NOTICE TO PROPERTY OWNERS OF PUBLIC HEARING REGARDING
PROPOSED CHANGES TO WATER, SEWER & SOLID WASTE RATES
Hearing Date & Time: December 14, 2023, 6:00 PM
Hearing Location: McFarland Council Chambers
103 West Sherwood Avenue, McFarland, California 93250
Why are you receiving this notice?
The City of McFarland (City) is mailing this notice to you because you are a water, sewer or solid waste customer, or the owner of record of property that receives one or all of these services. This notice is being provided pursuant to California Constitution Article XIIID (also known as “Proposition 218”). Proposition 218 requires the City to notify property owners and customers of proposed changes to property‐related fees such as those for water, sewer or solid waste service. This notice describes proposed changes to the rates for these services and gives information about a public hearing to be held on December 14, 2023, at the City Council Chambers, 103 West Sherwood Avenue, McFarland, CA 93250. If adopted, the proposed rates for water, sewer and solid waste service will be in effect beginning January 1, 2024.
What do water and sewer rates fund?
The City provides water and sewer service to residential, multi‐family, commercial, and government/correctional facility customers within itsservice territory. Monthly water and sewer rates charged to system users(customers) are the primary source of revenue to operate and maintain the water and sewer systems and are used solely for this purpose. Water and sewer rate revenue provides funding for costs related to system operations, maintenance, capital projects, debt repayment, administration, as well as costs related to prudent long‐term operational or financial management of the utilities, such as maintaining adequate fund reserves and planning for contingencies.
The proposed rates are based on a comprehensive utility rate study and financial plan completed by an independent consultant. The rate structures for each utility were designed so that revenues derived from the proposed rates do not exceed the amount of revenue required for the City to provide the services, nor will the revenue from the water and sewer rates be used for any purposes other than those for which they are imposed. The amount of the proposed rates imposed on any parcel or person as an incidence of their property ownership will not exceed the proportional cost of the service(s) attributable to such parcel; and no rate will be imposed for a service unless that service is actually used by, or immediately available to, the property owner or customer in question.
Why are water and sewer rate changes needed?
The utility rate study and financial plan determined that the City’s current water and sewer rates are notsufficient to meet rising costs associated with system operations and maintenance, which like most costs, increase over time. These costs also include administrative activities in support of operations, routine repair and replacement of aging system components, and capital facilities projects such as overhauling the City’s water well system, replacing aging water infrastructure, and upgrades to the Wastewater Treatment Plant.
How the water and sewer rates are determined and how they work To develop water and sewer rates that will generate sufficient revenue to meet fiscal and policy objectives of the City, a determination of the annual revenue requirements from water and sewer rates was completed. As previously mentioned, revenue requirements include projected expenditures for operations, maintenance, repair and replacement of aging system components, equipment, debt repayment and capital projects.
The revenue requirement for each utility also includes maintenance of designated reserves. Healthy reserve funds are critical to the ability of the City to serve its customers and respond to unforeseen and unpredictable costs. The reserves, like all elements of the water and sewer charges, may only be used to fund costs associated with those systems.
The revenue requirements were compared to the total sources of available funds under existing rates during each year of the forecast period to determine the adequacy of projected revenues to meet those requirements. Where a shortage of revenue was found, a series of revenue adjustments was calculated, which if implemented, will provide revenue sufficient to meet those needs. Following is a description of the proposed water and sewer rates.
Water ‐ Proposed water rates consist of 1) a monthly fixed charge for all customers, that varies based on meter size, that designates the minimum amount a customer will pay regardless of the amount of water used, and 2) a volumetric rate per 100 cubic feet, based upon the amount of monthly metered water use. Residential customers pay incremental volumetric rates, where the rate per 100 cubic feet increasesfor all water use once they exceed their usage block threshold of 900 cubic feet. All other customers pay a uniform volumetric rate per 100 cubic feet for all water use. The fixed charge recoversthe fixed costs of maintaining and operating utility infrastructure and facilities, while the volumetric rate recovers variable costs of pumping, treating, and distributing water. The rate structure was designed so that each system user will be charged an amount proportional to the cost of serving them, based on historical demand and usage characteristics.
Sewer – Proposed sewer rates consist of 1) separate monthly fixed charges for Single‐Family and Multi‐Family customers, per dwelling unit, regardless of their usage, 2) monthly fixed charges for Non‐Residential customers, per account, that vary by sewer discharge strength, regardless of their usage, and 3) Volumetric rates for Non‐Residential customers only, per 100 cubic feet, that vary by their sewer discharge strength. Single and Multi‐Family customers pay only a flat monthly fee, and no volumetric rate per 100 cubic feet. The fixed charges recover the fixed costs associated with the operation and maintenance of sewer collection and treatment facilities, while the volumetric rates recover the variable costs of treatment and disposal of wastewater. The rate structure was designed so each system user will be charged an amount that is proportional to the cost of serving them, based upon their demand, discharge strength and usage characteristics.
New water rates
The City is proposing to implement new water rates as a series of annual adjustments starting on January 1, 2024, and then each January 1 thereafter, until January 2028. The following table summarizes the proposed water rates. The Fixed and Volumetric charges will go into effect and remain in effect until superseded by Council action.
Proposed Monthly Water Rates
January 1, 2024 – January 1, 2028
New sewer rates
In order to provide necessary funding for the sewer system, the City is proposing to implement new sewer rates as a series of annual adjustments starting on January 1, 2024, and each January 1 thereafter until January 2028. The following table summarizesthe proposed sewer rates. The rates will go into effect and remain in effect untilsuperseded by Council action.
Proposed Monthly Sewer Rates
January 1, 2024 – January 1, 2028
Impact on your water and sewer bill
Per the proposed rates, effective January 1, 2024, for a typical single‐family home that uses 1,400 cubic feet of water per month, the combined water and sewer bill would increase from $80.04 per month currently to $83.60 per month. The accompanying graph provides a summary of existing and proposed rates under three usage scenarios.
How are solid waste rates determined, and what do they fund? The City contracts with R&F Disposal and Recycling (R&F), a local recycling and waste management company, to provide solid waste collection and disposal services. Solid waste rates are set in accordance with the City’s agreement with R&F, with an additional component to recover the City’s overhead and administrative costs that is proportionate to the rates specified in the R&F contract. Solid waste rate revenue provides funding to pay for removal, processing, transfer, and disposal of solid waste, recyclables, and organic material such as food waste, as well as reserve funds to be used in the event of unforeseen events or costs. Monthly solid waste rates charged to customers are the primary source of revenue to provide this service and are used solely for this purpose.
Why are solid waste rate changes needed?
Like most costs, those associated with solid waste removal increase over time. Several factors have impacted the cost of providing solid waste services in California. For example, changes in the global markets for recyclables have resulted in local recyclable material processors substantially increasing pricing and quality expectations. As a result, many municipal curbside recycling programs in other parts of the country have been cancelled or drastically reduced as they have become too expensive to sustain. Program cancellation is not a viable option in California due to State diversion mandates.
In addition, Senate Bill (SB) 1383 (short‐lived climate pollutants) requires the City to implement new residential and commercialservicesfor the collection of organic materialsuch asfood waste, which will come with considerable additional costs. Under State law SB 1383, California cities must implement universal organic waste recycling programs for all customers on or before January 1, 2022. Organic waste primarily includes landscape and green waste, food scraps, non‐ hazardous wood waste, and food soiled paper products. The goal of the regulations is to reduce methane emissions from landfills by diverting organic material. To provide for current operations and fund the additional SB 1383 residential and commercial services, rate increases are necessary.
It is proposed that solid waste rates from 2024 to 2028 will increase to keep pace with increases in the projected cost of services provided by R&F, as well as administrative costs incurred by the City.
New solid waste rates
The City is proposing to implement new solid waste rates as a series of annual adjustments starting on January 1, 2024, and then each January 1 thereafter, until July 2028. The following table summarizes the proposed solid waste rates, which will go into effect and remain in effect until superseded by Council action.

