MEMORANDUM
CITY OF MCFARLAND
TO: Honorable Mayor and Council Members
FROM: Kenny Williams, City Manager
Larry A Ronk III, Interim Community Development Director DATE: March 24, 2022
SUBJECT: Report, Discuss, and Possible Approval of Resolution 2022-0015 for Creation of Euthanasia Committee under the Quality of Life Committees.
SUMMARY:
Staff has discussed that there should be a committee who reviews all dog scenarios for each dog that stays at the shelter for a period of time. When all efforts for adoption and rescue are exhausted, many dogs remain at the shelter for months which creates an issue for the officers who receive calls and complaints about strays within the city. As of now, our shelter has been full and many of the dogs have been there months. There has been a struggle through California to get dogs rescued and adopted.
The staff would like the creation of a committee for the Animal Control Euthanasia protocol to allow for a better process of animals at the shelter. The ultimate goal is to save more than 90% of the dogs in our city. This committee would meet and discuss any possible action taken on any dog that has depleted all its options for rescue and adoption. Within the shelter now, the protocol is up to the discretion of the chief of police, and we find that it would be a better option to have a committee created of two (2) councilmembers and utilize a public meeting with public comment before any decision. This will allow for it to be transparent with the residents and locals that a committee decided rather than a certain person. This creates the ability to hear more than one person’s thoughts and allows all residents to have a chance for public comment. The committee will have its own agenda and be able to notify all residents when the meeting will be and where it is held. This will provide transparency to all.
RECOMMENDATION:
Staff recommends the City Council to approve Resolution No. 2022-0015 for the creation of a Euthanasia Committee that will fall under the Quality-of-Life Committees.

SUBJECT: Report, Discuss, and Possible Approval of Amendment to Agreement with De Lapide & Associates, Inc to conduct a Housing Element Update.
SUMMARY:
The State of California requires cities to update the Housing Element of the General Plan every 8 years. The purpose of this update is to ensure the Housing Element is consistent with all State laws related to housing, that there is adequate land available to satisfy the city’s Regional Housing Needs Allocation and that there are policies and programs that implement the goals of the Housing Element.
The city has a housing element that covers from 2015-2023. This process of updating taking about 26 weeks. Every housing element is required to be updated every five (5) years. This update will make the city compliant with state requirements. Through our general plan 2040 update, that gives us a foundation on where to start. The consultant that drafted our general plan update has all the qualification to conduct this separate element and has the general information needed for the update.
The amendment to the agreement will allow for the consultant to conduct public engagement, research, plan, and draft a housing element update for approval for the city. The city has planning grants (SALC) that will pay for the study in full.
RECOMMENDATION:
Staff recommends the City Council to Approve second amendment to agreement with De Lapide & Associates, Inc to conduct the housing element update.

CITY OF MCFARLAND
MEMORANDUM
TO: Honorable Mayor and Council Members
FROM: Kenny Williams, City Manager
DATE: March 24, 2022
SUBJECT
Resolution Submitting to City Voters at Next Regular Election To Be Held on November 8, 2022, a Ballot Measure to Adopt an Ordinance Approving a One Cent (1.00%) Retail Transactions and Use General Tax to Provide Funding for Essential City Services and Projects in the City of McFarland such as Police Patrols, Quick 9-1-1 Response, Repairing Potholes and Infrastructure, Maintaining Streets, Revitalizing Downtown, Improving Community Facilities, Parks, Senior Services, and other General City Services.
RECOMMENDATION
1. Adopt resolution submitting to city voters at the next regular municipal election to be held November 8, 2022, a ballot measure to adopt an ordinance approving transactions and use general tax to be administered by the California Department of Tax and Fee Administration and requesting that the Board of Supervisors consolidate that election with the statewide election and regular municipal election held on that same date by a 2/3 vote of all members of the City Council (4 votes);
2. Designate two members of the Council or Community or Staff to author the ballot argument in favor of the measure, and insert names into adopted resolution
SUMMARY
Section 2(b) of Article XIIIC of the California Constitution requires a tax for general municipal purposes to be submitted to the voters for approval and consolidated with the regularly scheduled general municipal election for members of the City Council, unless an emergency is declared by a unanimous vote of the City Council. The next general municipal election is November 8, 2022.
