MEMORANDUM

CITY OF MCFARLAND
TO: Honorable Mayor and Council Members
FROM: Nathan Hodges, Interim City Attorney
Kenny Williams, City Manager
DATE: July 14, 2022
SUBJECT: DISCUSSION AND POSSIBLE ADOPTION OF RESOLUTION TO ALLOW CITY COUNCIL MEETINGS TO BE HELD REMOTELY, CONSISTENT WITH ASSEMBLY BILL 361

RECOMMENDATION
BACKGROUND:

Assembly Bill 361 was recently signed by the Governor of the State of California and went into effect immediately upon signature by the Governor. The bill amends the Brown Act to allow local legislative bodies to continue having purely virtual meetings using teleconferencing and virtual meeting technology as long as there is a gubernatorial “proclaimed state of emergency,” with (1) state or local officials imposing or recommending measures that promote social distancing or (2) the legislative body finding that meeting in person would present an imminent safety risk to attendees.

The key differences between Executive Order N-08-21, which expired on September 30, 2021, and AB 361 is that AB 361 imposes particular requirements with respect to public comment and viewing of deliberations. Additionally, the City must make findings and adopt via resolution by majority vote that the state of emergency still exists and continues to directly impact the ability of the members to meet safely in person every 30 days.

The City Council requested the ability to hold City Council meetings and other Meetings regulated by the Brown Act remotely due to Covid-19. Pursuant to AB 361, a resolution to allow such remote meetings must be adopted prior to such remote meetings, or at the next meeting following a remote meeting.

It is important to note that neither AB 361 nor the proposed Resolution would require meetings to be held in an all-virtual format. Some cities that continue to adopt resolutions pursuant to AB 361 do so to allow a “hybrid” format where council members and staff participate either in person or remotely depending on their individual circumstances. Other cities adopt AB 361 resolutions to allow the public to continue to participate remotely because of space considerations in their council chambers. Failing to adopt the proposed Resolution would require meetings to be held in-person under traditional Brown Act parameters; adopting the resolution would give the City flexibility as it moves forward with meetings.

STAFF RECOMMENDATION:

It is recommended that the City Council (1) Discuss the use of teleconferencing or videoconferencing for Brown Act-covered public meetings of the City Council, City commissions, and City Committees; and (2) Adopt the attached Resolution to authorize the use of such technology for meetings for a period of 30 days.

FINANCIAL IMPACT:

None.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MCFARLAND TO ALLOW CITY COUNCIL MEETINGS TO BE HELD REMOTELY, CONSISTENT WITH ASSEMBLY BILL 361 RECOMMENDATION RESOLUTION NO. 2022-0066

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF

MCFARLAND TO ALLOW CITY COUNCIL MEETINGS TO BE
HELD REMOTELY, CONSISTENT WITH ASSEMBLY BILL 361

RECOMMENDATION
WHEREAS, the City of McFarland is committed to preserving and nurturing public access and participation in meetings of the City Council; and WHEREAS, all meetings of the City of McFarland’s legislative bodies are open and public, as required by the Ralph M. Brown Act (Cal. Gov. Code 54950 – 54963), so that any member of the public may attend, participate, and watch the City’s legislative bodies conduct their business; and
WHEREAS, the Brown Act, Government Code section 54953(e), makes provisions for remote teleconferencing participation in meetings by members of a legislative body, without compliance with the requirements of Government Code section 54953(b)(3), subject to the existence of certain conditions; and
WHEREAS, a required condition is that a state of emergency is proclaimed and state or local officials have imposed or recommended measures to promote social distancing; and WHEREAS, in response to the novel coronavirus (“COVID-19”) pandemic, Governor Newsom adopted a series of Executive Orders allowing the legislative bodies of local governments to meet remotely via teleconference so long as other provisions of the Ralph M.

Brown Act (“Brown Act”) were followed; and
WHEREAS, on March 4, 2020, Governor Newsom declared a statewide emergency arising from COVID-19 pursuant to Government Code section 8625; and WHEREAS, on Sept. 16, 2021, Governor Newsom signed AB 361, which immediately amended the Brown Act allowing governing boards to continue holding virtual meetings outside the teleconferencing requirements of Government Code section 54953(b), if the board makes a finding that there is a proclaimed State of Emergency, and either (1) state or local officials have imposed or recommended social distancing measures, or (2) meeting in person would present imminent risks to the health or safety of attendees due to the emergency; and NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of McFarland that:

1. The recitals set forth above are true and correct and fully incorporated into this Resolution by reference.

2. The City Council of the City of McFarland recognizes that a State of Emergency in the State of California continues to exist due to the COVID-19 pandemic.