If written protests, as outlined above, are not presented by a majority of property owners or customers of record, the City Council will be authorized to adopt the proposed rates. While both property owners and customers of record may submit written protests, only one protest will be counted for each parcel. If adopted, the rates for water, sewer and solid waste service will be in effect beginning January 1, 2024.

STAFF REPORT
TO: Honorable Mayor and City Council Members
FROM: Kenny Williams, City Manager
Paul Saldana, Community Development Director
DATE: October 12, 2023
SUBJECT: Report, Discuss, and Possible Approval of Resolution No. 2023-0125 authorize agreements for building inspection and plan check services.
SUMMARY:
The Community Development Director, as part of the overall departmental review, found that the Department has on-call, as-needed building plan check services however does not have oncall services for building inspection. Consequently, the Director issued a Request for Qualification (RFQ) to identify companies that could potentially provide both plan check and building inspection services on an on-call, as-needed basis. The RFQ was issued on September 5 and three (3) responses were provided by the RFQ deadline of September 18, 2023.
After reviewing the proposals, staff is recommending that the City contract with Interwest Consulting Group and CSG Consultants. The City currently uses Interwest for plan check services and the new agreement will update the terms and conditions as well as add building inspection services to the agreement. CSG provides plan check and building inspection services for a number of cities in California and additional provides other services in other disciplines.
The City will review the performance and response of the service providers and continuously monitor customer satisfaction with their services. The ability to have two firms under contract with the City provides assurance of coverage when needed and reduces the delay in securing additional assistance as needed.
FISCAL IMPACT:
Services are paid for through building permit fees and other services are fully reimbursed by project applicants and therefore there is no direct fiscal impact.
RECOMMENDATION:
Report, Discuss, and Possible Approval of Resolution No. 2023-0125 to approve agreements for building inspection and plan check services.

9.2.7. If, after notice of termination of this Contract under the provisions of this section, it is determined for any reason that Consultant was not in default under the provisions of this section, or that the default was excusable under the terms of this Contract, the rights and obligations of the parties shall be the same as if the notice of termination had been issued pursuant to Article 8 Termination for Convenience.
PROFESSIONAL CONSULTANT SERVICES AGREEMENT
9.2.8. The rights and remedies of City provided in this section shall not be exclusive and are in addition to any other rights and remedies provided by law or under this Contract.

