City Council Meeting

STAFF REPORT
Agenda Item No. 10.

Section: CONSENT AGENDA
Meeting Date: August 26, 2026
TO: Honorable Mayor and Council Members
FROM: Diego Viramontes, City Manager
Paul Saldaña , Economic Development Manager
SUBJECT: Second Reading and Adoption of Ordinance No. 7-2026 AN ORDINANCE OF

THE CITY COUNCIL OF THE CITY OF MCFARLAND, CALIFORNIA
AMENDING TITLE 17 OF THE MCFARLAND MUNICIPAL CODE TO

REMOVE OBSOLETE REFERENCES TO SECONDARY UNITS AND

SECONDARY RESIDENTIAL UNITS AND TO CONFORM TERMINOLOGY

TO ACCESSORY DWELLING UNITS
SUMMARY:

Over the past several years, California has enacted numerous amendments to State Accessory Dwelling Unit (ADU) laws intended to increase housing opportunities and streamline local approval processes. Consistent with State law, the City adopted Ordinance No. 1-2024 updating its ADU regulations and replacing older approaches to second-unit development with a modern ADU framework. The City's Housing Element notes that the former Section

17.12.090, entitled "Secondary Units," was replaced by the City's updated ADU regulations adopted in February 2024, and that the City amended its zoning regulations to conform with State ADU law.

As a result of those updates, several obsolete references remain within Title 17 of the Municipal Code. These references continue to utilize older terminology such as "Secondary Units" and "Secondary Residential Units," which is inconsistent with current State law and the City's adopted ADU regulations. Staff has identified several sections that should be amended to ensure consistency throughout the Municipal Code.

The proposed ordinance is a housekeeping measure intended to update terminology, remove obsolete provisions, and improve consistency throughout the zoning code. It does not create new development entitlements, expand allowable densities, or modify existing development standards applicable to ADUs beyond those previously adopted by the City. The proposed changes are:

Repeal the following obsolete sections:
• Section 17.12.090, "Secondary Units"
• Section 17.040.625, "Secondary Residential Unit"
These provisions were originally adopted prior to the City's comprehensive ADU update and contain terminology and regulatory approaches that are no longer consistent with

Page 60 of 103 ends

current State ADU requirements.

Renaming of Section 17.136.150: The ordinance changes the title of Section 17.136.150 from "Additional Dwelling Units" to "Accessory Dwelling Units." This amendment aligns the Municipal Code with terminology used under California Government Code Section 65852.2 and the City's adopted ADU ordinance.

Conforming Terminology Amendments: The ordinance also updates references contained in Section 17.152.030 by replacing the term "Secondary Residential Units" with "Accessory Dwelling Units" in subsections:
• 17.152.030(4)
• 17.152.030(11)
• 17.152.030(12)
These amendments are intended solely to ensure consistency throughout the Municipal Code and avoid confusion for property owners, applicants, city staff, and decision-makers.

Consistency with General Plan and Housing Element
The proposed amendments are consistent with the City's Housing Element and recent efforts to implement State housing legislation. The Housing Element acknowledges the City's adoption of updated ADU regulations and identifies ADUs as an important component of the City's housing strategy. The proposed amendments further those efforts by eliminating outdated terminology and conforming municipal code references to current regulations.

Environmental Review
The proposed ordinance is exempt from the California Environmental Quality Act (CEQA) pursuant to CEQA Guidelines Section 15061(b)(3), commonly known as the "Common Sense Exemption," because it can be seen with certainty that the proposed amendments will not have a significant effect on the environment.

The ordinance consists solely of technical and conforming amendments to the Municipal Code.

The ordinance does not approve any development project, authorize additional development intensity, expand density allowances, or create any new land use entitlement.

FINANCIAL IMPACT:

No fiscal impact is anticipated as a result of the proposed ordinance. Implementation of the ordinance will be completed through existing staff resources.

RECOMMENDATION:

Introduce and waive the first reading of Ordinance No. 7-2026.