3. The City Council of the City of McFarland finds that holding in-person meetings would present imminent risks to the health or safety of attendees due to the cause of the State of Emergency and that the cause of the State of Emergency directly impacts the ability of the City Council and other Board and Commission members to meet safely in person.

4. The City Council of the City of McFarland authorizes the use of teleconferencing for all meetings in accordance with Government Code section 54953(e) and all other applicable provisions of the Brown Act, for a period of thirty (30) days from the adoption of this resolution, or such a time that the City Council adopts a subsequent resolution in accordance with Government Code section 54953(e)(3).

5. The use of teleconferencing shall be a “hybrid” format where council members and staff participate either in person or remotely depending on their individual circumstances as it relates to Covid-19. Should all Council Members, Commission

Section 1. Firm Identification and Qualifications
Description and Location
The Pavement Management Group (PMG) is a consulting firm specializing in providing professional pavement management services for public and private agencies throughout the United States. One hundred percent of our business operations and activities are directly within pavement management, separating us from the majority of our competitors within the industry.

Founder and CEO James Golden III founded the firm in 2017 after an extensive 18-year career of managing and directing pavement management projects for public and private agencies.

Our extensive knowledge of pavement management systems, maintenance, preservation, repair, and project planning aid our clients in identifying the “right” treatment to apply to the “right” pavement at the “right” time. The result of this effort alone helps to maximize the annual maintenance and repair budget while receiving an actual return on investment from our services in terms of both tax dollars and conditions. Finally, our advancements in video-based artificial intelligence technologies are paving the way for objective, repeatable, and timely roadway condition assessment.

Our company resources from both a personnel and financial position are vital and allow us to provide our cost-effective, streamlined turn-key pavement management solution, to any client, in any area, and within the project timeline.

PMG’s official office headquarters are 1255 Hebron Road, Heath, OH 43056. We also have three additional satellite locations, Tampa, FL, Oviedo, FL, and Branson, MO, with our fourth in process in Stanford, CA.

Our firm continues to grow to serve our Nation’s increasing pavement management needs.

Section 2. Project Understanding
The Pavement Management Blueprint from PMG
Being within the pavement management sector for over 20 years, we have made the necessary adjustments and pivots to meet the needs of our clients and engineering partners. The development of long-term, optimized roadway management plans is rooted in quality data collection that is fully trusted, supported, and objective in nature. At PMG, we take pride and passion in delivering our solution in this manner. The following scope of services within our blueprint provides a complete, data and map-driven pavement management solution in a user-friendly way.

The PMG Blueprint allows our partners and clients to fully leverage our standardized roadway condition assessment data to develop an optimized and long-term project plan. Furthermore, our project deliverables are easy to comprehend and produced in a map-driven and data-driven manner, complete with an interactive condition map and streaming high-definition video.

Commitment to Quality Data Collection
PMG commits to capturing quality distress-based data to produce objective, repeatable, and reliable Pavement Condition Index (PCI) values. There is an old saying within the industry, “garbage in, garbage out.” With any long-term project plan, the reliability and accuracy of the data are critical. James and his team have proven competency in this arena by completing coursework and obtaining specific credentials relating to pavement management and ASTM condition assessment through the University of Colorado State and the Metropolitan Transportation Commission. Each year, PMG performs tens of thousands of PCI calculations for municipalities throughout the United States, with that number growing each year.

Section 3. Technical Approach, Scope of Services, and Schedule A. Project Kickoff Meeting
PMG will host a one-hour online project kickoff meeting via Zoom to discuss the scope of work, establish the timeline, discuss deliverables, and define all resources required for the project. At this meeting, the project manager will present and request any additional information, data, files, maps, etc., that would be deemed essential for completing the project on time.

PAVEMENT MANAGEMENT SERVICES PROPOSAL
Page | 6
B. Network Inventory and Video
PMG recommends the PAVER Pavement Management System for your initial project implementation. For the network inventory definition, we use aerial imagery and professional measuring tools from Google Earth Professional in conjunction with client-provided shapefile data to produce a complete and accurate inventory of your maintained street network. Your roadway network is segmented by intersection with all standard attributes documented, including Section ID, From, To, Length, Width, Area, lanes, Surface, Last Construction date, Curb Type, Rank Class, etc.

