SUBJECT: Introduce, by title only Ordinance 11-2024, AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF MCFARLAND AMENDING CHAPTER 5.04 OF

THE MCFARLAND MUNICIPAL CODE RELATING TO BUSINESS LICENSES SUMMARY:

Chapter 5.04 of the McFarland Municipal Code regulates the issuance of business taxes and licenses within the City limits. There are currently uses within the City for which a business license rate is not defined other than the general annual gross receipts.

The proposed ordinance would provide for an additional category called "animal confinement/breeding/raising" which would provide for an annual fee of $2,000 per acre for the business license. This fee is preferable than a "per confined animal" or annual gross receipts since it would be difficult for the City to verify these options, while an acre measurement can be adequately audited.

FINANCIAL IMPACT:

An increase of $146,000 in general fund revenue is estimated from the modifications to the business license fee structure.

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
MCFARLAND AMENDING CHAPTER 5.04 OF THE MUNICIPAL

CODE RELATING TO BUSINESS LICENSES
Section 1. Recitals
WHEREAS, Article XI section 7 of the California Constitution provides authority to the City of McFarland to adopt ordinances and regulations for businesses transacted in the City, and WHEREAS, Chapter 5.04 of the McFarland Municipal Code regulates business license and business license fees, and
WHEREAS, the City currently has no fees identified for businesses that operate animal confinement, breeding, and raising operations.

NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF MCFARLAND DOES ORDAIN AS FOLLOWS:

Section 1. The following is added to Section A of Chapter 5.04.140 as follows:

Section 7. Notice. The City Clerk shall certify to the passage and adoption of this ordinance and shall cause this Ordinance to be posted within 15 days after its passage, in accordance with Section 36933 of the Government Code.

Section 8. Severability. If any section, subsection, sentence, clause, phrase, or word of this Ordinance is, for any reason, deemed or held to be invalid or unconstitutional by the decision of any court of competent jurisdiction, or preempted by legislative enactment, such decision or legislation shall not affect the validity of the remaining portions of this Ordinance. The City Council of the City of McFarland hereby declares that it would have adopted this Ordinance and each section, subsection, sentence, clause, phrase, or word thereof, regardless of the fact that any one or more sections, subsections, clauses, phrases, or word might subsequently be declared invalid or unconstitutional or preempted by subsequent legislation.

Section 9. Effective Date. This Ordinance shall take effect thirty days after its adoption pursuant to California Government Code section 36937.

Section 10. Certification; Publication. The City Clerk shall certify to the passage and adoption of this Ordinance and shall cause the same to be published or posted according to law.