MCFARLAND, CALIFORNIA AMENDING TITLE 17 OF THE

MCFARLAND MUNICIPAL CODE TO REMOVE OBSOLETE

REFERENCES TO SECONDARY UNITS AND SECONDARY

RESIDENTIAL UNITS AND TO CONFORM TERMINOLOGY TO

ACCESSORY DWELLING UNITS
Section 1. Recitals
WHEREAS, the City of McFarland maintains zoning regulations in Title 17 of the McFarland Municipal Code; and

WHEREAS, the City Council finds that the proposed amendments will improve clarity and consistency within the City’s zoning regulations.

NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF MCFARLAND DOES ORDAIN AS FOLLOWS:

Section 1. Findings. The foregoing recitals are true and correct and are incorporated herein by reference.

Section 2. Repeal of section 17.12.090. Section 17.12.090, entitled “Secondary Units,” is hereby repealed in its entirety.

The Ordinance consists solely of technical and conforming amendments to the McFarland Municipal Code.

Section 7. Codification. The City Clerk is directed to transmit this Ordinance to the City’s codifier. The codifier may make minor, nonsubstantive changes to formatting, numbering, and cross-references as necessary to properly integrate these amendments into the McFarland Municipal Code.

Section 3. Severability. If any section, subsection, sentence, clause, phrase, or portion of this Ordinance is held invalid or unconstitutional by a court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this Ordinance. The City Council declares that it would have adopted this Ordinance and each portion thereof irrespective of the fact that any one or more portions may be declared invalid.

Section 4. Effective Date. This Ordinance shall take effect thirty (30) days after its adoption.

Section 5. Certification; Publication. The City Clerk shall certify to the adoption of this Ordinance and shall cause it to be published in the manner required by law.

SUBJECT: Approval of Resolution No. 2026-102 A RESOLUTION OF THE CITY

COUNCIL OF THE CITY OF MCFARLAND, CALIFORNIA APPROVING A

SERVICE AGREEMENT WITH GOGOV, LLC FOR CITIZEN

NOTIFICATIONS, MOBILE APPLICATION, VOICE CALLS, AND SMS TEXT

MESSAGING SERVICES
SUMMARY:

The City of McFarland continues to place a strong emphasis on communication, transparency, and public outreach. As more City services and information become available online, staff continues to identify opportunities to make those resources easier and faster for residents to access.

Staff is proposing the implementation of GOGov's GONotify platform, which would provide the City with a centralized communication platform and branded mobile application. The application would serve as a convenient access point connecting residents with the City's existing online resources, including the City website, permitting services, online payment systems, social media platforms, and other digital services.

Most importantly, the platform would significantly expand the City's ability to communicate time-sensitive information directly to residents. Through mobile push notifications, SMS text messages, voice calls, email, social media, and other communication channels, the City would be able to quickly distribute important updates such as:
• Water service notices and emergency notifications
• Utility billing reminders and billing cycle information • Road closures and traffic impacts
• Community events and recreation information
• City Council and public meeting information
• Facility closures
• Election and holiday information
• Public safety and weather-related notifications
• Other time-sensitive City announcements
GONotify would complement the City's recent investments in its website and other digital services and continue the City's progress toward a more accessible, responsive, and

Page 65 of 103 ends

connected local government. Providing information directly to residents' mobile devices gives the City an additional tool to communicate quickly while making everyday City services more convenient to access.

FINANCIAL IMPACT:

The proposed GOGov services have an annual subscription cost of $5,800 for the initial 12- month term.

The annual cost consists of:
• GONotify Citizen Notifications & Alerts – Unlimited Subscription: $4,800 per year • Voice and SMS Text Messaging – 25,000 credits annually: $1,000 per year • Implementation/Service Cost: $0
• Total Annual Cost: $5,800
The initial subscription term is 12 months. Under the proposed agreement, subsequent annual renewals may include an increase of up to 7 percent.

Funding for the initial $5,800 subscription will be provided through the Communications and Marketing budget, Professional Services allocation. The cost is currently budgeted and sufficient existing appropriations are available.

RECOMMENDATION:

That the City Council of the City of McFarland approve Resolution No. 2026- 102 authorizing the City Manager to execute the service agreement with GOGov, LLC for GONotify Citizen Notifications & Alerts and Voice/SMS messaging services at an initial annual cost of $5,800 and authorize staff to proceed with implementation of the City's citizen notification platform and mobile application

City of McFarland
City Council Meeting

STAFF REPORT
Agenda Item No. 12.

