SUBJECT: ACCEPTANCE OF WORK, FILING NOTICE OF COMPLETION, AND RELEASE RETENTION FUNDS TO HARDY & HARPER, INC. FOR THE PAVEMENT REHABILITATION PROGRAM FY 2022-2023 PROJECT
RECOMMENDATION:
Staff recommends that the City Council:
1. Accept project completion for the Pavement Rehabilitation Program FY 2022-2023 Project as performed by Hardy & Harper, Inc., for a total amount of $3,430,181.22; and
2. Authorize the City Manager to file a project Notice of Completion with the County of Los Angeles Registrar-Recorder; and
3. Authorize the City Manager to release a retention payment of $171,509.06 to Hardy & Harper, Inc. within 35 days following recordation of the Notice of Completion.
BACKGROUND:
The project included the asphalt concrete resurfacing (cold mill and overlay), crack-filling, full-depth AC patching, concrete curb ramp, curb and gutter, and sidewalk replacement at various locations, striping and pavement markings and related work.
On June 1, 2023, staff advertised Notice Inviting Bids (NIB) on the local newspaper in conformance with City of Maywood Municipal Code Section 3-7.04. Bids were due on June 20, 2023 at 2:00 PM.
On June 28, 2023, the City Council awarded a public works contract totaling $3,539,000.00 to Hardy & Harper, Inc for the Pavement Rehabilitation Program FY 2022-2023. The project construction budget also includes contingency budget of $353,900.00 (10% of Contract) for any unforeseen conditions as necessary. The total established construction budget was $3,892,900.00.
Construction activities were completed by the Contractor and confirmed by the City Engineer. The work was completed within the approved budget.
DISCUSSION:
In August of 2023, Hardy & Harper, Inc. began construction of the project per plans, specifications and bid documents per contract with the City. The work included asphalt roadway resurfacing (asphalt cold mill and overlay), asphalt pothole repairs, reconstruction of concrete curb ramps, sidewalks, curb and gutter at various locations and restoration of pavement markings and striping. All required improvements were constructed in
conformance with the approved plans and specifications. The work was performed to the City Engineer’s satisfaction. Construction costs totaled $3,430,181.22, which is within the approved construction budget.
The project has been completed within the contract schedule and budget. Therefore, staff recommends that City Council approve issuance of a Notice of Completion.
LEGAL REVIEW:
The City Attorney has reviewed this report.
FISCAL IMPACT:
There is no fiscal impact associated with this action. The work was completed within the previously approved budget and included in this year's capital improvement plan.
