basic SWAT training and written qualification requirements have been completed.

TBD.5 TRAINING AND CONTINUING QUALIFICATION
TBD.5.1 INITIAL AND ASSIGNMENT-SPECIFIC TRAINING
Before performing a tactical function, each member shall complete and document the training required for that function. Except for the limited activities expressly permitted by this policy, this includes the POST-certified Basic SWAT Course and any applicable sniper/observer, breaching, less-lethal, chemical-agent, armoredrescue, communications, or other specialty training designated by the Department or YSRST operating procedures.

Before any YSRST participation, each member shall also have successfully completed all mandatory IIPP training and workplace violence prevention training required by the City or Department. The sergeant designated by the Chief to coordinate SWAT activity shall verify and document completion and current status.

A lapse in either mandatory training places the member in a non-participating status until corrected.

A member may observe or assist during training only when the activity is part of an approved course or documented training plan, the member is appropriately supervised and equipped, and the training does not place the member in an operational role for which the member is not qualified.

TBD.5.2 ONGOING TRAINING AND PROFICIENCY
Members shall maintain all YSRST and Department attendance, firearms, physical fitness, scenario-based training, specialty, and other proficiency requirements. The sergeant designated by the Chief to coordinate SWAT activity shall obtain sufficient documentation to independently verify compliance rather than relying solely on a regional roster or verbal confirmation.

A member whose qualification has expired, lapsed, or cannot be verified shall be immediately placed in a non-deployable status. Remediation may occur only under a written plan approved by the Chief or the Lieutenant, if designated by the Chief, and shall not authorize operational deployment until the deficiency is corrected and documented.

TBD.6 PERSONAL PROTECTIVE EQUIPMENT AND READINESS
TBD.6.1 DEPARTMENT APPROVAL
The Department shall provide or approve all PPE necessary for its personnel's participation. YSRST issuance, recommendation, or acceptance of an item does not constitute Department approval. The Chief or the Lieutenant, if designated by the Chief, shall ensure that PPE:
• Complies with applicable federal and state law, occupational safety requirements, Department policy, recognized standards applicable to the equipment, and manufacturer instructions. • Is appropriate for the member's assignment and reasonably anticipated hazards. • Is compatible with other issued equipment and does not create an identified safety or functional conflict. • Is individually fitted where required and accompanied by documented training in inspection, donning, use, limitations, care, and storage.
• Has not exceeded its manufacturer-designated service life and is not damaged, altered, recalled, contaminated, or otherwise unserviceable.

TBD.6.2 INSPECTIONS
The sergeant designated by the Chief to coordinate SWAT activity shall ensure a documented comprehensive inspection of each member's assigned PPE at least annually and after any event that may affect its protective capability. Each member shall conduct and document a readiness check before training or deployment as required by Department or YSRST procedures.

Missing, damaged, expired, improperly fitted, unauthorized, or otherwise noncompliant PPE shall be removed from service. The member shall not participate in the affected training or operational function until the deficiency is corrected and verified.

TBD.7 DEPLOYMENT AUTHORIZATION AND ACCOUNTABILITY
TBD.7.1 AUTHORITY TO WITHHOLD OR WITHDRAW
A Department supervisor or member shall promptly report a safety, training, equipment, staffing, command, or policy concern. A Department supervisor may withhold or withdraw Marysville personnel from an assignment pending review. No member shall be disciplined for declining an assignment in good faith when the member reasonably believes the member lacks required training, qualification, PPE, or a reasonably safe means to perform the assignment, provided the concern is promptly communicated through the chain of command.

TBD.7.2 TACTICAL DIRECTION AND DEPARTMENT AUTHORITY
During an authorized deployment, members may operate under the tactical direction of the designated YSRST Tactical Commander. Department administrative authority, personnel accountability, conduct requirements, and the duty to comply with Department policy remain with the Marysville Police Department. A member shall immediately notify the YSRST Tactical Commander and a Department supervisor when an order appears inconsistent with law, Department policy, the member's approved role, training, qualification, or available PPE.

TBD.8 PROHIBITED COMMAND AND LEADERSHIP ROLES
Department personnel shall not serve as a YSRST Tactical Commander or in any other YSRST command.

This prohibition may not be waived by regional selection, seniority, rank, temporary need, or direction from another agency.

The sergeant designated by the Chief to coordinate SWAT activity, the Lieutenant when designated by the Chief, and the on-duty sergeant perform MPD administrative or supervisory functions only and do not constitute YSRST leadership positions. Nothing in this section limits an MPD supervisor's responsibility for Policy Marysville Police Department

the safety, accountability, conduct, or withdrawal of Marysville personnel, or the authority to direct ordinary MPD patrol activity outside the YSRST command structure.

TBD.9 OPERATING PROCEDURES AND AGREEMENT REVIEW
The Chief or the Lieutenant, if designated by the Chief, shall obtain and maintain the current, fully executed MOU and YSRST operating procedures applicable to Marysville personnel. Before initial participation and at least annually thereafter, the Department shall verify the MOU's execution and effective status and review those materials for consistency with Council authorization, Department policy, training and equipment requirements, command structure, reporting, and risk allocation.

Any material amendment to the MOU or operating procedures, or any change affecting Marysville personnel's duties, command authority, required equipment, training standards, or exposure to liability, shall be reviewed before implementation. When appropriate, the Chief shall refer the change to the City Manager, City Attorney, human resources, or the City's risk-management or insurance representative. No regional procedure or informal practice may expand Marysville participation beyond that authorized by the MOU, City approval, and this policy.

TBD.10 RECORDS
The sergeant designated by the Chief to coordinate SWAT activity shall maintain or ensure access to records sufficient to demonstrate each member's readiness and the Department's oversight. Records should include:
• Appointment and role authorization, including any limitations. • Council authorization and the fully executed MOU, including effective and expiration or termination information.
• Course completion, attendance, firearms, fitness, scenario, specialty, remediation, and proficiency records.
• Required IIPP and workplace violence prevention training completion and currency records. • PPE inventory, approval, fit, training, inspection, maintenance, repair, recall, replacement, and service-life information.

TBD.13 POLICY REVISION
Any amendment, exception, waiver, replacement, or other substantive change to this policy must be approved in writing by both the City Manager and the City Attorney before becoming effective. Neither regional operating procedures nor direction from a participating agency may modify this policy.