Ordinance
Under the State Revenue and Taxation Code if the Council wishes to increase the City’s sales tax, the City Council must propose an ordinance to City voters establishing the sales tax by a 2/3 vote of the Council. The proposed ordinance is attached to the Council resolution calling for the election. Thereafter, the voters would vote on the ordinance via the ballot measure. Approval requires a 50% plus one vote of the votes cast. The ordinance is intended as a general sales tax, includes accountability language (annual audit, report, and a Citizens Oversight Committee), and includes text required by the California Department of Tax and Fee Administration.
If the local revenue sales tax measure passes and the ordinance is adopted, the City of McFarland will enter into two contracts with the State: (1) to set up the tax and (2) for ongoing administration. The tax will not be operative until the first day of the first calendar quarter commencing more than 110 days after the adoption of this ordinance at the election. This means that a tax passed in November 2022 would not be imposed and collected until February 2023.
The ordinance would also become part of the McFarland Municipal Code.
Ballot Measure Resolution
The Elections Code has specific requirements for placing a ballot measure on the ballot. The attached resolution includes text required by the Elections Code as to the placement on the ballot, consolidation of Election, arguments, the ballot question, synopsis of the measure, and requirements of the Elections Office, City Clerk, and City Attorney.
The attached resolution proposes to place on the November ballot an ordinance that would implement a local transaction and use tax in the amount of one cent (1.00%). This will be a general tax. Passage requires a 50% plus one vote of the votes cast, and the City Council must determine by a two-thirds vote to place it on the ballot. Voters will be voting on adoption of the entire Ordinance, but the ballot question to be placed before the voters is limited by statute to 75 words or less, and reads as follows:
MEASURE __
To provide funding for essential city services and projects in the City of McFarland such as: police patrols, crime prevention, and quick 9-1-1 emergency response; repairing potholes and infrastructure, maintaining streets, revitalizing the downtown area, and improving community facilities, parks, senior services, and other general city services, shall the measure establishing a one percent sales tax providing approximately $__________ annually until ended by voters, requiring citizen oversight, independent audits, and all funds controlled locally, be adopted?
The entire Ordinance will be accessible to the public via the County Elections Office, the City’s website, and the McFarland City Clerk’s Office.
Council Preparation of Argument in Support of Measure
Under Elections Code section 9282, a ballot argument on this City Council-sponsored measure may be authored by the City Council, or any members of the Council authorized by that body, or any individual voter who is eligible to vote on the measure, or bona fide association of citizens, or any combination of voters and associations. The City Council is asked to designate two persons to author the ballot argument in support of the measure. The two names will be included in the resolution. The argument may not exceed three hundred (300) words. Those two members may solicit up to three additional signatories.
Impartial Analysis
As required by the Elections Code, the City Attorney will prepare an impartial analysis of the measure, not to exceed five hundred (500) words in length, showing the effect of the measure on the existing law and the operation of the measure, and transmit the impartial analysis to the Elections Division by the deadline set by the Elections Office.
Roles and Limitations During Ballot Measure Campaign Period The City can provide educational materials to the public, informing them about the Measure.
But the City cannot expend any time, money, staff resources, or effort advocating a position supporting passage of the ballot measure. Councilmembers and staff can work on the campaign on their own time and at their own expense, provided it is made clear that they are doing so on their own time and not with City resources. The City Attorney will provide further guidance on this if the Resolution is adopted.
FISCAL IMPACT
Cost of placing initiative on the ballot: $4,000-$6,000.
Potential revenue of $_________ annually.

The Annual Review Report shall be filed in the City Clerk’s Office not later than January 1 of each fiscal year in which the tax is collected.