10. COVENANTS AGAINST CONTINGENT FEES. Consultant warrants that it has not employed or retained any company or person, other than a bona fide employee working for Consultant, to solicit or secure this Agreement, and that Consultant has not paid or agreed to pay any company or person, other than a bona fide employee, any fee, commission, percentage, brokerage fee, gift, or any other consideration contingent upon, or resulting from, the award or making of this Agreement. For breach or violation of this warranty, the City shall have the right to terminate this Agreement without liability or, at the City’s discretion, to deduct from the Agreement price or consideration, or otherwise recover the full amount of such fee, commission, percentage, brokerage fee, gift or contingent fee.
11. OWNERSHIP OF DOCUMENTS.
11.1. All computer data, computer drawing files, plans, studies, sketches, drawings, reports, specifications, and all work product produced by Consultant under this Agreement are the property of the City, whether or not the City completes the Scope of Work or proceeds with the project for which such documents are prepared.
11.2. This Agreement creates a nonexclusive and perpetual right or license for City to copy, use, modify, reuse, and sublicense any and all copyrights, designs, and other intellectual property embodied in the writings prepared by Consultant, and Consultant subcontractors, under this Agreement. In the event the City should ever desire to undertake a project or review other proposed projects based upon the documents, the Consultant agrees that the City shall have the right to reuse all or any portion of the documents at no additional compensation to the Consultant. For the avoidance of doubt, nothing in this Agreement shall be understood to grant City rights to pre-existing intellectual property of Consultant, including Consultant software and licensed software, or to any improvements thereto. Consultant shall have no liability arising from the use of any work product for any purpose or on any project other than that for which it was produced.
12. INDEPENDENT CONTRACTOR.
12.1. The Consultant shall perform the services provided for herein in a manner of Consultant's own choice, as an independent Contract and in pursuit of Consultant's independent calling, and not as an employee of the City. Consultant shall be under control of the City only as to the result to be accomplished and the personnel assigned to the Project.
12.2. If the Consultant subcontracts any of the work to be performed under this Agreement pursuant to the terms of this Agreement, Consultant shall be as fully responsible to the City or the acts and omissions of the Consultant's subcontractor and of

the persons either directly or indirectly employed by the subcontractor, as Consultant is for the acts and omissions of persons directly employed by Consultant. Nothing contained in the Agreement shall create any contractual relationship between any subcontractor of Consultant and the City. The Consultant shall bind every subcontract by the terms of the Agreement applicable to Consultant's work, including indemnity and insurance requirements.
13. HOLD HARMLESS AND INDEMNIFICATION.
13.1. Indemnification - It is understood and agreed that Consultant has the professional skills, experience, and knowledge necessary to perform the work agreed to be performed under this Agreement and that City relies upon the professional skills of Consultant to do and perform Consultant's work in a skillful and professional manner, and Consultant thus agrees to so perform the work.
13.2. Acceptance by City of the work performed under this Agreement does not operate as a release of said Consultant from such professional responsibility for the work performed. It is further understood and agreed that Consultant is apprised of the scope of the work to be performed under this Agreement and Consultant agrees that said work can and shall be performed in a fully competent manner.
13.3. Consistent with California Civil Code section 2782.8, when the services to be provided under this Agreement are design professional services to be performed by a design professional, as that term is defined under said section 2782.8, Consultant shall, to the fullest extent permitted by law, indemnify, protect, immediately defend, and hold harmless City, and its officers, employees, agents, and volunteers, from and against all third-party claims, demands, damages, costs, or liability (including liability for claims, suits, actions, arbitration proceedings, administrative proceedings, regulatory proceedings, losses, expenses, or costs of any kind, interest, defense costs, and expert witness fees) to the extent arising out of, pertaining to, or relating to the negligence, recklessness, or willful misconduct of Consultant, its officers, employees, subcontractors, subconsultants or agents during the performance this Agreement, or from any violation of any federal, state, or municipal law or ordinance to the extent caused, by the negligence, reckless, or willful misconduct of Consultant or its employees, subcontractors, or agents, or by the quality or character of Consultant’s work, excepting only liability arising from the sole or active negligence, or intentional misconduct of City, its officers, employees, agents, and volunteers.

Other than in the performance of professional services by a design professional, which law shall be solely as addressed in subparagraph 12.3 above, and to the fullest extent permitted by law, Consultant shall indemnify, protect, defend, and hold harmless City, and its officers, employees, agents, and volunteers, from and against any third-party claims, demands, damages, costs, or liability (including liability for claims, suits, actions, arbitration proceedings, administrative proceedings, regulatory proceedings, losses, expenses, or costs of any kind, interest, defense costs, and expert witness fees) to the extent arising out of the negligent performance of this Agreement by Consultant, its officers, employees, agents, subcontractors and subconsultants, excepting only that resulting from
PROFESSIONAL CONSULTANT SERVICES AGREEMENT
the, sole or active negligence, or intentional misconduct of City, its officers, employees, agents, and volunteers. It is understood that the duty of Consultant to indemnify and hold harmless includes the duty to defend as set forth in section 2778 of the California Civil Code. Notwithstanding any provision of law to the contrary, Consultant shall have the right to defend and settle any action for which indemnification is sought, provided that it shall not enter into any settlement that requires an admission of wrongdoing by any indemnitee without that indemnitee’s approval. Consultant’s obligations under this Agreement are contingent upon timely receipt of notice of the claim for which indemnification is sought, such that defense of the claim is not prejudiced, and the reasonable assistance of the indemnitee in connection with the defense of the claim.
13.5. Acceptance of insurance certificates and endorsements required under this Agreement does not relieve Consultant from liability under this indemnification and hold harmless clause. This indemnification and hold harmless clause shall apply whether or not such insurance policies shall have been determined to be applicable to any of such damages or claims for damages.
14. ASSIGNMENT OF AGREEMENT. Consultant is without right to and shall not assign this Agreement or any part thereof or any monies due hereunder without the prior written consent of the City, which shall not be unreasonably delayed or withheld.

A. Commercial General and Automobile Liability. Consultant, at Consultant's own cost and expense, shall maintain commercial general and automobile liability insurance for the period covered by this Agreement in an amount not less than one million dollars ($1,000,000) per occurrence, combined single limit coverage for risks associated with the work contemplated by this Agreement. If a Commercial General Liability Insurance or an Automobile Liability form or other form with a general aggregate limit is used, either the general aggregate limit shall apply separately to the work to be performed under this Agreement or the general aggregate limit shall be at least twice the required occurrence limit. Such coverage shall include but shall not be limited to, protection against claims arising from bodily and personal injury, including death resulting therefrom, and damage to property resulting from activities contemplated under this Agreement, including the use of owned and non-owned automobiles.