Section: ADMINISTRATIVE
AGENDA
Meeting Date: August 26, 2026
TO: Honorable Mayor and Council Members
FROM: Diego Viramontes, City Manager
Adrian Olmos, Chief of Police
SUBJECT: Approval of Resolution No. 2026-99 A RESOLUTION OF THE CITY COUNCIL

OF THE CITY OF MCFARLAND, CALIFORNIA AUTHORIZING THE
PURCHASE AND UPFITTING OF THREE (3) POLICE VEHICLES AND APPROVING A BUDGET ADJUSTMENT IN THE AMOUNT OF $52,537.70

FROM THE GENERAL FUND TO THE VEHICLE CAPITAL FUND TO
PURCHASE THREE (3) POLICE DEPARTMENT VEHICLES THROUGH PHIL

LONG FORD OF DENVER, LLC
SUMMARY:

The McFarland Police Department relies on a dependable fleet of patrol vehicles to conduct emergency response, traffic enforcement, proactive patrol, community policing, prisoner transportation, and other daily law enforcement activities. Reliable vehicles are essential to maintaining effective response capabilities and providing officers with the equipment necessary to perform their duties safely and efficiently. As the City of McFarland continues to grow and the Police Department expands its staffing to meet increased public safety demands, replacement and assignment-specific vehicles are needed to replace damaged or aging units, support SRO services, and maintain adequate fleet availability.

Staff is requesting authorization to purchase three (3) 2026 Ford Police Interceptor Utility AWD, police-pursuit-rated vehicles from Phil Long Ford of Denver, LLC. The proposed vehicles are currently identified by the vendor as in-stock pre-build units and include lawenforcement-specific equipment and patrol upfitting. Two vehicles are configured as standard patrol pre-build units, and one is configured as a slick-top pre-build unit.

All three vehicles were included in the City’s budget planning. One vehicle was budgeted as a replacement for a totaled patrol vehicle and will be reimbursed through an insurance claim.

The second was budgeted as an SRO vehicle and will be reimbursed through the City’s SRO contract with the McFarland Unified School District. The third was budgeted through the City’s annual allocation for fleet replacement. However, the original $205,000 appropriation was based on preliminary estimates and was insufficient to cover the final vehicle, equipment, upfitting, transportation, painting, tax, and registration costs.

The Department’s patrol vehicles operate under conditions that are substantially more demanding than normal passenger vehicle use. Patrol units routinely remain in service for extended periods, operate for significant periods at idle, respond under emergency conditions,

Page 76 of 103 ends

and carry communications equipment, emergency lighting, computers, weapons-security systems, prisoner-transport equipment, and other specialized law enforcement equipment.

The proposed Ford Police Interceptor Utility vehicles provide the passenger and cargo capacity, all-wheel-drive capability, durability, and police-specific features necessary for frontline patrol operations. The quoted vehicles include features such as police engine idle, backup cameras, reverse sensing, keyless entry, police-specific rear-door configurations, and other factory equipment intended for law enforcement use.

Phil Long Ford of Denver has quoted two patrol pre-build vehicles at a combined cost of $148,955.94, including the vehicle cost, pre-build patrol upfitting, contract discounts, and transportation to Airwave Communications in Bakersfield. The third vehicle is a slick-top patrol configuration quoted at $72,360.33, including the vehicle, pre-build upfit, applicable contract discounts, and transportation to Bakersfield. The Phil Long Ford quotations utilize price agreement TIPS Contract No. 240901, allowing the City to obtain established cooperative contract pricing for the vehicles and related upfitting.

Airwave Communications will complete additional equipment installation necessary to finish each vehicle for McFarland Police Department operations. The additional equipment includes computer docking equipment, prisoner seating and mounting hardware, weapons-security equipment, antenna components, switches, installation materials, and labor. Each of the three Airwave quotations totals $5,732.83 per vehicle, inclusive of quoted sales tax.