SUBJECT: Committee Consolidation
RECOMMENDATION:
Staff recommends the City Council approve the consolidation of the city committees and reassign council members to each committee.
BACKGROUND:
Over the course of many years the city has developed numerous committees which now consists of nineteen. The primary function of a committee is to contribute to the efficient operation of an organization. In most cases, a committee is concerned with the communication of information and with assisting the leadership in the decision-making process by providing needed information.
Each of these committees are public and designed to help conduct the people’s business and therefore the actions of the committees and deliberations must be conducted openly as set forth in the Brown Act. Managing a committee can be time consuming as they require the posting of the meeting location and an agenda detailing the items to be discussed. With nineteen committees to manage this would be cumbersome to staff and therefore we are recommending we consolidate the committees into three separate committees broadening the scope of the committee to allow for more inclusion into each committee.
This consolidation will allow for a decrease in the number of committees and provide a more efficient method of operation. As new topics need to be addressed through a committee council can then examine what area the topic fits and place those into existing committees. In the event the topic does not fit into the existing committee a new committee can be formed to address the issue.
Below is a list of the proposed committees.
Quality of life Committee:
• Downtown Design
• Veterans Memorial
• Festival Committee
• Euthanasia committee

TO: HONORABLE MAYOR AND COUNCIL MEMBERS
FROM: Peter Cosentini, Assistant City Manager
DATE: March 24, 2022
SUBJECT: Hiring Ms. Lisa Tucker
Recommendation:
It is recommended that the City Council approve the attached letter of engagement to hire Ms.
Lisa Tucker of A1 Multi Business Center Inc. to assist with 2020-2021 audit in doing bank reconciliations and other accounting work in support of the audit.
Fiscal Impact:
The fiscal impact is anticipated to be between $3,500 and $7,000. The money is already budgeted in the current budget in the Non-Departmental section under line item 5220 contract services.
Discussion:
As the Council is aware, we are playing catch up on the historic audits that have not been done.
Council has already engaged our auditors to do the audit for the 2020-2021 fiscal year. This is the next audit to do as we catch up to the current fiscal year.
During the last audit performed, for the 2019-2020 fiscal year, our auditors used Lisa Tucker of A1 Multi Business Center Inc. to assist with bank reconciliations and other accounting services.
We found that this team was very effective, so we wish to assemble the same team for this next audit for 2020-2021. This is why we are recommending the hiring of Ms. Lisa Tucker of A1 Multi Business Inc.

MEMORANDUM
CITY OF MCFARLAND
TO: Honorable Mayor and Council Members
FROM: Kenny Williams, City Manager
DATE: March 24, 2022
SUBJECT: DISCUSSION AND POSSIBLE ADOPTION OF RESOLUTION TO ALLOW CITY COUNCIL MEETINGS TO BE HELD REMOTELY, CONSISTENT WITH ASSEMBLY BILL 361
RECOMMENDATION
BACKGROUND:
Assembly Bill 361 was recently signed by the Governor of the State of California and went into effect immediately upon signature by the Governor. The bill amends the Brown Act to allow local legislative bodies to continue having purely virtual meetings using teleconferencing and virtual meeting technology as long as there is a gubernatorial “proclaimed state of emergency,” with (1) state or local officials imposing or recommending measures that promote social distancing or (2) the legislative body finding that meeting in person would present an imminent safety risk to attendees.
The key differences between Executive Order N-08-21, which expired on September 30, 2021, and AB 361 is that AB 361 imposes particular requirements with respect to public comment and viewing of deliberations. Additionally, the City must make findings and adopt via resolution by majority vote that the state of emergency still exists and continues to directly impact the ability of the members to meet safely in person every 30 days.
The City Council requested the ability to hold City Council meetings and other Meetings regulated by the Brown Act remotely due to Covid-19. Pursuant to AB 361, a resolution to allow such remote meetings must be adopted prior to such remote meetings, or at the next meeting following a remote meeting.
