MEMORANDUM
CITY OF MCFARLAND
TO:
FROM:
DATE:
SUBJECT:
Honorable Mayor and Council Members
Kenny Williams, City Manager
Larry A Ronk III, Community Development Director
November 10, 2022
Second Reading of Water Conservation Ordinance Update 12.10.
Discussion:
City Ordinance 12.10 identifies all water conservation measures that the City can implement to help the State with the drought. The City has implemented stage two water shortage restrictions, however, the staff has not implemented enforcement. The update to the municipal ordinance 12.10 will allow enforcement by the City. The officers will follow the same guidelines it uses now in issuing citations. This will include the issuing of a warning prior to any citation, to educate residents and property owners that are in violation. The Code Enforcement and Water Divisions will be educating residents with information sent with monthly City water bills. This information will include watering schedules and what stage of the water conservation we are enforcing.
Recommend:
Staff recommends City Council open the Public Hearing, receive public testimony, read the ordinance by title only and motion for adoption Ordinance NO. 0010-2022 amending Title 12, Chapter 12.10 to provide an enforcement process to enforce the City’s water conservation measures.
Fiscal Impact:
Legal Fees.

12.10.030 Relief from Compliance
12.10.040 Enforcement
12.10.010 - Purpose.
The state of California faces persistent water supply problems. Accordingly, it is the purpose and intent of this chapter to implement measures to conserve water resources, to reduce outdoor water use, and to mitigate unnecessary consumption of available water supplies in the city. (Ord. No. 040-2014, § 1, 11-13-14)
12.10.020 - Drought restrictions.
The following restrictions shall be imposed upon declaration by the city of McFarland of a water shortage:
A. Stage 1 Water Shortage. When the city of McFarland implements its Stage 1 water shortage allocation reduction, the following restrictions on the use of water from the McFarland water system shall be in effect:
1. The use of water which allows substantial and unreasonable amounts of water to run into a gutter, ditch, or drain. Every water user is deemed to have his water distribution lines and facilities under his control at all times and to know the manner and extent of his water use and excess runoff.
2. The excessive use, loss, or escape of water through breaks, leaks, or malfunctions in the water user's plumbing or distribution facilities for any period of time after such escape of water should reasonably have been discovered and corrected. It shall be presumed that a period of forty-eight hours after discovery is a reasonable time within which to correct such leak or break.
3. The washing of vehicles, building exteriors, sidewalks, driveways, parking areas, tennis courts, patios or other paved areas without the use of a positive shut-off nozzle on the hose, which results in excessive runoff, except where necessary to dispose of liquids or substances that could endanger the public's health, welfare and safety.
B. Stage 2 Water Shortage. When the city of McFarland implements its Stage 2 water shortage allocation reduction, the following restrictions on the use of water from the McFarland water system shall be in effect in addition to all Stage 1 water shortage restrictions:
1. Irrigation utilizing individual sprinklers or sprinkler systems of lawns, gardens, landscaped areas, trees, shrubs or other plants is permitted on the "odd/even" protocol (based on last digit of street address), between the hours of eight p.m. and five a.m. on designated days. a. A hand-held hose with positive shut-off nozzle is used; or b. A hand-held, faucet-filled bucket of five gallons or less is used; or c. A drip irrigation system is used.
3. Irrigation Overspray and Runoff. Water shall not spray or flow to any impermeable private or public surface, including but not limited to, walkways, driveways, sidewalks, alleys, streets, or storm drains.
4. Exception: Commercial nurseries, farmers, and similar establishments are exempt from Stage 2 irrigation restrictions, but will be requested to curtail all nonessential water use.
3. The washing of automobiles, trucks, trailers, boats, airplanes, and other types of mobile equipment is permitted only on designated irrigation days based on the "odd/even" protocol (based on last digit of street address), between the hours of eight a.m. and six p.m. on designated days. Such washing, when allowed, shall be done with a hand-held bucket, or a hand-held hose equipped with a positive shut-off nozzle for quick rinses.
4. Exception: Washing may be done at any time on the immediate premises of a commercial car wash or commercial service station. Further, the aforementioned washing is exempt from these regulations if the health, safety, and welfare of the public is contingent upon frequent vehicle cleanings, such as in the cases of garbage trucks and vehicles to transport food and perishables.
5. The emptying and refilling of water to swimming pools and/or spas is permitted only on designated irrigation days between the hours of seven p.m. and ten a.m.
6. The operation of any ornamental fountain or other structure making similar use of water is prohibited unless the fountain uses a recycling system, such as an electric pump.
7. The washing of sidewalks, driveways, parking areas, courts, patios, or other paved areas is absolutely prohibited, unless it is necessary for the health and safety, and welfare of the public.
8. Eating and Drinking Establishments.