The Department has also obtained a quote for the required exterior door painting associated with the black-and-white police vehicle configuration. The painting quote is $2,093.77 for a 2026 Police Interceptor. Applicable California use/sales tax of $4,625.00 per vehicle will also be required when the vehicles are registered at the DMV for City use, for a total of $13,875.00.

Once completed, the three vehicles will maintain and improve the number of operational patrol units available to officers, provide appropriate cargo capacity for emergency and specialized equipment, and improve fleet reliability.

One in-service Police Department patrol vehicle purchased in 2025, was previously determined to be a total loss after it was involved in an on-duty vehicle accident. The City’s claims administrator, Sedgwick, has approved a total-loss claim, and the Department anticipates receiving approximately $82,524 in insurance proceeds. In addition, the SRO vehicle will be reimbursed through the City’s SRO contract with the McFarland Unified School District, while the third vehicle is supported by the City’s annual fleet-replacement allocation.

The insurance proceeds and MUSD reimbursement are anticipated to offset the applicable vehicle costs and replenish the General Fund following receipt.

Approval of the proposed purchase and budget adjustment will allow staff to secure the vehicles, complete the required equipment installation and vehicle preparation, and place the units into service for front-line law enforcement operations.

FINANCIAL IMPACT:

The total estimated cost to purchase, equip, upfit, register, and place the three Police Department vehicles into service is $257,537.70. The Vehicle Capital Fund currently includes $205,000.00 budgeted for police vehicle purchases. Therefore, an additional $52,537.70 is

Page 77 of 103 ends

required to complete the project. Staff recommends a budget adjustment transferring $52,537.70 from the General Fund to the Vehicle Capital Fund. This additional appropriation is necessary because the actual purchase and upfitting costs exceeded the preliminary budget estimates.

The anticipated insurance reimbursement of approximately $82,524 associated with the previously totaled patrol vehicle is expected to offset and replenish the General Fund following receipt of the claim proceeds. The SRO vehicle will also be reimbursed through the City’s contract with the McFarland Unified School District, and the third vehicle was included in the City’s annual fleet-replacement allocation. Accordingly, the requested budget adjustment does not represent the final net General Fund cost of all three vehicles.

RECOMMENDATION:

Staff recommends the City Council approve the purchase and upfitting of three (3) patrol vehicles from Phil Long Ford, LLC and approve a budget adjustment in the amount of $52,537.70 from the General Fund to the Vehicle Capital Fund.

Credits or refunds for returns will not include prior shipping or service charges. Special or custom orders are non-refundable.

Some parts may be substituted.

The price includes parts and return shipping to the customer.

The customer is responsible for shipping the radios to Airwave's facility. If a radio is deemed unrepairable, it can either be returned to the customer or recycled by Airwave for a $65.00 fee, plus shipping and handling (based on actual cost). Any unclaimed units after 90 days will be recycled. This fee can be waived if a new radio unit is purchased as a replacement. A $65.00 diagnostic fee will apply if the in-house repair rate is not approved by the customer. There is a 90-day warranty on labor.

Both original and aftermarket parts may be used. A $25

Airwave can only guarantee pricing for 30 days from the date the quote is issued. After 30 days, a new quote must be provided to reflect any manufacturer cost adjustments. For the most up-to-date pricing and availability, please consult your Airwave representative.

Modifications or Additions to Terms and Conditions:

No modifications, additions, or waivers of any of these terms and conditions shall be binding unless provided in writing and agreed upon by the Seller.

Airwave Communications reserves the right to charge for time and effort in gathering this information if intended for RFP, RFQ, or similar purposes. We are not responsible for equipment failures due to testing, programming, or rebooting resulting from age, wear, tear, or factors beyond our control. Additional charges apply for delays that cause stand-by time during the job. Monitoring provides a snapshot of frequency noise at the time of testing and does not guarantee protection from future interference. Additional parts and work outside the Schedule of Work will be billed at time and material rates. The seller reserves the right to make design improvements to goods without notice. Airwave reserves the right to correct any errors in prices or quantities for products or services. All work is scheduled during regular business hours and requires uninterrupted site access.

