AGENDA REPORT

CITY OF MAYWOOD
AGENDA ITEM NO. 6.

DATE: May 11, 2022
TO: HONORABLE MAYOR AND MEMBERS OF THE CITY COUNCIL
FROM: JENNIFER VASQUEZ, CITY MANAGER
BY: CLAUDIA ZAVALA, COMMUNITY SERVICES LIAISON
SUBJECT: CONSIDERATION OF APPROVING FINANCIAL ASSISTANCE FOR AQUATIC

PROGRAMMING AND SLEEP AWAY CAMP OFFERED AT THE YMCA FOR CITY

RESIDENTS
RECOMMENDATION:

Staff recommends that the City Council approve the financial assistance for aquatic programming and Sleep Away Camp provided by the YMCA for City residents.

BACKGROUND:

The YMCA has been successfully adjusting and serving the community during the COVID-19 pandemic. Once the mandate was lifted, they began to gradually open their facilities to programs and activities. During this time, the City partnered with the YMCA to continue to bring community events to the residents of Maywood. In 2021, the YMCA was awarded the Community Benefit Fund to provide programs such as Grab-n-Go, a pumpkin giveaway at our Trick-or-Trunk Event, Turkey Giveaway and Toy Giveaway.

DISCUSSION:

Staff recommends that the Council considers partnering with the YMCA to assist our community in getting back to a healthy lifestyle.

Aquatic Programming
The City can provide its residents with financial assistance to participate in swim lessons, summer family swim, and summer water aerobics for seniors at the Aquatic Center. The following is a breakdown of the total costs per program.

Swim Lessons - the Y in previous years averages about thirty-five (35) Maywood residents per session. There is a total of three (3) sessions throughout the summer.  Five (5) Saturdays
 Each class is thirty (30) minutes long.
 5 to 1 ratio (student to lifeguard).
 Member price of forty-five dollars ($45.00) per participant (non-member rate is ninety dollars ($90.00) per participant.
 The cost for one-hundred (100) Maywood residents at forty-five ($45.00) per participant = $4,500.00

Page 157 of 205 ends

Summer Family Swim -
 The pool is scheduled to open in June 2022.
 Monday – Friday 12:00 – 5:00 PM / Saturdays 12:30 – 3:00 PM.  Children ages eleven (11) years old and under.
 Teens twelve thru eighteen (12 -18) years of age are encouraged to sign up for the YMCA’s Free Summer Teen Membership program to be able to utilize the pool and other services.  The current non-member rate to enter the pool is five dollars ($5.00) per person.  Maywood residents' discounted rate will be three dollars ($3.00) per person.  The cost for five-hundred (500) Maywood residents at three ($3.00) per participant = $1,500.00  The YMCA will bill the City monthly.

Summer Water Aerobics
 The class is geared for seniors ages sixty (60) years or older.  The average Maywood residents per class is twenty (20).  Two days a week (Monday and Wednesday) at 11:00 AM
 June – August 2022
 Instructor rate: Twenty ($20.00) per hour at 1.5 hours per class = $30 per class  Aquatics Clerk rate: Sixteen ($16.00) per hour at 1.5 hours per class = $24 per class  Lifeguard rate: Eighteen ($18.00) per hour at 1.5 hours per class = $27 per class  Payroll Tax & Benefits: $304.00
 Cost per class is eighty-one ($81.00) for twenty-six (26) classes = $2106.00 + $304.00  Total cost for three (3) months = $2410.00
Sleep Away Camp
The YMCA offers a “Sleep Away Camp” program during the summer for children in 3rd – 8th grade. Staff recommends that the Council considers financial assistance for children who would like to participate in the program.

Sleep Away Camp is a place where kids can escape and get out of the city to explore nature, make life-long friends and, more importantly, it’s a place where kids can be themselves. Campers will experience fun-filled days in their cabin groups enjoying activities such as arts & crafts, swimming, mountain biking, hiking, archery, sports, and so much more. Camping, like many Y programs, is about learning skills, developing character, and making friends.

The following is a breakdown of the program:
 Date: July 10 – 16, 2022 (1 week)
 Location: Camp Marcil (Big Bear)
 Ages: Children who are in 3rd – 8th grades
 Cost: $660.00 per child
 Maywood residents' reduced rate is $400.00
 Cost for 25 children: $400 x 25 = $10,000
 The YMCA has averaged between twenty to twenty-five (20-25) Maywood residents in previous years.

The City has been allocated $6M from the American Rescue Plan Act (ARPA). These funds can be used for the proposed programming as they will promote public health and recreation.

AGENDA REPORT

CITY OF MAYWOOD
AGENDA ITEM NO. 7.

DATE: May 11, 2022
TO: HONORABLE MAYOR AND MEMBERS OF THE CITY COUNCIL
FROM: JENNIFER VASQUEZ, CITY MANAGER
BY: CLAUDIA ZAVALA, COMMUNITY SERVICES LIAISON
SUBJECT: DISCUSSION AND DIRECTION REGARDING OPTIONS FOR A CHRISTMAS TREE AND OTHER CHRISTMAS DÉCOR FOR THE CITY.