In the alternative, Consultant may rely on a self-insurance program to meet these requirements so long as the program of self-insurance complies fully with the provisions of the California Labor Code. The insurer, if insurance is provided, or the Consultant, if a program of self-insurance is provided, shall waive all rights of subrogation against the City for loss arising from work performed under this Agreement.
PROFESSIONAL CONSULTANT SERVICES AGREEMENT
D. Deductibles and Self-Insured Retentions. During the period covered by this Agreement, upon express written authorization of City Risk Manager, Consultant may increase such deductibles or self-insured retentions with respect to City, its officers, employees, agents, and volunteers. The City may condition approval of an increase in deductible or self-insured retention levels upon a requirement that Consultant procure a bond guaranteeing payment of losses and related investigations, claim administration, and defense expenses that is satisfactory in all respects to each of them.
E. Notice of Reduction in Coverage. In the event that any coverage required under subsections (A), (B), or (C) of this section of the Agreement is reduced, limited, or materially affected in any other manner, Consultant shall provide written notice to City at Consultant's earliest possible opportunity and in no case later than five day after Consultant is notified of the change in coverage.
F. Other Remedies. In addition to any other remedies City may have if Consultant fails to provide or maintain any insurance policies or policy endorsements to the extent and within the time herein required, City may, at its sole option:
i. Obtain such insurance and deduct and retain the amount of the premiums for such insurance from any sums due under the Agreement; ii. Order Consultant to stop work under this Agreement or withhold any payment which becomes due to Consultant hereunder, or both stop work and withhold any payment, until Consultant demonstrates compliance with the requirements hereof;
iii. Terminate this Agreement.
iv. Exercise of any of the above remedies, however, is an alternative to other remedies City may have and is not the exclusive remedy for Consultant's failure to maintain insurance or secure appropriate endorsements.
16. DISPUTES.

Review final maps, improvement plans, and landscape plans. Review includes evaluation of required records, studies, grading and improvement plan, and additional materials submitted by the design professional.
Confirm that plans conform to City standard design criteria, conditions of approval, and infrastructure or other master plans.
Each plan review will be accompanied with a letter summarizing the red-line comments addressed to the applicant’s engineer or landscape architect, with a copy to City staff and the applicant. A complete red-lined set of drawings and any reports will be returned to the design professionals for use in their corrections. At the applicant’s discretion, the comment summary letter and red-lined plan sheets can be scanned and submitted electronically to the design consultant to expedite the review process.
Although we understand that meetings will not be required, CSG is available to meet with the applicant/representative and City staff to review comments or to delineate the standards which are not being met, in order to facilitate timely completion of the review and meeting the maximum goal of two plan checks. CSG will accept and review subsequent submittals electronically, when feasible, in order to expedite the review process. Soils reports will be evaluated and confirmation of recommendations will be included on the plans. Boundary conditions will be evaluated to maintain continuity with surrounding properties and maintain existing drainage patterns.
Construction erosion control and post-construction water quality control will be evaluated for compliance with the storm water quality management permit in effect for the City. Assist the City with development of conditions of approval, development agreements, and other requirements associated with development applications. Transportation /Traffic Engineering Plan Check Review
Our general project approach to on-call traffic engineering review encompasses three components:
i. Research of Relevant Background Information: this includes items such as previous studies, records of prior approvals or resolutions, conditions of approval that may be relevant to the project under consideration, etc.
ii. Application of our Engineering and Planning Knowledge: to discern prospective issues including controversial issues and providing notice to the City staff. Our knowledge is based on the collective experience of our team members coupled with the relevant background information. In delivering our services we build on:
a. Policies and Procedures at the Local, Regional, State, and Federal levels: which include regulations and guidelines impacting the municipal traffic engineering process from the City code to elements like SB 1, SB743, the regional Green House Gas/SCS policies and plans, MUTCD, the Complete Streets guidelines, among others.
b. Emerging Trends in Traffic Engineering Practice and Technology: which includes elements such as Vision Zero, concepts of Complete Streets and Active Transportation considerations.
Similarly, changes in the MUTCD and the new Highway Safety Manual affect the practice of municipal transportation traffic engineering.
iii. Effective and Timely Communication: we expect on-going interaction with City staff during each task order during which progress can be monitored. This could include weekly touchpoints to discuss the project and ensure all parties are up to date on project progress. We anticipate that informal check in meetings will occur regularly.