This proposal does not include ongoing monitoring, maintenance services, spare equipment, or third-party system integrations unless otherwise noted. Prevailing wage is assumed not required. Prevailing wage rates and certified payroll reporting are excluded unless explicitly included in the quoted scope. Delays in radio unit availability on programming day may result in extra charges.

Payment Terms:

Payment is due in full per the agreed net terms from the invoice date.

For sales over ten thousand dollars, 30% is due at PO issuance, 30% upon receipt of equipment or parts at our facility, and the remaining balance upon delivery or pickup. Any changes to these terms must be made in writing. Invoices not paid within the agreed net terms will incur a charge of 0.833 percent per month (ten percent annually) after a 7-day grace period. Customers will be notified of late fees within ten business days. Payments apply first to late fees, then to principal. Late fee disputes must be submitted in writing within thirty days. Terms may change with thirty days notice. Invoices unpaid for over ninety days may be sent to collections, and customers will be responsible for all associated fees. These terms are governed by California law. A three-and-a-half percent service fee applies to credit card transactions.

Customer to Provide:

FCC frequency(s) and channel setting(s), 110 A/C power at the agreed equipment location, site access, shaded area, Wi-Fi access (if needed), clear radio placement instructions
(dash/console/desktop/rack, etc.), conduit between rooms or roof, and a lift (if required). For outfitting, vehicle drop-off and pickup must be as scheduled. All personal belongings, weapons, gear, etc., must be removed before delivery. We are not responsible for items left in vehicles. Stand-by time, waiting for POC, vehicles, or delays will be charged at time and materials rates.

Return:

A Return Authorization (RA) number must be requested and issued before returning any products to Airwave Communication. Most products may be returned within thirty (30) days of shipment without a restocking fee if in original packaging and condition for resale. After thirty (30) days, a twenty percent (20%) restocking fee will apply, with a net account credit but no refund unless agreed upon in writing in advance. Credits or refunds for returns will not include prior shipping or service charges. Special or custom orders are non-refundable.

Some parts may be substituted.

Cancellation:

Buyer may cancel an order only with the seller’s written consent, and the seller is entitled to reasonable cancellation charges, including but not limited to labor, material, and overhead expenses. The seller reserves the right to deduct cancellation charges from any advance payment received from the buyer.

Radio Repair:

shipping and handling fee applies to radios under manufacturer warranty. This rate does not cover liquid or physical damage, engraving, licensing, or accessories (batteries, antennas, mics, etc.). Programming is an additional fee if required. Prices are subject to change without notice.

A minimum 3-day rental charge applies. The quoted equipment is for general use. Specific building layouts, vehicle designs, or topological conditions may require additional equipment. FCC itinerant channels are shared commercial frequencies; Airwave does not guarantee service continuity or protection from interference. Prices and promotions are subject to expiration; please consult your Airwave representative for details.

Additional taxes, fees, and other charges may apply. Rental equipment reservations require a 30-day advance notice. The customer is solely responsible for the equipment. Service repairs or alterations to rental equipment are prohibited without prior written authorization from Airwave. The customer will be charged the full retail price for any lost, stolen, or damaged equipment. Additional charges apply for usage beyond the agreed rental period.

Airwave Communication will not share your personal data with any third party, except as necessary to provide and maintain services under these Terms and Conditions.

Important Pricing & Supply Chain Notice:

Recent changes in U.S. trade policy—including the
implementation of new tariffs on select foreign imports—have impacted the cost structure of components used across our product portfolio. Combined with ongoing volatility in the national supply chain, customers may experience extended lead times and price fluctuations for certain products and services.

City of McFarland
City Council Meeting

STAFF REPORT
Agenda Item No. 13.

Section: ADMINISTRATIVE
AGENDA
Meeting Date: August 26, 2026
TO: Honorable Mayor and Council Members
FROM: Diego Viramontes, City Manager
SUBJECT: Approval of Resolution No. 2026-100 A RESOLUTION OF THE CITY

COUNCIL OF THE CITY OF MCFARLAND, CALIFORNIA APPROVING
ADDENDUM NO. 1 TO THE MEMORANDUM OF UNDERSTANDING

BETWEEN THE CITY OF MCFARLAND AND THE MCFARLAND POLICE

OFFICERS ASSOCIATION
SUMMARY:

The City of McFarland and the McFarland Police Officers Association (MPOA) have reached agreement on updates to the existing Memorandum of Understanding (MOU) to reflect previously approved compensation changes, the City's transition to the California Public Employees' Retirement System (CalPERS) for sworn personnel, an extension of the agreement through June 30, 2030, and other agreed-upon administrative and benefit revisions.