RECOMMENDATION:

Staff recommends that the City Council discuss the information received and provide direction regarding options for Christmas décor, including the City Christmas tree, for the City’s Holiday Season.

BACKGROUND:

The City previously had banner décor for the light poles, donated living trees as well as artificial Christmas trees.

DISCUSSION:

City Staff has researched multiple tree and pole mounts and have identified vendors for the Council’s consideration for the City Hall tree ranging from $4,200 - $8,700 and all light poles ranging from $300 - $710 on Slauson Avenue and Atlantic Boulevard. In addition, a quote was provided for 195 light poles power converters.

For this report, staff has prepared three commercial tree options, multiple pole mount options and power converters which are outlined in our PowerPoint presentation. Staff seeks City Council direction.

LEGAL REVIEW:

The City Attorney has reviewed this report.

FISCAL IMPACT:

Pending the option selected by the City Council, the funding source will be identified and processed.

BACKGROUND:

The Planning Commission is a five-member body that reviews and acts on matters related to planning, land use development and community development in general. The Planning Commission has an essential role in the planning process by acting as an advisory body to the City Council on all planning and development issues as well as functions as the decision-making body for a number of planning proposals.

Duties of the Planning Commission include but are not limited to holding public hearings and meetings; reviewing the General Plan; reviewing and recommending zoning code regulations; reviewing subdivision maps; and taking action on variances, conditional use permits, special use permits.

The term of the existing Commissioner, whose Seat No. 3 expired on February 6, 2022 and the term of existing Commissioner, whoseSeat No. 4 is set to expire on May 15, 2022. Accordingly, in April 2022, the City began to accept applications from persons who desire to serve on the Maywood Planning Commission for the next terms. The application period closed on April 29, 2022 with three (3) submittals.

AGENDA REPORT

CITY OF MAYWOOD
AGENDA ITEM NO. 9.

DATE: May 11, 2022
TO: HONORABLE MAYOR AND MEMBERS OF THE CITY COUNCIL
FROM: JENNIFER VASQUEZ, CITY MANAGER
BY: STEVE FOWLER, DIRECTOR OF BUILDING AND PLANNING
SUBJECT: CONSIDERATION OF THE RENEWAL OF A COMMERCIAL CANNABIS RETAIL

LICENSE FOR MAYWOOD GREEN SOLUTION, LLC DBA HAVEN
RECOMMENDATION:

Staff recommends that the City Council approve the application for the renewal of a commercial cannabis retail license for Maywood Green Solution, LLC (“Haven”), located at 3951 Slauson Avenue for a one-year term expiring on May 12, 2023, and authorize the Director of Building and Planning to notify the applicant in writing of the City Council's decision.

BACKGROUND:

On August 28, 2019, the Maywood City Council adopted ordinance 19-03 that changed the status of commercial cannabis uses and businesses in the City. Most significantly, the ordinance banned the issuance of any new commercial cannabis licenses. Applications that were in the process had to have received their license and conditional use permit prior to the effective date of the Ordinance. The adoption of this Ordinance also made any existing commercial cannabis business a non-conforming use subject to the provisions of Section 15.2 of Appendix C of the Zoning Code.

Ordinance 19-03 ("Ordinance") created a process for the renewal of existing licenses. The ordinance details the application renewal process by establishing requirements to determine if an application can be renewed or denied. These requirements must be met to allow the City Council to determine whether a license should be renewed, or if there are grounds for denial.

This process requires that the City Council determines if the cannabis entities operate lawfully. The information necessary to make this determination is provided by Hinderliter, de Llamas & Associates (“HdL”). Every year the business is inspected quarterly to determine if the business is operating in compliance with State law and the City's Ordinance. The inspection also ensures the business operates in a safe manner to protect both employees and customers at each business. Staff accompanies HdL on these inspections to verify compliance with the approved Conditions of Approval for the Conditional Use Permit. These inspections with their suggested remedial actions help to ensure proper operation prior to license renewal.

As part of this renewal process HdL conducts criminal background checks on all owners, managers, employees, contractors and volunteers, employed in Maywood’s commercial cannabis industry. All who are found to have disqualifying factors will not be permitted to work, own, manage or volunteer for a cannabis business in Maywood. HdL will also conduct a financial audit annually, which includes the verification of the tracking and tracing of the product and of matching the product with its respective transaction. This measure

Page 194 of 205 ends

will detect illegal diversion or the sale of unlicensed (illegal) product, which is central to the verification of the lawful and complete remittance of the local cannabis tax.

DISCUSSION:

Haven’s Conditional Use Permit was approved on June 19, 2018. Haven is a cannabis retailer or dispensary that obtained their business license in November 2018. All audits and sales tax payments have been made.

Haven currently operates as a brick and mortar dispensary with a single component; retail. They are licensed by the State of California Bureau of Cannabis Control (license #C10-0000082-LIC) as a Type 10 Retailer, and their license is currently valid through May 22, 2023.