It is important to note that neither AB 361 nor the proposed Resolution would require meetings to be held in an all-virtual format. Some cities that continue to adopt resolutions pursuant to AB 361 do so to allow a “hybrid” format where council members and staff participate either in person or remotely depending on their individual circumstances. Other cities adopt AB 361 resolutions to allow the public to continue to participate remotely because of space considerations in their council chambers. Failing to adopt the proposed Resolution would require meetings to be held in-person under traditional Brown Act parameters; adopting the resolution would give the City flexibility as it moves forward with meetings.
STAFF RECOMMENDATION:
It is recommended that the City Council (1) Discuss the use of teleconferencing or videoconferencing for Brown Act-covered public meetings of the City Council, City commissions, and City Committees; and (2) Adopt the attached Resolution to authorize the use of such technology for meetings for a period of 30 days.
FINANCIAL IMPACT:
None.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
MCFARLAND TO ALLOW CITY COUNCIL MEETINGS TO BE
HELD REMOTELY, CONSISTENT WITH ASSEMBLY BILL 361
RECOMMENDATION
WHEREAS, the City of McFarland is committed to preserving and nurturing public access and participation in meetings of the City Council; and WHEREAS, all meetings of the City of McFarland’s legislative bodies are open and public, as required by the Ralph M. Brown Act (Cal. Gov. Code 54950 – 54963), so that any member of the public may attend, participate, and watch the City’s legislative bodies conduct their business; and
WHEREAS, the Brown Act, Government Code section 54953(e), makes provisions for remote teleconferencing participation in meetings by members of a legislative body, without compliance with the requirements of Government Code section 54953(b)(3), subject to the existence of certain conditions; and
WHEREAS, a required condition is that a state of emergency is proclaimed and state or local officials have imposed or recommended measures to promote social distancing; and WHEREAS, in response to the novel coronavirus (“COVID-19”) pandemic, Governor Newsom adopted a series of Executive Orders allowing the legislative bodies of local governments to meet remotely via teleconference so long as other provisions of the Ralph M.
Brown Act (“Brown Act”) were followed; and
WHEREAS, on March 4, 2020, Governor Newsom declared a statewide emergency arising from COVID-19 pursuant to Government Code section 8625; and WHEREAS, on Sept. 16, 2021, Governor Newsom signed AB 361, which immediately amended the Brown Act allowing governing boards to continue holding virtual meetings outside the teleconferencing requirements of Government Code section 54953(b), if the board makes a finding that there is a proclaimed State of Emergency, and either (1) state or local officials have imposed or recommended social distancing measures, or (2) meeting in person would present imminent risks to the health or safety of attendees due to the emergency; and NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of McFarland that:
1. The recitals set forth above are true and correct and fully incorporated into this Resolution by reference.
2. The City Council of the City of McFarland recognizes that a State of Emergency in the State of California continues to exist due to the COVID-19 pandemic.
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MCFARLAND TO ALLOW CITY COUNCIL MEETINGS TO BE HELD REMOTELY, CONSISTENT WITH ASSEMBLY BILL 361 RECOMMENDATION
3. The City Council of the City of McFarland finds that holding in-person meetings would present imminent risks to the health or safety of attendees due to the cause of the State of Emergency and that the cause of the State of Emergency directly impacts the ability of the City Council and other Board and Commission members to meet safely in person.
4. The City Council of the City of McFarland authorizes the use of teleconferencing for all meetings in accordance with Government Code section 54953(e) and all other applicable provisions of the Brown Act, for a period of thirty (30) days from the adoption of this resolution, or such a time that the City Council adopts a subsequent resolution in accordance with Government Code section 54953(e)(3).
5. The use of teleconferencing shall be a “hybrid” format where council members and staff participate either in person or remotely depending on their individual circumstances as it relates to Covid-19. Should all Council Members, Commission Members, or Committee Members require teleconference for a specific meeting, notice to the public of the meeting shall state that the meeting will be held virtually.