11 L A N D S U R V E Y I N G & M A P P I N G R E V I E W S E R V I C E S : C I T Y S U R V E Y O R The traditional role of the City Surveyor is to
ensure that maps, legal descriptions, and plats
prepared for private developments or public
projects are technically correct. However,
more often than not, the City Surveyor also
routinely ensures that the documents are
comprehensive of City requirements and
completed in accordance with the California
Subdivision Map Act and local ordinances and
are in substantial conformance with the
approved entitlement application (traditionally
the functions of the City Engineer). The City
Surveyor’s functions can vary, but typically
include evaluating the documents submitted
by applicants for completeness, reviewing and providing written comments and ‘redlines,’ and signing final documents/certificates or mylar prints of subdivision maps once approved. When complicated or unusual circumstances arise, the City Surveyor often meets with and advises the City Engineer and private applicants.
On rare occasions, the City surveyor may also be directed to set street monuments not set by private development surveyors.
Detailed Scope of Work
CSG will review Final/Tract and Parcel Maps, Amending Maps, Certificates of Correction, Street Dedications and Public Easement Grants (Plats/Legal Descriptions), Lot Line Adjustments and Lot Mergers (Plats/Legal descriptions, and complete certificates), or other documents for compliance and conformance with the following:
Approved Tentative Map (for subdivisions)
Conditions of Approval
The California Subdivision Map Act
The Professional Land Surveyor’s Act
Industry Standards and Local Practice
Title information for the property, including existing easements and any other relevant land encumbrances, based on information contained in a preliminary title report (PTR) and record documents to be furnished by the applicant (a hyperlinked PTR typically works best) Survey and miscellaneous information presented on parent record maps and deeds of the subject and adjacent properties
The Project Improvement Plans and other documents when conformance review is required by the City In conjunction with each review, CSG performs the following:
Review of closure calculations
Review, seal and sign final copies of subdivision maps or sign various certificates for technical correctness (as Acting City Surveyor or Technical Reviewer) Preparation of Staff Report(s) for City Council approval, if required Preparation of Lot Line Adjustment and Lot Merger certificates Preparation of Certificates of Compliance (including review of the Chain of Title for the parcel in question, and preparation of a technical memorandum describing our findings).
In addition to the documents listed above, CSG also regularly reviews Tentative Maps and assists municipalities with preparing Conditions of Approval (COAs). As City Surveyor, our scope of work is generally limited to review of the boundary and title information, and generating COAs associated with easements, or vacations or dedications of Rights-of-way. However, CSG can assist with all facets of Tentative Map reviews, including engineering reviews if needed.

12 CSG’s Review Process
New map submittals will be coordinated with the proposed project manager. At the time of new submittals, the applicant may decide to meet with the City and CSG’s project manager via Zoom or Microsoft (MS) Teams, or in person, to briefly present the project and discuss any challenges.
Upon receipt of the submittal package, CSG will perform a cursory review to determine if the submittal is complete or let the applicant know if additional documents are needed for the review. The documents required to initiate a mapping review consist of the following (minimum):
✓ Final or Parcel Map (or plat & legal description) in a PDF format ✓ A hyperlinked Preliminary Title Report, dated within 60 days ✓ Closure Calculations
✓ Any other record document used in the preparation of the new map or plat and legal description that is not readily available via the hyperlinked PTR
Depending on the City’s preference and project timeline, we may require missing documents immediately or address the matter in the form of a general comment with the first review.
Map reviews are typically completed by our team within fifteen (15) working days after receipt of a complete submittal package. Redlined documents and written comments are prepared for each review and can be provided electronically via email (most common), via overnight delivery, or by regular mail. Although comments are always provided to the City, comments may also be provided directly to the applicants upon City’s request. Subsequent submittals are typically reviewed within five to ten (5-10) working days, but additional review time may be requested depending on project size, complexity, and applicant responsiveness to the first review. Conversely, expedited plan reviews may be performed upon request in certain cases.
Following each review, CSG is available to meet with City staff and/or applicants to discuss comments via Zoom, MS Teams, or by conference call. Our staff is always available to meet with applicants to discuss concerns and explain comments, at any stage of the review process.
Technology & Resources
CSG staff are trained in the latest technologies available for mapping review work. The following methods are employed daily at CSG:
Bluebeam Revu Our staff utilizes the latest version of Bluebeam Revu for digital map and plan review.
Of particular note is the software’s ability to quickly compare two similar documents, particularly near approval, to ensure no additional unapproved changes are made.
ParcelQuest CSG subscribes to this web-based application to quickly pull publicly available data such as Owner names, addresses, APNs and APN maps from the regional Assessor’s Office database.
Zoom and Microsoft
Teams platforms
Virtual meetings, including screen sharing, allows for more efficient coordination and immediate collaboration.
Virtual communication is now widely used to reduce overall review time and control costs.
SURVEYS AND DOCUMENTS F OR PUBL IC PROJECTS
On occasion, certain projects will require that the City prepare documents affecting property rights on behalf of the public (such as right-of-way dedications or vacations, and public easements) or prepare documents affecting the fee title ownership of public property (such as lot line adjustments for public facilities – Community Centers, Police Stations, Parks, Corporation Yards, etc.) CSG has assisted many of our clients in such transactions and worked closely with City Attorneys to ensure that proper procedures and legal requirements are observed.