The proposed Addendum No. 1 memorializes these negotiated terms while leaving all other provisions of the existing MOU unchanged. The MPOA membership has voted in favor of the terms contained in the Addendum.

Following approval of the Addendum, the City and MPOA intend to work toward incorporating these changes into a consolidated and updated MOU so that the governing terms are contained within a single agreement. Any consolidated MOU will be reviewed and approved by both parties and presented to the City Council for consideration.

DISCUSSION:

The proposed amendments include the following:

1. Article 3: Recognition - Classifications
Update the recognition and classification language to include the Police Emergency Dispatcher and Lieutenant classifications within the bargaining unit.

2. Article 4: Term - Agreement Term
Extend the MOU through June 30, 2030. The agreement will remain in effect following expiration until a successor agreement is negotiated and adopted or new terms are lawfully implemented.

3. Article 15: Salaries and Compensation - Performance Evaluations Clarify that newly hired employees in covered classifications, including lateral hires and Police Officer Trainees, serve a twelve-month probationary evaluation period. A Police Officer Trainee who graduates from the Police Academy and promotes to Police Officer

Page 91 of 103 ends

will begin a new twelve-month probationary period.

Employees receiving internal promotions will continue to serve a six-month promotional probationary evaluation period.

4. Article 15: Salaries and Compensation - Compensation Update the MOU and salary schedules to reflect previously approved wage adjustments, including the salary adjustment for sworn classifications, subsequent salary adjustments, reclassifications, and additions.

The existing 2.5% annual Cost of Living Adjustment (COLA) will continue during the extended term as follows:
• 2.5% effective July 1, 2027;
• 2.5% effective July 1, 2028; and
• 2.5% effective July 1, 2029.

5. Article 15: Salaries and Compensation - Uniform Allowance Provide Animal Control/Code Enforcement Officers and the Animal Control/Code Enforcement Supervisor with an annual uniform cleaning and replacement allowance of $450, consistent with the benefit currently provided to Police Office Technicians.

6. Article 16: Health and Ancillary Benefits - Retirement Benefits Update the MOU to reflect the City's transition of sworn personnel to CalPERS and remove obsolete provisions associated with the City's prior retirement plan. Retirement benefits will be administered consistent with the City's CalPERS contract, applicable law, and CalPERS rules and regulations.

7. Comparable Benefits Provision
Include language providing that the City will make a good faith effort to extend comparable benefits or provisions provided to sworn personnel to miscellaneous personnel where appropriate and consistent with operational needs, legal requirements, and fiscal considerations.

The MPOA has voted in favor of the terms contained in Addendum No. 1. The Addendum has also been reviewed by the City's labor counsel.

As a longer-term administrative step, the City and MPOA intend to incorporate the provisions of the Addendum into a consolidated MOU. This will allow the parties to maintain a single updated agreement rather than relying on the existing MOU together with a separate addendum. The consolidated MOU will not alter the substantive terms approved through this Addendum without mutual agreement and will be brought back to the City Council for consideration.

FINANCIAL IMPACT:

The Addendum primarily memorializes compensation and retirement changes previously approved or implemented by the City. The extended agreement also continues the existing

2.5% annual COLA through June 30, 2030.

The $450 annual uniform allowance for eligible Animal Control/Code Enforcement personnel and future COLAs will be incorporated into the City's annual operating budgets. Other

Page 92 of 103 ends

administrative revisions do not create material fiscal impacts beyond the obligations established by the agreement.

RECOMMENDATION:

Staff recommends that the City Council adopt the attached Resolution No. 2026-100 approving Addendum No. 1 to the Memorandum of Understanding between the City of McFarland and the McFarland Police Officers Association and authorize the City Manager to execute the Addendum and implement its provisions.
