AGENDA REPORT

CITY OF MAYWOOD
AGENDA ITEM NO. 1.

DATE: November 18, 2025
TO: HONORABLE MAYOR AND MEMBERS OF THE CITY COUNCIL
FROM: JENNIFER VASQUEZ, CITY MANAGER
BY: DAISY GUERRERO, DEPUTY DIRECTORY OF BUILDING AND PLANNING

RIMO HANSON, FINANCE DIRECTOR
SUBJECT: OVERVIEW OF STATE AND LOCAL CANNABIS SALES TAXED AND DISCUSSION

AND DIRECTION REGARDING SAME
RECOMMENDATION:

Staff recommends that the City Council review and provide direction to staff regarding the City's cannabis sales tax rate adjustment.

BACKGROUND:

The City of Maywood adopted its Cannabis Regulatory Program in August 2018 (Ordinance No. 18-12). In November 2018, the City placed the Commercial Cannabis Activity Tax (Measure CT) on the ballot, which was approved by voters with more than 70% support. Measure CT established an initial tax rate of 6% of gross receipts for all commercial cannabis activities and authorized the City Council to adjust the rate by resolution.

The measure also allowed the City to establish different rates for various types of cannabis activities, provided that no rate exceeded the maximum of 10% of gross receipts.

In January 2019, the City Council adopted Resolution No. 6010, setting the tax rate for all retail cannabis activities, including both storefront and non-storefront delivery services and microbusinesses—at the maximum rate of 10%. Currently, the city has five active commercial cannabis businesses operating under this regulatory framework.

Since its implementation, the cannabis sales tax has become the City’s second-largest source of tax revenue, providing essential funding to support public safety services and general city operations. To date, the city has collected the following cannabis sales tax revenues as shown in table 1.

DISCUSSION:

The interest in bringing this discussion before the Council stems from concerns raised by industry representatives regarding the City of Maywood’s cannabis sales tax rate as it is higher than those of neighboring cities. Tonight’s presentation is intended to provide a clear overview of how state and local taxes affect the City’s cannabis business owners, along with a legislative update and comparative analysis of cannabis tax rates.

LEGAL REVIEW:

The City Attorney has reviewed this report.

FISCAL IMPACT:

There is no fiscal impact on this discussion.