13 Detailed Scope of Work
The types of legal documents that may be prepared by the City will vary but may include Parcel Maps, Lot Line Adjustments, Lot Mergers, and more. Plats and legal descriptions may need to be prepared. For street dedication or vacation documents, as well as easement grants and abandonments, the burden of preparing the plats and legal descriptions are typically put on the private party responsible for the private development that triggered the need for the land transaction (such as a right-of-way vacation). For those occasions when there are no private developments associated with the work in question (such as a Lot Merger between two City-owned parcels), the documents are typically prepared as stand-alone documents/instruments by the City Surveyor. Lastly, records of survey may also be prepared if dictated by the Professional Land Surveyor’s Act.
All documents are produced using the same level of care and quality control as mapping reviews, and prepared in conformity to the following legal codes:
California Subdivision Map Act
Professional Land Surveyor’s Act
Streets and Highways Code
Civil Code
Other relevant sections of the Government Code
All maps or certificates are prepared using local industry standards and pre-established City requirements.
CSG’s Map/Document Preparation Process
CSG will meet with City representatives to discuss the scope of the project, general expectations, and final intent for the public property. Occasionally, better or quicker solutions are proposed to resolve issues after the project is thoroughly assessed and discussed. CSG will provide field and office surveys, perform research of record documents, and order and analyze Preliminary Title Information. The parcel map (or legal description and plat as the case may be) are subsequently prepared and submitted for review and comment to the City prior to producing mylar prints or final certificates and obtaining signatures from all parties.
QUAL ITY ASSURANCE / QUALITY CONTROL APPROACH
CSG’s in-house QA / QC Implementation Plan utilizes a peer review process on every project. Our dedicated QA/QC Manager will be responsible for the following:
Establishing guidelines & assigning accountable personnel and responsibilities for each task. Assuring that all deliverables are reviewed, including products from subconsultants. Monitoring the process to assure that the schedule and budget are followed. Participating in internal and external reviews.
Reviewing and signing off on deliverables before submittal to the clients.
Quality control is the responsibility of every team member of our staff at every level and at every milestone of the project development processes. All deliverables, including technical engineering reports, studies, design drawings and calculations, and maps are subject to a multi-tiered approach for review to ensure that all products are checked for accuracy, correctness, completeness and conformity with the City’s municipal code and design guidelines and standards, State, Federal and regulatory agencies requirements.
The QA / QC Manager conducts audits of the QA / QC process to ensure that all reviews are being properly conducted and documented by all team members.

AB ILITY TO MONITOR PROJECT BUDGET AND SCOPE
We understand that private development projects are often rush projects that require immediate attention and meticulous follow-through. Our strategy for staying on track, expediting reviews when possible, and maintaining quality while not noticeably increasing the level of effort (and costs) is as follows:
Keep the same map reviewer on a project whenever possible, thereby eliminating any additional and extraneous effort by other staff members
Utilize to the maximum extent feasible the functionalities of the digital map review software used (such as ‘document compare’ and the ‘Toolbox’ used to generate duplicate comments) Daily tracking by the Project Manager of submittals due dates and coordination with staff Avoiding unnecessary resubmittals or delayed resubmittals by scheduling virtual meetings or conference calls to discuss complicated comments or highly deficient work products (with City’s consent)
COMMUNICATION WITH CLIENTS AND STAKEHOLDERS
CSG understands that clear communication with the City is vital to delivering the reviews successfully and getting projects approved. This also allows us to gauge any potential issues and resolve them appropriately.
Internally, CSG conducts regular staff meetings where review progress and issues can be discussed to determine ways to enhance review quality and eliminate duplication and conflicting comments for the reviews that involve multiple disciplines. We also recognize that each jurisdiction is different and during onboarding meetings we will work with the City to establish an efficient, straightforward “Communication Protocol” which addresses the City’s needs.

CSG has the environmental staff resources to manage and prepare clear, concise, and legally defensible environmental documents under the California Environmental Quality Act (CEQA) and the National Environmental Policy Act (NEPA) for projects of all types, including development, infrastructure improvements, ecological enhancements, and policy adoption documents, such as General Plans and Specific Plans. CSG will serve as an extension of Chino Hills staff to ensure that the entire environmental review process is conducted in a comprehensive manner. CSG will consider recent legislation and court decisions pertaining to CEQA and NEPA and agency requirements. Our objective is to provide premium services to our clients, along with highly accurate technical documentation and impact determinations. Our approach entails an efficient process to ensure that studies are comprehensive, objective, technically accurate, and complete, while maintaining a focus on the schedule established for the review. Our approach includes consistent and regular interaction and communications between staff, our team, and other interested/responsible governmental agencies and parties, as appropriate, allowing for frequent exchange of information without loss of time or resources.
Our range of types of CEQA studies includes Categorical Exemptions, Initial Studies, Negative Declarations, Mitigated Negative Declarations, Project/Program/Focused/Supplemental/Subsequent and Addendum Environmental Impact Reports (EIR’s), consistency checklists, as well as mitigation monitoring programs. We can assist the City of Chino Hills with recommendations and scoping for the appropriate CEQA and NEPA documentation and, should an EIR be the determined CEQA clearance, CSG can lead the preparation of response to comments and any required findings of facts/statement of overriding considerations. We are also ready to assist the City of Chino Hills with project stakeholder coordination, filing of public notices, participation in public hearings, and complete project management services throughout the environmental review process.
Our team for environmental review is led by Mr. Glenn Lajoie, AICP, Principal and Director of Environmental Planning. Mr. Lajoie has attained over 35 years of experience in providing environmental and planning services for public sector clients throughout California. His project experience (as summarized in Section 6 of this qualifications overview) involves project and on-call services for urban and rural communities and has included complex projects requiring technical expertise, creative solutions, and development of effective and workable mitigation. The CSG team is well versed in CEQA analysis and planning practices and is further supported by industry partners and experts to prepare specialized technical studies, depending upon the nature and scope of the project, and required analysis for a specific assignment.
Methods
CSG views every assignment and project as a way to build long-lasting, meaningful working relationships with our clients. We always seek to excel in maintaining a clear line of communications with every client, stakeholder, agency, decisionmaker, and project team members to ensure assignments and projects are achieving and exceeding expectations. We work with positive attitudes, focus on teamwork, and have a shared determination in exhibiting professionalism in everything we do. Our mission is to consistently meet or exceed our client’s expectations in a responsible and efficient manner.
We believe that a comprehensive approach to environmental review includes attention to land planning, urban design, and the environment. Our project management philosophy is built upon the anticipation of, and preparation for, all issues that may arise throughout the review process. Our management team of senior professionals will work in close partnership with Chino Hills staff to ensure continuous coordination of our proposed services. We will assist the City of Chino Hills in determining environmental review requirements with support from additional CSG staff, which allows our team to provide a wide range of services in a cost-effective manner.
CSG recognizes that future agency projects, depending on their type, size, and issues of concern, may require several different types of CEQA and NEPA processes. For NEPA, the evaluation and associated environmental assessment will be prepared in accordance with the format and content specified by the NEPA lead agency. For CEQA, the work program will be initiated following completion and confirmation of the Project Description. As directed by the City of Chino Hills, CSG can then proceed with the preparation of an Initial Study pursuant to Appendix G of the CEQA Guidelines. The Initial Study will provide a screening and threshold review for each topical area in order to confirm and proceed with the appropriate CEQA clearance review.
STATEMENT OF QUALIFICATIONS TO THE CITY OF MCFARLAND