Renewals per the ordinance are to be renewed annually. The renewal process began last year and is continued throughout the year with quarterly inspections and an annual audit. As a result of the adherence to the regulations, the evaluation of Haven's commercial cannabis license renewal application was completed.

Background Check:

Applications for two (2) owners and twelve (12) employees were submitted and all background checks were subsequently cleared. Haven is in full compliance with this requirement.

Facility Inspection:

HdL has conducted several on-site inspections since Haven opened, including a virtual inspection during the Covid-19 pandemic. The latest inspection was conducted on March 1, 2022 with City staff in attendance. City staff and a Compliance Inspector from HdL conducted a facility inspection. The inspection revealed no noncompliant issues. As a result, the facility is considered to be in full compliance.

Financial Audit:

Haven is current on all audits and sales tax payments.

In conclusion, based on the inspections, investigations, and audits described in this report, staff has determined that the business is in compliance and that none of the conditions in Section 5-45-05(b) exist, and therefore, staff recommends that the City Council approve the renewal of the license.

LEGAL REVIEW:

The City Attorney has reviewed this report.

FISCAL IMPACT:

Haven's Maywood dispensary pays the 10% Cannabis Sales Tax (Revenue Account 4238) on a quarterly basis to the City. Haven's Maywood dispensary also generates Sales Tax, which is currently 10.25 percent and is divided as follows: a) 6.00% State Tax; b) 0.25% County Tax; c) 0.75% City Tax; and d) 3.25% Special Tax.

Both tax sources (Cannabis Sales tax and Regular Sales tax) provide revenues that help support City services.

All quarterly Cannabis Sales Tax payments of Haven's Maywood dispensary are current.

AGENDA REPORT

CITY OF MAYWOOD
AGENDA ITEM NO. 11.

DATE: May 11, 2022
TO: HONORABLE MAYOR AND MEMBERS OF THE CITY COUNCIL
FROM: JENNIFER VASQUEZ, CITY MANAGER
BY: STEVE FOWLER, DIRECTOR OF BUILDING AND PLANNING
SUBJECT: TO CONSIDER THE RENEWAL OF A COMMERCIAL CANNABIS MANUFACTURER LICENSE FOR I.O.N. DISTRIBUTION, LLC
RECOMMENDATION:

Staff recommends that the City Council approve the application for the renewal of a commercial cannabis manufacturer license for I.O.N. Distribution, LLC located at 3728 Fruitland Avenue, for a one-year term expiring on May 12, 2023, and authorize the Director of Building and Planning to notify the applicant in writing of the City Council's decision.

This measure

will detect illegal diversion or the sale of unlicensed (illegal) product, which is central to the verification of the lawful and complete remittance of the local cannabis tax.

DISCUSSION:

I.O.N.’s Conditional Use Permit was approved on July 3, 2018. ION is a cannabis manufacturer and distributor that obtained their business license in January 2019. All audits and sales tax payments have been made.

I.O.N. currently operates as a manufacturer and distributor. They are licensed by the State of California Bureau of Cannabis Control (license #CDPH-10003336) as a Type 6 Manufacturer (Non-volatile) and Type 11 Distributor (license #C11-0001078). Their Type 6 license is valid through May 31, 2022 and their Type 11 license is valid through September 17, 2022.

Renewals per the ordinance are to be renewed annually. We started the renewal process last year and continued with the quarterly inspections and annual audits. As a result of the adherence to the regulations, the evaluation of I.O.N's commercial cannabis license renewal application was completed.

Background Check:

Applications for one (1) owner and one (1) employee were submitted and all background checks were subsequently cleared. I.O.N. is in full compliance with this requirement.

Facility Inspection:

HdL has conducted several on-site inspections since I.O.N. opened, including a virtual inspection during the Covid-19 pandemic. The latest inspection was conducted on March 1, 2022 with City staff in attendance. City staff and a Compliance Inspector from HdL conducted a facility inspection. The inspection revealed no noncompliance items. As a result, the facility is considered to be in full compliance.

Financial Audit:

I.O.N. is current on all audits and sales tax payments.

In conclusion, based on the inspections, investigations and audits described in this report, Staff has determined that the business is in compliance and that none of the conditions in Section 5-45.05(b) exist and therefore, staff recommends that the City Council approve the renewal of the license.

LEGAL REVIEW:

The City Attorney has reviewed this report.

FISCAL IMPACT:

I.O.N. Distribution LLC's dispensary pays the 10% Cannabis Sales Tax (Revenue Account 4238) on a quarterly basis to the City. I.O.N. Distribution LLC’s Maywood dispensary also generates Sales Tax, which is currently 10.25 percent and is divided as follows: a) 6.00% State Tax; b) 0.25% County Tax; c) 0.75% City Tax; and d) 3.25% Special Tax. Both tax sources (Cannabis Sales tax and Regular Sales tax) provide revenues that help support City services.

All quarterly Cannabis Sales Tax payments of I.O.N. distribution LLC's Maywood dispensary are current.