STAFF REPORT
CITY OF MCFARLAND
TO: Honorable Mayor and City Council Members
FROM: Kenny Williams, City Manager
Larry A Ronk III, Community Development Director
DATE: November 10, 2022
SUBJECT: Report, Discussion, and Potential Approval of Resolution No 2022-0119 Adopting the Resolution of Necessity.
Recommendation:
Adopt the Resolution of Necessity (2/3 vote required).
Background:
A new housing development, which was approved by this Council, is currently being constructed and is bounded by Taylor Avenue and Garzoli Avenue. Currently, the proper infrastructure along both Taylor Avenue and Garzoli Avenue does not exist to allow the residents of this new development to safely travel. Thus, the City must construct proper infrastructure, including widening of the road, curb, gutters and sidewalks. Such construction will provide a complete infrastructure installation that will coincide with the installation of the housing development in the area.
The City, however, does not own the property where the infrastructure must be constructed. The parcel is located across from Horizon Elementary at the Southwest corner of Taylor Avenue and Garzoli Avenue. The property is designated as single-family residential, R-1, zoning on the City General Plan Map and Zoning map. Therefore, to complete these improvements, the City must acquire rights of way and/or public utility easements from the affected property along the corridor within the Project area.
A plat map showing the proposed street improvements is attached as an exhibit to the proposed Resolution.
Staff has been in contact with the property owners. Additionally, an appraiser, retained by the City, assigned a fair market value to the portion of the property necessary to complete the Project. An offer from the City to acquire the property for the amount stated in the appraisal was made but not yet accepted. Therefore, in order to meet the construction schedule, the City must consider the filing of an eminent domain action, which will allow the City to proceed with the project while the fair market value is determined by the Court.
Before an eminent domain case can be filed, the City Council must adopt, by at least a 2/3 vote, a “Resolution of Necessity.” This resolution makes certain findings required by state law and authorizes the city attorney to begin the proceedings.
It must be emphasized that the price to be paid for the property is NOT the subject of this hearing. This hearing has the sole purpose of determining whether the statutory findings can be made.
Statutory Findings:
The statutory findings required to be made, and the facts supporting the making of the findings, are as follows:
1 . The project is planned and located in a manner that will be most compatible with the greatest public good and the least private injury.
Facts: Yes, the new housing development, which was approved by this Council, is currently being constructed and is bounded by Taylor Avenue and Garzoli Avenue.
However, the proper infrastructure along both Taylor Avenue and Garzoli Avenue does not exist to allow the residents of this new development to safely travel. The project would extend the current alignment and improvements along that portion of both Taylor Avenue and Garzoli Avenue abutted by the Property that exist along the other portions of Taylor Avenue and Garzoli Avenue. This Project is deemed important for the safety of the residents of McFarland and is necessary to install the proper infrastructure, including widening of the road, curb, gutters and sidewalks. The subject property is on the southwest side of the cross-street. The roadway cannot be shifted to the north or east and thus avoid the taking because of the geometries of the street design and because this will require a redesign and construction of the intersection of Garzoli Avenue and Taylor Avenue. If the street was shifted to the north, more private property would need to be acquired and the street would not make a smooth transition along its proposed route.
2. The taking of the project is necessary for the proposed project.
Facts: Yes, as stated above, there would be insufficient room for the street improvements, including sidewalk and other street infrastructure, if the portion of the Property was not taken.
3. The offer to purchase required by California Government Code Sec. 7267.2 was made to the owners of the property interests.
Facts: Yes, a written offer to acquire the property at the fair market value as determined by the appraiser was made on August 4, 2022.
4. The necessary notice of this hearing was given as required by Code of Civil Procedure Sec. 1245.235.
Facts: Yes, the notice was given by the City Clerk on October 17, 2022.
5. The City of McFarland has complied with all conditions and statutory requirements necessary to exercise the power of eminent domain.
Facts: Yes, as outlined in this staff report.
6. The City of McFarland has complied with all provisions of the California Environmental Quality Act for the project.
Facts: Yes, the project qualifies for Categorical Exemption 15301 (c) (Existing Facilities) as it represents a minor alteration to existing streets for the purpose of public safety. The project also qualifies for CE 15303(d) (New Construction or Conversion of Small Structures) as it includes constructing small facilities including street improvements.
7. If any portion of the property is appropriated for a public use, the public uses are necessary and paramount pursuant to Code of Civil Procedure Sec. 1240.610, or alternatively, will not unreasonably interfere with or impair the continuance of the public use as it then exists or can be reasonably expected to exist in the future.
Facts: Yes, the surplus portion of the taken property, after the building is removed, will be used for public purposes, including landscaping and potential open space or parking for a nearby transit center.
Fiscal Impact:
Acquisition of this property is included in the costs of the project budget and legal fees.
Conclusion:
If the City Council wishes to proceed with the project, then this Resolution should be adopted.

DISCUSSION:
The Public Works Department has not been able to fill the Water Operator III/Supervisor position over a two-year period. Current salaries of neighboring cities with similar job descriptions are higher than our current salary range. Staff has brought forward a proposed salary range increase to become more competitive with our neighboring competing agencies. The current salary range is range 32, which is $54,454 to $68,716 annually. Staff is proposing that the salary range be increased to range 38 $63,169 to $80,849 which puts us at the average of the salary survey data.
The amount previously budgeted for this position was a combined annual cost of $93,321 including annual salary at C step range 32, health benefits and 401K. The proposed annual cost to fund the proposed salary increase is a combined annual cost of $116,131 which includes an annual salary at F step range 38, health benefits and 401K. The annual increase in expenses to fund the position at the higher salary range of range 38 is $22,810.
FISCAL IMPACT:
It will cost the City $22,810 more annually to fund the Water Operator III/Supervisor position at the higher salary range. 100% of the cost will be funded out of the Water Fund. There is no fiscal impact on the General Fund.
RECOMMENDATION:
It is recommended that the City Council Approve Resolution number 2022-0120 approving an updated job description for the Water Operator III/Supervisor position and an appropriation of an additional annual sum of $22,810 from the Water Fund to fund a recommended higher salary range increase for the Water Operator III/Supervisor position at range 38 step F at $38.87/hour.