17 Additionally, and more specifically, we embrace the following steps in the review process:
Establish a communications protocol and technical leads, including subconsultants and other key team members, to ensure project critical information is efficiently and accurately conveyed across the team. Ensure roles/responsibilities are clear for efficient management of assignments and quality control of services and deliverables.
Utilize experienced staff with extensive relevant experience who will do the job right the first time. Agree on initial project schedule, budget, and protocol for updating status during all project phases. Determine key project description details with the City early to facilitate accurate and consistent reviews and analysis.
Verify that the technical approach/scope of services, as conveyed in the proposal, meet Chino Hills’s expectations following completion of the Project Description. Collaborate up front with the City on standard templates for project deliverables, including peer review technical memoranda and CEQA document components.
Communications and Techniques
As previously mentioned, CSG’s goal is to provide cost-effective, technically sound, and legally defensible environmental consulting and documentation services to our municipal clients. To this end, we emphasize frequent, informal communications with agencies and prepare concise verbal and written summaries of project information that can be readily shared with project participants and City staff. Our firm’s management style involves “no surprises,” which means that if we encounter a challenge, or constraint, we will immediately notify the City and be prepared to provide proven, short and/or long-term strategies for remedying any situation we encounter. Our project management philosophy revolves around an infrastructure of effective communications and problem solving, resulting in effective results for a particular situation.
In order to effectively manage CEQA processes, CSG will work with City staff to leverage previously prepared environmental documentation, with the collection of new, detailed environmental data necessary to analyze a project. Our approach facilitates the development of a comprehensive impact analysis, while streamlining the environmental compliance process, where appropriate, without compromising the analytical review that is necessary for a project.
CSG encourages our clients to integrate environmental considerations early in a project planning and design process so that environmental opportunities and constraints can be taken into account. Our experience has shown that by proactively incorporating environmental and permitting considerations into projects at the earliest feasible time (i.e., conceptualization, design, and planning phase), project proponents can reduce and, in some instances, eliminate the need for additional regulatory permits that can add months or even years to project schedules and substantially increase project costs. Our approach also prevents “scope creep” which often occurs when project designs change after technical studies have been completed.
Developing Project Descriptions and Context
One of the most important factors in preparing a legally defensible environmental document is having a complete and accurate understanding of the proposed project/action prior to initiating environmental analysis or review.
Taking the time to fully describe “the whole of the action” can result in significant time and cost savings. Further, initiating technical studies and starting the CEQA process at the appropriate time eliminates the need to backtrack and redo analysis due to new or changing project circumstances. CSG will assist City staff in defining the precise location and boundaries of all of the components, facilities, and associated infrastructure to be studied for a proposed project. CSG will also assist the City in identifying opportunities to keep a project moving forward, despite uncertainties. For example, if a specific utility alignment is not yet known, CSG can evaluate a larger area in the field in order to provide flexibility in the project design, while allowing the environmental studies to proceed.
Conducting Preliminary Environmental Compliance Review
CSG’s proposed approach to preparing environmental documentation is reflective of our experience in dealing with the preparation of documentation for a wide range of projects. After conducting a preliminary environmental compliance review to confirm whether and at what level a project is subject to CEQA, CSG will consider whether a
STATEMENT OF QUALIFICATIONS TO THE CITY OF MCFARLAND
FOR PLAN CHECK SERVICES
18 statutory or categorical exemption may apply and provide the appropriate recommendation. CSG will also evaluate whether a project may be eligible to utilize one or more of the applicable CEQA streamlining provisions.
For example, actions that are not consistent with zoning (but still require discretionary approvals) may utilize the streamlined exemption under Public Resources Code Section 21083.3 and CEQA Guidelines Section 15183, which states that a certified EIR for a planning or zoning action may be used to eliminate or reduce the scope of environmental review for later development projects that are consistent with the planning or zoning action. Section 21083.3 applies when a parcel has been zoned or designated in a community plan to accommodate a particular density of development and an EIR was certified for that planning or zoning action. Section 21083.3 also applies when an EIR was certified for a General Plan (Update) and a development project is consistent with the plan.
Similarly, CEQA Section 15332 provides exemptions under CEQA for projects characterized as infill development and that meet specific criteria. CSG is available to meet with City staff to discuss a specific project and to confirm whether unusual circumstances would disqualify a project from consideration under CEQA Section 15332.
CEQA does not provide specific procedures for determining if an exemption applies. If a project appears to meet all criteria, CSG can prepare a Notice of Exemption (NOE) for City review, and/or we can prepare supporting technical studies that affirm the applicability of the Exemption. While there are no requirements for a lead agency to respond to comments on an Exemption finding, it is good practice to do so and one that CSG recommends. Once an Action is approved, the NOE is recommended for filing with the County to start the 30-day statute of limitations.
Preparing Initial Studies
When it is determined that a project/action is subject to CEQA and no statutory or categorical exemption/exclusions apply, CSG would recommend that an Initial Study be prepared to determine the level of CEQA clearance that is required. An Initial Study is the common supporting review documentation for a (mitigated) negative declaration determination. In certain instances, we know early on that a proposed activity may have the potential to result in significant impacts and that the preparation of an EIR will be required. In these cases, depending upon a project’s circumstances, CSG can either bypass the preparation of an initial study and immediately proceed with preparing an EIR, or we may recommend that it is beneficial to prepare an Initial Study as a tool for scoping an EIR to only those topical areas that may result in a potentially significant impact.
Preparing EIRs
When there is substantial evidence in which a proposed project or action may result in potentially significant impacts on the environment, CSG provides the technical capabilities and expertise to assist our agency clients in preparing an EIR, including, but not limited to: defining the project description, identifying stakeholders and affected agencies, maintaining the administrative record, preparing and distributing the notice of preparation for a 30 day review, conducting a scoping meeting, preparing supporting technical reports and Administrative Draft EIR for internal review, preparing and circulating the Public Review Draft EIR for a 45 day review period, drafting responses to comments, preparing the Final EIR and Mitigation Monitoring and Reporting Program, preparing Findings of Facts, and, as necessary, preparing a Statement of Overriding Considerations to support a lead agency’s final decision on a project.
Leveraging Knowledge of Local, State, and Federal Regulations CSG regularly works with regulatory agencies through the CEQA process to identify, discuss, and resolve key environmental issues, as well as during the regulatory permitting phases of a project. We have professional working relationships with local, state, and federal agency staff and can facilitate discussions and meetings as needed for items and issues for discussion. Our management and technical staff have excellent working relationships with Caltrans, California Department of Fish and Wildlife, the Regional Quality Control Boards, California Housing and Community Development, the Army Corps of Engineers, and other State and Federal agencies.
Public Input Processes and Dissemination of Information CSG will help the City ensure that responses to public comments received on environmental documents are complete and accurate for the purposes of CEQA. CSG can assist the City in preparing robust community outreach plans that include ongoing public engagement opportunities, or we can attend public hearings and meetings either to answer questions on the City’s behalf or present our findings to the decision-making body. Should any additional/new public comments be raised at these hearings and meetings, CSG can assist the City in appropriately responding to these comments.