In addition to defining the inventory of your network(s), PMG will import your provided shapefile(s) into the pavement management system and link all correlating pavement sections to their GIS segments. This effort provides a complete, GIS-assigned pavement management inventory for map-driven reporting, condition analysis, streaming video review, and decision making.

PMG will capture 100 % of your Roadway Network in 1080P full HD video. We will organize these video files by street name and section number and deliver them on a 1TB external hard drive and a shared Google drive folder. Your Roadway Network Videos will also be available to stream directly to your desktop in HD throughout all project deliverables with just a high-speed internet connection.

PAVEMENT MANAGEMENT SERVICES PROPOSAL
Page | 7
D. Condition Assessment
PMG uses an automated and proprietary AI model developed in-house to identify, document, and quantify all distresses occurring within each roadway section of the network. We import the distress data into the PAVER pavement management system for Pavement Condition Index (PCI) calculation, adhering to the ASTM D6433 condition assessment standard. The PCI is on a numeric scale of 0 – 100, with 0 considered failed and 100 considered excellent. Upon completion of the condition assessment, each pavement section within the network will have a calculated PCI.

PAVEMENT MANAGEMENT SERVICES PROPOSAL

DATE: July 14, 2022
SUBJECT: Janitorial Service for City Hall
RECOMMENDATION:

Staff recommends the City Council discuss and approve the proposal to hire Cal Clean, LLC Janitorial Services to clean city hall.

BACKGROUND:

Currently, the city has no custodial services to clean the city hall building. Over the past year, the city has assigned employees from various departments to clean city hall. This extra task is a collateral assignment assigned to employees that are hired for other functions. Unfortunately, because of the workload, these individuals cannot provide a consistent schedule of cleaning. Therefore, city hall often has dirty floors, unemptied garbage receptacles, empty paper towel and toilet paper holders, as well as dirty windows and carpet.

Customers and visitor’s frequent city hall usually tending to business by use of the city hall lobby and sometimes the lobby restroom. Because of the inconsistency in cleaning, the lobby and restroom often have dirty floors and many times the bathroom is out of paper towels and toilet paper. This reflects negatively on the city and decreases the faith the residents have in our ability to provide a professional public service.

Currently, the employees assigned to clean city hall have no formal or informal training in custodial work and therefore they do not possess the knowledge or skill set necessary to provide an appropriate cleaning service for the city. The city needs a Janitorial Service to assure city hall is appropriately maintained and assure we are professionally servicing our customers. This service will also decrease the purchasing of cleaning supplies and equipment we currently use to upkeep the facilities.

Upon Councils’ approval of the hiring of a Janitorial Service, staff will assure appropriate references and insurances prior to completing the agreement.

SUBJECT: Report, Discuss, and possible Approval of resolution No. A Resolution of the City Council of the City of McFarland approving an appropriation of funds from ARPA for the funding of staff training with Tyler Technologies.

RECOMMENDATION:

Staff recommends the City Council discuss and possibly adopt the attached resolution appropriating $20,000.00 for staff training with Tyler Technologies.

BACKGROUND:

The City currently utilizes Tyler Technologies (“Tyler”) financial management software program known as ERP Pro 10. Upon its acquisition, it is believed that certain staff received appropriate training to competently use ERP Pro 10. Since that time, most of the Finance staff has turned over multiple times with a loss of knowledge on each turnover. As a result of this turnover and lack of training for current staff, the current software is not being utilized to its full potential. Staff believes an appropriate training program on the City’s financial system is critical to ensure staff has the necessary skills to perform their daily tasks. These funds will also be used to train employees of other departments engaged in finance functions, such as payables and invoice creation.

FISCAL IMPACT:
$20,000.00 – Funded Fully by American Rescue Plan Act (ARPA) funds.

Good morning!
The City has a subscription to TylerU for quick online training. Go to www.tylertech.com  and either login or register.

Then choose the blue client support button, ERP Pro (Incode 9 & 10) and you will find Tyler University access there. Tyler Community in the same area, also has a few training videos and information.

We have Tyler Tutoring available for one‐on‐one instructor lead training at @250 per hour, minimum of 2 hours. This is a great option as you can purchase a block of hours and use them in the different areas of training needs. You can use a couple of hours at a time or whatever timeframe you need.

Also, at times, Tyler Community will announce VLL’s (Virtual Learning Labs) that are billable, but you will have coursework with an online instructor.

Let me know if you would like to utilize Tyler Tutoring and the hours you would like to purchase and I will put together pricing for review.