19 Ensuring Compliance with Processing and Legal Requirements The CSG team has historically prepared CEQA documentation for low to highly controversial projects and we have an excellent record of legal defensibility for the documentation we prepare. We exercise particular care to ensure that CSG’s environmental documents contain thorough environmental analysis and explicitly document all data sources and research contacts. This approach reduces the potential for successful legal challenges and assists lead agencies in preparing the administrative record. CSG staff are experienced in conducting environmental review for controversial projects and we have developed research and documentation techniques that can reduce the potential for legal challenges.
Quality Assurance/Control
CSG is committed to providing high quality documentation that engenders client satisfaction, meets the needs of the project, and withstands legal scrutiny. Therefore, conducting in-house QA/QC reviews concurrently with the preparation of written technical documents is a critical part of our delivery of technically sound and legally defensible environmental documents. Our approach to achieving the envisioned level of quality includes the following steps: First, our QA/QC process begins with the assignment of staff members who have the appropriate technical expertise to complete the work. Second, all work products are prepared with oversight and review by an assigned technical lead. Third, upon completion of the first internal draft of a technical document or report, it is reviewed by the project manager for consistency with the project description, compliance with the approved scope of work, and technical accuracy. Once the documentation has been revised and updated to the satisfaction of the project manager, it is sent to our technical editor for review of grammar, proper nomenclature, references, and methodology consistency. The last step before the document is submitted to the City is a thorough and complete word processing review that produces a correctly formatted document, with accurate references to tables, exhibits, appendices, and the table of contents. Only then is the document submitted to the City for review.

CITY OF MCFARLAND
STAFF REPORT
TO: Honorable Mayor and City Council Members
FROM: Kenny Williams City Manager
DATE: October 12, 2023
SUBJECT: Report, Discuss, and Approve resolution number 2023-0128 a resolution of the city council approving the expenditure of funds for the rehabilitation of the Browning Well from the city’s enterprise fund (Water) and awarding the project to Bakersfield Well and Pump for the project.
SUMMARY:
In August of 2023 during the scheduled testing of the City’s water wells the city discovered the Browning Well contained nitrate beyond the levels allowed by the California State Water Board.
Upon consultation with the city’s water consultant, Dee Jasper, it was recommended the city obtain pricing on having the well rehabilitated in an attempt to decrease or eliminate the nitrate in the well. Dee Jasper obtained three quotes for the rehabilitation of the Browning Well as listed below:
Bakersfield Well and Pump: $104,115.00.
South Valley Companies: $157,360.00
Farm Pump and Irrigation Co, Inc: $513,205.00
Dee Jasper examined the three quotes and determined all three companies covered the same scope of work and all were reputable companies that could demonstrate the ability to fulfill the contract successfully. Based on the submitted quotes the city determined the lowest quote for the repairs was from Bakersfield Well and Pump.
FINANCIAL IMPACT:
The financial impact is $104,115.00 from the city’s enterprise fund (water).
RECOMMENDATION:
Staff recommends City Council Discuss, and Possibly Approve resolution number 2023-0128 a resolution approving the expenditure of $104,115.00 for the rehabilitation of the Browning Well from the City’s enterprise funds (Water) and awarding the project to Bakersfield Well and Pump. 2 | Page
